Agenda 01/10/2017 Item #16A14 16A14 01/10/2017 EXECUTIVE SUMMARY Recommendation to Approve an Extension of the Interlocal Agreement between the City of Naples and Collier County for Contractor Licensing by Collier County. OBJECTIVE: That the Board of County Commissioners approve an extension of the current Interlocal Agreement between the City of Naples and Collier County for contractor licensing by Collier County. CONSIDERATIONS: Collier County and the City of Naples have been parties to an Interlocal Agreement setting forth the County's responsibilities concerning the issuance of contractor licensing (excluding lawn maintenance) since 1992. The parties have found that the implementation of a City- County license has proved beneficial to both the City and County governments and its contractors. Having the County issue licenses and conduct investigations of violations of the Contractors' Licensing Board Ordinance facilitates uniform application to both the City and the County. The Contractors' Licensing Board has at least two members who reside within the corporate city limits and have been recommended by the City Council. The current Interlocal Agreement is scheduled to terminate on February 6, 2017. The attached proposed extension to the Interlocal Agreement amends the termination date to run through February 6, 2022. FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and requires majority vote for Board approval.-SRT RECOMMENDATION: To approve the Extension of Interlocal Agreement between the City of Naples and Collier County for contractor licensing extending the termination date through February 6,2022. The County shall be responsible for issuing licenses to contractors working with the County and/or City in accordance with County Ordinance No. 90-105, as amended. (latest amendment is Ordinance No. 2006-46) (with exception of a. paragraph 1.3.1. Owner-Builders) and subsequent amendments and ordinances related thereto. J 2. The County shall collect the licensing fees for those contractors licensed to work o within the County and/or City for issuance of a countywide license. 3. The County shall provide the staff supervision, equipment and supplies necessary (- to issue all new and renewed contractors' licenses covered under this agreement �r and to provide all supervisory and investigative personnel necessary to investigate co; and prosecute unlicensed contractors before the applicable disciplinary boards, as well as investigate all related complaints. 4. The Collier County Contractor Licensing Supervisor shall supervise all Contractor Licensing investigations and advise the County's Building Division of same. O 5. The County shall provide the City with monthly reports of the licensing and investigation activities within the City. The report is to include all activities related to licensing and enforcement within the City limits of Naples, including current specific complaints, investigations in progress, pending hearings and court cases and disposition of such cases. The County shall provide the City monthly reports of all contractors currently licensed in the County and City. a 7. The combined County/City Contractor Licensing Board shall hear all disciplinary 0U matters. The composition of the Contractor's Licensing Board shall include a _ minimum of two members who reside within the corporate city limits of Naples or shall be recommended to the Board of County Commissioners by the Naples 0 oo City Council. a 8. This Interlocal Agreement shall be in effect for a period of five (5) years z beginning February 7, 2017. o a 9. E C, d BACKGROUND: Q On July 15, 1992, City Council approved an Interlocal Agreement by Resolution 92-6689 for the County to issue Contractor licenses, with the exception of lawn maintenance, in an effort to j o streamline the licensing process and avoid duplication of services. On December 14, 2011, the City ' 13 and Collier County approved Resolution 11-13007 to renew the Interlocal Agreement for a period of five (5).years to expire on February 7, 2017. This system continues to work well for both the County and City. By streamlining the licensing and investigation process, unnecessary duplication of services for City contractors has been eliminated, o Collier County continues to provide thorough investigation of unlicensed contractors and reprimands through the Collier County Licensing Board, The City has determined that the initial implementation of this service and its' continuation is advantageous to all parties involved and therefore it is staff's cs desire to renew the Interlocal Agreement for a period of five (5) years with Collier County. RECOMMENDED ACTION: Adopt a Resolution approving an Interlocal Agreement between the City of Naples and Collier E County for contractor licensing by Collier County; and authorizing the Mayor to execute the Interlocal c Agreement.
