It is the opinion of the Affiant that, as of April 24, 2000, the record owner of the real and personal property described herein is BAY WINDS LODGING, L.L.C., a Florida limited liability Company, (hereinafter ,'Owner"). The Owner acquired record title to the subject real property by instrument recorded in Official Records Book 2620, Page 2936, of the Public Records of Collier County, Florida, attached hereto as Exhibit "B". 4. The Affiant has examined the Regulations of the limited liability company known as: BAY WINDS LODGING, L.L.C., and found it to be validly created and is currently in existence and active within the State of Florida. Ronald D. White, as Managing Member, is authorized to execute instruments on behalf of the BAY WINDS LODGING, L.L.C., in conjunction with the conveyance of the water and sewer utility facilities to the Development Services Department for approval by the Board of County Commissioners of Collier County, Florida. 5. The subject real property is encumbered of record by the following: a) Mortgage executed by Ronald D.
