Agenda 11/15/2016 Item #16D 1 16D.1 11/15/2016 EXECUTIVE SUMMARY Recommendation to adopt a Resolution repealing all previous resolutions establishing and amending parts of the Collier County Parks and Recreation Division Facilities and Outdoor Areas License and Fee Policy and establishing the policy anew to modify the fitness membership corporate discount to include not-for-profit organizations. OBJECTIVE: To revise and update the existing policy in order to include 501(c)3 not-for-profit organizations. CONSIDERATIONS: The Collier County Parks and Recreation Division's operations have historically been funded from a variety of sources, including fitness membership fees, as well as general revenues. The financing of recreation services has relied on a balance between these user fees and charges and contributions from the Countywide and Unincorporated general funds. User fees and charges are established by the Board within the Collier County Parks and Recreation Division Facilities and Outdoor Areas License and Fee Policy, most recently approved by the Board December 8,2015 (Agenda item 16D7)as Resolution 2015-240. In an effort to encourage utilization of County fitness center facilities in partnership with local not for profit groups, staff is requesting the repeal of the existing Fee Policy to establish an updated fee schedule to include non-profit organizations and their members within the fitness membership corporate discount. Attachment A is a redlined version of the current Resolution, and Attachment B is the proposed Resolution with the recommended changes. FISCAL IMPACT: All of the Parks and Recreation fees remain the same. The total fiscal impact of extending the corporate discount to non-profit organizations and their members will vary based on the number of fitness memberships sold,but is not expected to be substantial. GROWTH MANAGEMENT IMPACT: No Growth Management Impact is associated with this action. ADVISORY BOARD RECOMMENDATION: The Parks and Recreation Advisory Board approved this item with a 5-0 vote on October 19,2016. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY THAT: a) I. PURPOSE rts The purpose of these policies is to ensure appropriate and maximum use of facilities, outdoor areas and programs in Collier County, to include Conservation Collier Preserve Lands, a. and provide equitable fees and charges collected from users of such facilities, outdoor areas, programs, and Preserve Lands. o• II. LIMITATIONS110 The Parks and Recreation Director, or his designee, may waive enforcement or application of anyof these regulations or restrictions with respect to anyfacility, ° pp gu outdoor areas, •�, or program, or with respect to any Preserve Lands, provided such waiver does not harm the natural resources or interfere with public safety or enjoyment. No fees may be waived. The Board of County Commissioners shall set fees and charges for all facilities and programs. Fees for County-sponsored special events shall be set by the Board prior to the event. Those fees not identified in the fee policy are approved by the Board of County Commissioners through the budgeting process (the division will identify those fees each year as they are created and applied 0 to the budget). a a) Consistent with Collier County's policy of ensuring all citizens equal opportunity to participate in programs, any resident requesting special consideration must substantiate to the Parks and Recreation Director proof of financial need for child care programs. All information provided is not confidential but will be used only for the purpose of establishing reduced or waived program fees. Rates and charges can be modified on a case-by-case basis if approved by the Parks and Recreation Director for special promotional sales, and advertisements, contractors working on park property, volunteer organizations participating in Keep Collier Beautiful, Bay Days, and related clean-up events, visiting investigators conducting research on park property, a. and schools, colleges and universities participating in field based education programs that provide a valid public purpose or stimulate increased utilization of programs. Facility License Definitions and Uses EL. 1. Outdoor Areas: Open space or land owned or leased by the Parks and Recreation Division. Such outdoor areas shall include, but not limited to, sports fields, playgrounds, swimming pools and/or other park and recreation areas, excluding Golden Gate Community Center. (As to E Golden Gate Community Center, refer to Section Q, herein). Outdoor areas shall be used for those purposes designated or implicit in their character. Any deviation from normal appropriate use shall require express prior permission from the Parks and Recreation Director or designee. o a) a> 2. Vehicle Parking Fees: Parking lots at Collier County beach parks and accesses, to include, but not limited to, the following: Tigertail Beach, Barefoot Beach Access, Barefoot Beach Preserve, Clam Pass Park, o Conner Park, Vanderbilt Beach, North Gulf Shore Access, and Southco Marco Beach Access. 5. Boat Launch Fees: Ramp use at Collier County owned and operated boat launch facilities to include, but not limited to, Port of the Isles Marina, Goodland Boating Park, Bayview Park, Cocohatchee River Park, Caxambas Park, and Collier Boulevard Boating Park. a. c B. While receptacles are provided, all rubbish or waste generated by the event shall be carried away from o Collier County Preserve Lands by the person responsible for its presence, and properly disposed of elsewhere. C. If sanitary service is not available at Preserve Lands, the user will be responsible for hiring a licensed sewage disposal business. Q D.
