EXECUTIVE SUMMARY
Recommendation to approve the Collier County Domestic Animal Services Veterinarian Licensing
Agreement which allows veterinarians and authorized agents to sell Collier County licenses,collect
fees,and relevant surcharge established by Resolution No.2016-125.
OBJECTIVE: To formalize the protocols for the sale of Collier County pet licenses by local veterinary
clinics and authorized agents.
CONSIDERATIONS: To ensure accountability and accuracy between participating veterinarians and
Collier County Domestic Animal Services, a Veterinarian Licensing Agreement was created to
establish roles and responsibilities for selling County license tags.
Collier County Animal Control Ordinance requires any owner of a dog or a cat to obtain a County
license for each animal when the animal is four months old or older. Licenses are issued for a period
of one year and must be renewed annually.
Collier County Animal Control Ordinance No. 2013-33, as amended, authorizes veterinarians to sell
dog and cat licenses and to charge a surcharge established and revised by resolutions adopted by the
Board of County Commissioners.
Collier County Domestic Animal Services recently revised their fee policy, Resolution No. 2016-125,
and established a veterinarian/agent surcharge for selling licenses not to exceed $3.00 per license.
Currently, participating veterinarians retain $1.00 from the purchase price of every license sold as part
of the surcharge. The Veterinary Licensing Agreement requires participating veterinary practices to
remit the full license cost to Domestic Animal Services.
Collier County citizens have the option of purchasing animal licenses through Domestic Animal
Services without paying a surcharge.
FISCAL IMPACT: Remittance of the full license cost to Domestic Animal Services by participating
veterinarians will result in an annual increase of$18,000 in Animal Licensing revenues.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION:That the Board of County Commissioners approves the Veterinarian Licensing
Agreement and authorizes the Domestic Animal Services Director to sign the Veterinarian Licensing
Agreement on behalf of Collier County.

COMMISSIONERS SUPERSEDING RESOLUTION NO. 2014-29 AMENDING
THE DOMESTIC ANIMAL SERVICES FEE POLICY TO PROVIDE
APPROPRIATE FEES FOR ALL SERVICES PROVIDED BY COLLIER
COUNTY DOMESTIC ANIMAL SERVICES AND TO ALLOW FOR WAIVERS
AND REDUCTIONS IN FEES WHERE NEEDED.
WHEREAS, on February 11, 2014, the Board adopted Resolution No. 2014-29 which
established a revised Fee Policy in accordance with newly adopted Animal Control Ordinance to ensure a

EXHIBIT A
COLLIER COUNTY DOMESTIC ANIMAL SERVICES
FEE POLICY
I. PURPOSE
The purpose of this policy is to establish user fees which will partially offset the cost of
providing domestic animal services to the taxpayers of Collier County.

II. LIMITATIONS
A. Waiving of Fees. The Board of County Commissioner shall set all fees and charges. a'
Fees may be waived in accordance with policies articulated herein, such as under certain conditions
upon reclaim, when fees are for animals in safekeeping. Fees for field surrenders and board for
quarantine may be waived at the discretion of the Director when to do so will prevent the suffering of an
animal or ensure public safety and no reasonable alternative to waiving the fee exists. Such waivers
shall be brought before the Board in quarterly reports for after-the-fact ratification.
B. Non-Fee-Related Policies. The Director of Animal Services, or designee, may waive >
enforcement or application of any department policies or restrictions provided such waiver does not M
conflict with applicable local, state, or federal laws and does not interfere with public safety.
C. Promotional Sales and Advertisements. Fees may be reduced for special promotional
sales and advertisements if approved by the Director of Animal Services and such a reduction is applied
in a consistent and time-limited manner. N

D. Sponsored Fees. The department may accept cash donations to sponsor fees for
customers in need. Fee sponsorship donations will be accounted for as the sale of gift certificates to be
redeemed at the time of the fee-incurring transaction. Redemption of sponsored fee gift certificates will N
be at the director's discretion in accordance with the following general guidelines: A customer cannot cc
benefit from sponsored fees more than once in a twelve-month period.

E. Reclaim Fees. Fees may be reduced or waived at the discretion of the Director of
Animal Services if such fees would facilitate a live release and allow for the animal to be returned to a
responsible home. Reducing and/or waiving of fees should only be utilized once all fee-sponsored
donations are exhausted. Collier County license and microchip are not subject to reduction or waiver of
fees.
F. Safekeeping. If an animal is impounded at the request of a first-responding agency due to
the death, medical emergency, or disaster-related circumstance of its owner or caretaker, and that animal
is claimed by the owner, next of kin, or otherwise authorized party at the first available opportunity,
impound, and board fees may be waived. This exception does not apply to animals of owners or
caretakers who have been arrested or incarcerated. Safekeeping animals are subject to all other

requirements of impounded animals at Domestic Animal Services as per Collier County Animal Control
Ordinance.
G. Refunds. The following fees are nonrefundable: Impoundment Fees, Owner Surrender
Fees (except as provided herein), License Fees (except as provided for herein), and Permitting Fees
(except situations where the applicant is not approved for zoning as required by Collier County Animal
Control Ordinance). The following fees are refundable only if service is not rendered: Mandatory
Spay/Neuter Fees, Micro-chipping Fees, and Euthanasia and Cremation Service Fees may be refunded at
the discretion of the Director of Animal Services, or designee, upon written request received within 30
days of payment or receipt of service, whichever comes first.

