Detail/Specific/Rationale for request:The scope of the original task was to identify right-of-way along Thomasson Drive and design streetscape Improvements from Bay Street to Orchard Way.The engineering firm identified an issue with right-of-way(ROW) along the northeast corner of Thomasson Drive and Bayshore Drive that encroached onto private property known as Cirrus Pointe. The project was put on hold until the issue of right-of-way was resolved. After extensive research,it was determined,although, the County right-of-way maps Identified 100 feet of right-of-way along this corridor,there was never a conveyance document from the property owner for 40 feet of the right-of-way that was a part of the initial'design, 2, Why change not in original contract:The right-of way Issue was not contemplated in the original contract and ultimately required reconsideration of the proposed design.As a result, other studies were commissioned, Including a roundabout feasibility study. The studies showed that Incorporating roundabouts into the design would address traffic and the limited right-of-way Issues,The Advisory Committee approved incorporating roundabouts into the design and for the engineer to move forward with the redesigning the proposed improvements into the limited 60 feet of right-of-way, The right of way issue was not contemplated in the original contract and has resulted.When staff and engineer reviewed the County ROW maps,it was identified on the maps, The time extension will provide for completion of the design services and adequate time for post design services during construction phase to final completion of the project, 3. impact if not processed:This streetscape redesign was Intended to promote safer traffic patterns,for both vehicle and pedestrian traffic. If the change order is not granted this project will not move forward,streetscape Improvements will not be able to be installed and money collected through the MSTU will not be able to be expended in a timely manner.
