Agenda 12/13/2016 Item #16A41 16.A.41 12/13/2016 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to sign a Quit Claim Deed between Collier County ("County") and TT of Lake Shore, Inc. ("Developer") in order to reconvey to Developer a public access easement associated with the development project at Naples Infiniti - Volvo, PL20160000297, that was previously erroneously conveyed to the County. (Companion to ID #2419) OBJECTIVE: To correct the erroneous conveyance of a public access easement to the County for the Naples Infiniti -Volvo project. CONSIDERATIONS: On August 5, 2016, TT of Lake Shore, Inc., ("Developer"),the owner of Lot 2, Pine Air Lakes Unit 6,recorded a public access easement over a portion of their property in favor of the public for vehicular and pedestrian ingress and egress. The access easement is a requirement of Section 7.14 A (Transportation Element) the Pine Air Lakes PUD No. 07-32 to ensure interconnectivity throughout the subdivision. The subject easement was intended to connect Naples Boulevard to Hollywood Drive as shown on the attached location map. During the review of the Site Development Plan (SDP) for Lot 2 (PL20160000297) it was determined that the easement was granted to the public over the wrong portion of the property. The county, on behalf of the public, has not accepted the recorded access easement, and will quitclaim its interest in the access easement back to Developer. The Developer is aware of the error and has agreed to accept reconveyance of the access easement. The Developer will convey a new access easement in favor of the public over the correct portion of the property as part of the Naples Infiniti -Volvo plat which is a companion to this item. Staff has reviewed the proposed SDP and concurs that the easement will better serve the public in the proposed location. FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary, the applicant will be responsible for recording fees. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires a majority vote for Board approval. - SAS RECOMMENDATION: To approve and authorize the Chairman to execute the attached Access Easement Quit Claim Deed, and authorize the Clerk to record the Quit Claim Deed in the public records.