Adoption fees are nonrefundable. Adopted animals may be returned before the 30th day of placement
without incurring an owner surrender fee. On the 31st day and all those thereafter, an owner surrender
fee will be incurred for adoption returns. Days are counted as calendar days, irrespective of Domestic
Animal Services open-to-the public hours. If an animal is returned within 30 days of placement, the '
adopter may adopt a like type animal at no cost within 60 days of the original adoption. Adoption fees
may be refunded within ten (10) days from adoption if the adopter can demonstrate non-routine
veterinary medical expenses in excess of the amount of the adoption fee. Adoptions are considered "as

is," and no expenses beyond the adoption fee will be reimbursed. Adoption fees will not be reimbursed .L-
if the adopter failed to sign up for free pet insurance offered by Domestic Animal Services.

Veterinarian Licensing Agreement
This Veterinarian Licensing Agreement hereinafter referred to as the "Agreement" is
dated .20 ,by and between . whose
mailing address is . ("Veterinarian"), and Collier
County, Florida, whose mailing address is 7610 Davis Boulevard, Naples, Florida 34104,
("County"):

WHEREAS, Section Eight of Ordinance No. 2013-33 authorizes veterinarians to issue
dog and cat licenses as issued by the Director of Domestic Animal Services ("DAS") subject to
the fees and relevant surcharges established by Resolution by the Board of County
Commissioners of Collier County("Board"); and J
WHEREAS, such provisions of the Ordinance require that forms and licenses be c
furnished by the County to the veterinarian choosing to issue such licenses; and .-
WHEREAS, Resolution No. 2016-125, as may be amended from time to time, ("DAS co
Fee Policy") sets forth the relevant fees and surcharges to be collected by the veterinarian in o
performing such service on behalf of the County; and

WHEREAS, Veterinarian wishes to provide the service of issuing licenses to its
customers as authorized by Section Eight of Ordinance No. 2013-33, as may be amended from
time to time, subject to the terms and conditions as set forth herein.
NOW, THEREFORE, in consideration of the mutual promises and benefits set forth
herein,the parties hereby mutually agree that:
ca1. Veterinarian agrees to issue pet licenses to its customers on behalf of the County,
as authorized by Section Eight of Ordinance No. 2013-33, as may be amended from time to time
in accordance with the requirements set forth herein. The Veterinarian shall ensure that all forms ='
are correctly and completely filled out by either the Veterinarian or the animal owner. Each
license form shall clearly identify and describe the animal receiving the license and provide the
correlating number on the license to the license form. Veterinarian must also provide the breed,
color, age, sex,and sterilization status of the animal. co

2. Veterinarian shall collect from the animal owner the correct Board-authorized fee
as set forth in the DAS Fee Policy, as may be amended from time to time. Veterinarian shall not
waive any fees and shall correctly identify whether or not the animal has been spayed or neutered
before issuing a license. The Veterinarian shall remit to the County on a monthly basis the full
and correct license fee along with the Monthly License Tag Sales Form and all license form

3. Veterinarian is authorized to collect the Board-authorized surcharge, in addition
to the cost of the pet license, to be retained by the Veterinarian as compensation for providing
such services. The Veterinarian may choose to charge the full surcharge, less than the Board-

approved surcharge or waive the surcharge completely, but shall not charge more than the
Board-approved surcharge.
4. Upon request by the Veterinarian, the County will issue a set of one-hundred
(100) license tags and forms to the Veterinarian for distribution to its customers. A Veterinarian
may request as many sets of licenses each month as needed, but shall first have submitted a c
Monthly License Tag Sales Form for the previously issued licenses and shall have remitted all E
required fees to DAS before the County issues the next set of licenses. a

5. Veterinarian shall maintain control and shall be responsible for all pet licenses in im
the possession of the Veterinarian until they are subsequently issued to the individual pet owners.
If a license is lost by the Veterinarian, the Veterinarian shall note on the Monthly License Tag °;

6. This Agreement is at-will with no termination date. However, failure by the c
Veterinarian to comply with the terms of this Agreement will be grounds for termination of this Y
Agreement. Either party may terminate this Agreement at any time for convenience, so long as a)
