(County Attorney's request) Time Certain Items: Items 9A and 9B to be heard immediately following Item 5A 01/24/2017 EXECUTIVE SUMMARY Recommendation to hold one of two required hearings for Land Development Code amendments at 5:05 p.m. on Tuesday, March 14, 2017. OBJECTIVE: To present to the Board of County Commissioners (Board) Land Development Code (LDC) amendments that change the actual list of permitted and conditional uses within the Golf Course (GC) Zoning District at two hearings on Tuesday, March 14, 2017, at 5:05 p.m., and Tuesday, March 28, 2017, at 9:00 a.m. CONSIDERATIONS: The current LDC amendment cycle includes proposed changes that amend the zoning atlas or that change the actual list of permitted, conditional, or prohibited uses of land within several zoning categories. These amendments require public notice pursuant to LDC section 10.03.06 K. This LDC section states that two Board meetings are required, and at least one hearing shall be held after 5:00 p.m. on a weekday, unless by super majority vote the Board elects to conduct the hearing at another time of day. To encourage public participation at these hearings, staff proposes that a nighttime hearing is held for this ordinance. The LDC amendments propose the following: 1) Adding uses to the list of permitted and conditional uses in the Golf Course (GC) Zoning District, 2) Adding a new section to address golf course conversions, 3) Amending the on-site and off-site native vegetation retention requirements, and 4) Addressing stormwater management for single-family dwellings, two-family dwellings, and duplexes. It should be noted the Collier County Planning Commission (CCPC) has held or scheduled public hearings on the following dates: Thursday, December 15, 2016, at 9:00 a.m. Thursday, January 5, 2017, at 9:00 a.m. Thursday, January 19, 2017, at 9:00 a.m. Monday, January 30, 2017, at 5:05 p.m. The CCPC will review and provide recommendations regarding these amendments to the Board. FISCAL IMPACT: There are no fiscal impacts associated with this Executive Summary. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and it requires a majority vote for approval. - HFAC GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary.
