Agenda 12/13/2016 Item #16D10 16.D.10 12/13/2016 EXECUTIVE SUMMARY Recommendation to approve a Memorandum of Understanding with the Southwest Florida Workforce Development Board which will provide funds to allow up to 130 children to receive recreational opportunities at Collier County Parks and Recreation facilities during the summer. OBJECTIVE: To allow up to 130 children to participate in recreation programs during the summer. CONSIDERATIONS: The Parks and Recreation Division provides recreation experiences for children throughout Collier County. In Immokalee, recreation programs are provided at the Immokalee Community Park and Immokalee South Park. The Southwest Florida Workforce Development Board is again participating in a community-wide initiative for 2017 called the Immokalee Out-Of-School Time Initiative (IOSTP). This program seeks to provide recreational opportunities for the children of Immokalee during the summer. Recreational opportunities include; field trips, cultural, athletic, educational, and water activities. Children will participate in a variety of different art, music, fitness and educational opportunities that teach good sportsmanship. Also included is the implementation of"7 Habits of Happy Kids" throughout each Parks and Recreation out-of-school program. The Memorandum of Understanding provides up to 130 children with these opportunities during the summer. This is the second year the Southwest Florida Workforce Development Board has approached Collier County Parks and Recreation Division to partner in this summer camp initiative. FISCAL IMPACT: To provide the appropriate staffing for the IOSTP program, personal service and operating costs will be impacted in the amount of $78,500. The Southwest Florida Workforce Development Board will provide up to $78,500 to fund the summer enrichment program(summer camp), depending on staff needs based on the number of participants. It is estimated that the program will have between 50 and 130 participants. The reimbursed amount will cover the personal service and operating costs as well as the cost of supplies and equipment necessary to run the program. Funds have been budgeted in the appropriate Park cost centers within the MSTD General Fund(111). GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for approval. - CMG RECOMMENDATION: That the Board of County Commissioners approves and authorizes the Chairman to sign the MOU with the Southwest Florida Workforce Development Board. O L This Memorandum of Understanding is entered into between the Southwest Florida Workforce Development ° Board, Inc. (hereinafter referred to as the"SFWDB") and Collier County, a political subdivision of the state of Florida through its Collier County Parks and Recreation Department(hereinafter referred to as the"Parks and Recreation"). I.Purpose The purpose of this Memorandum of Understanding is to support the implementation of the Naples Children and c°n Education Foundation Immokalee Out-of-School Time Initiative (IOSTP), locally known as GPS (Great Programs c" Synergizing), in Collier County, Florida, in a 2017 Summer Project to provide up to 130 students (80 at N Community Park, 50 at South Park) with summer camp and tutoring programs. The project is funded by the Naples Children and Education Foundation from June 1, 2017,through August 31, 2017. O II. Services to be Provided by Parks and Recreation Parks and Recreation agrees to: o A. Provide a 9-week (5 days a week) summer program to 130 kindergarten through 5`h grade students (80 ca at Community Park; 50 at South Park); B. Conduct the program at the cost of$550.00 per student or a total budget not to exceed $71,500.00, o which shall include field trips and appropriate snacks; C. Report in writing on agreed upon deliverables (Attachment A) to include: (1) attendance verification for all students attending the Community Park and South Park Summer camps; and, (2) pre-and post- a assessment results in at least one (1) academic area; D. Collaborate with GPS to include GPS provided academic tutoring in student schedules; E. Implement the 7 Habits of Happy Kids ubiquitously throughout each Parks and Recreation time program; F. Provide transportation by Parks and Recreation vehicles (vans) as needed for program delivery within the fixed budget not to exceed $7,000.00 G. Participate in GPS meetings to provide reports and updates and to offer programmatic suggestions; H. Maintain usual and customary records to be available upon request; J. Submit invoices to SFWDB for services rendered to include materials/supplies, personnel. Such invoices may be computer-generated and may be in electronic, facsimile, or paper format; and, K. Submit final invoice no later than September 15,2017. Failure to submit final invoice and report by September 15, 2017, will constitute breach of contract and may result in the forfeiture of all or partial funding. 0 III. Services to be Provided by the Workforce Board y a. The Workforce Board agrees to: A. Provide reimbursement services to Parks and Recreation as necessary and documented to support the ca implementation of the 2017 Summer Program for a total funding amount not to exceed $78,500.00;funds shall support: (1)the Immokalee Community Park camp scholarships,not to exceed$44,000.00; (2)the Immokalee South Park camp scholarships,not to exceed$27,500.00;and, (3)the use of Parks and `o Recreation vans as necessary for program implementation,not to exceed$7,000; B. Provide weekly tutoring services and resources to all students enrolled in both Community and South Park o facilities;and, 0 C. Provide one Project Director to assist Parks and Recreation in the full implementation of the IOSTP 2016- t, 2017 Summer Project. 0 IV. General Conditions co N V7 A. Parks and Recreation and its representative signing this document attest that: N 1. Parks and Recreation as an organization in part or as a whole is not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions by .° any federal department or agency; and, 2. Parks and Recreation or any of its agents are not suspended or debarred or otherwise excluded from receiving Federal funds. 0 B. Parks and Recreation and the Workforce Board agree that: n. 1. Each party is solely responsible for the negligent acts or willful omissions of its own designated agents and agrees to hold the other parties harmless against any claim or suit, including all costs and attorney's fees arising from the act, omission, or negligence of its own officers, agents, volunteers or V4- employees, employees, including, but not limited to, claims or suits based on allegations of discrimination on the basis of race, creed, color, national origin, gender, age, sexual orientation, or disability; 2. The parties to this Memorandum of Understanding who are State agencies or subdivisions of Florida c agree to be responsible for the negligent acts or willful omissions of their own designated agents . only to the extent allowed by § 768.28, Florida Statutes; Page 2 of 4 CAO Packet Pg.1286 16.D.10.a 'arksRecreation CiPg201 f,;_17 3. Each party agrees to maintain the confidentiality of any shared student records as required by Florida and Federal law, and that such records shall be used only for purposes allowed under § 1002.22, Florida Statutes, and shall be shared only with written parental permission; and 4. Each party commits to support the other in its implementation and to work collaboratively with the other and in consultation with the Florida Department of Education program office if any changes, adjustments, or improvements to this arrangement become necessary or desirable. 0 is V. Duration of Memorandum of Understanding '2 This Memorandum of Agreement shall begin when signed by all parties and shall end on September 15, 2017, ° except as provided in Article V ("Termination") of this Memorandum of Understanding. It is understood that this agreement may be amended during the program year at the direction of the Naples Children and Education Foundation or as a result of programmatic need. Any such revisions shall be in writing and agreed o upon by both parties. VI. Termination N Either party to this Memorandum of Understanding may terminate its responsibilities and agreements made herein upon no less than thirty (30) days advance notice to each of the other parties. In the event of termination o by either party, payment will be made by the Workforce Development Board to Parks and Recreation for .— services rendered through the effective date of termination.
