Agenda 10/11/2016 Item #10C 10_C 10/11/2016 EXECUTIVE SUMMARY Recommendation to direct staff to (1) evaluate whether the Code of Laws and Ordinances Sec. 130- 79 should allow public parks and beach access parking to support a broader range of land uses; (2) to evaluate the need for an amendment to Land Development Code Section 4.05.04 F.2 to support shared parking for complementary businesses, particularly near the beach; and (3) to provide a stay on any code enforcement action for Administrative Parking Reductions applications until the aforementioned issues are examined by staff and presented to the Board. OBJECTIVE: To provide staff direction to analyze the Code of Laws and Ordinances Sec. 130-79 - Public parks and beach access parking provision to determine whether the section should allow public parks and beach access parking to support a broader range of land uses. In addition, request staff to examine the Land Development Code (LDC) Section 4.05.04 F.2 to determine whether an amendment is needed to support shared parking for complementary businesses, particularly near the beach. Further, to issue a stay on any code enforcement action for Administrative Parking Reductions applications until the aforementioned issues are examined by staff and presented to the Board. CONSIDERATIONS: Currently, the Code of Laws and Ordinances Sec. 130-79 - Public parks and beach access parking establish that public parks and beach access parking is "solely" dedicated for the said uses. This constraint should be evaluated to determine if concepts, such as "park once and walk" model; can be used to support a larger number of land uses, including retail businesses and civic functions. If applied, this concept would allow for public parking lots to support pedestrian friendly environments with a broad range of uses,rather than"solely"for public parks and beaches. LDC section 4.05.04 F.2 establishes an administrative parking exemption for a "use which is not specifically referenced [in the LDC]" and demonstrates a unique nature. This section should be evaluated to determine whether additional standards and/or flexibility is needed to allow for administrative parking exemptions for complementary and tourism related businesses seeking to share parking, particularly near the beach. Further, to place a stay on any code enforcement action on any Administrative Parking Reduction applications while staff conducts an analysis of the aforementioned code provisions and any proposed changes are presented to the Board. FISCAL IMPACT: There are no fiscal impacts associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality,and requires majority vote for approval. -JAK RECOMMENDATION: To direct staff to evaluate the Code of Laws and Ordinances Sec. 130-79 and LDC section 4.05.02 F.2 and examine the need for additional parking flexibility. 'a (Ord. No. 2010-29, § 1) Sec. 130-77. -Purpose and intent. The purpose of this division is to provide, maintain and ensure the availability of parking for those members of the public who seek access to Collier County public parks and beaches. E (Ord.No. 2010-29, § 2) Q Sec. 130-78.-Applicability. N This division shall apply to, and be enforced in, all unincorporated areas of Collier County, Florida. 0 U (Ord. No. 2010-29, § 3) Sec. 130-79.-Public parks and beach access parking. /"."� a Public Parks and Beach Access Parking is to be utilized solely for the purpose of accessing public parks and beaches. It shall be a violation of this division for anyone to park in an area designated as "Public Park Parking"or "Public Beach Access Parking" who is not utilizing a public park or beach during CP the hours from dawn to dusk. ci 01 (Ord.No. 2010-29, § 4) Sec. 130-80.-Designation of public parks and beach access parking by resolution. a. (a) The County Manager, or his designee, shall investigate and make recommendations to the Board of County Commissioners concerning which areas to designate as Public Park Parking or Public Beach Access Parking. Recommendations shall be in accordance with the terms of this division in an effort a to protect the public's ability to access the public parks and beaches of Collier County as well as to aid in the implementation of the conditions set forth in this division. (b) Upon the advice of the County Manager or his designee, the Board of County Commissioners may, by Resolution, designate certain areas owned or leased by the County as Public Park Parking or m w Public Beach Access Parking. (c) Upon the Board of County Commissioners enacting a Resolution designating certain areas owned or leased by the County as Public Park Parking or Public Beach Access Parking, such parking facilities, a parking lots or portions thereof so designated shall be posted specifying the restrictions or Sa, prohibitions, as enacted by the Board of County Commissioners. Q (d) The presence of a beach parking permit upon a vehicle shall not be considered as evidence of intent to go to the beach. Requirements for off-street parking for uses not specifically mentioned in this section shall be the same as for the use most similar to the one sought, or as otherwise determined by the County Manager or designee pursuant to 4.05.04 of this LDC it being the intent of this LDC to require all uses to provide off-street parking, unless specific provision is made to the contrary. B. Measurement. Where this LDC requires off-street parking based on various types of measurements, Tri the following rules shall apply: c 1. Floor area means, for the purposes of this section only, the gross floor area inside the exterior v walls, unless otherwise specifically indicated. 2. In hospitals, bassinets do not count as beds. 3. In stadiums, sports arenas, houses of worship, and other places of public assembly where occupants utilize benches, pews, or other similar seating arrangements, each twenty-four (24) a lineal inches of such seating facilities count as one(1)seat. 4. Where the parking requirements are based on number of employees or persons employed or working in an establishment and the number of employees increases after the building or structure is occupied, then the amount of off-street parking provided must be increased in ratio to the increase of the number of employees. When units of measurements determining number of required off-street parking spaces result in a requirement of a fractional space, then such fraction equal or greater than one-half(1/2) shall to require a full off-street parking space. Developers of commercial projects located within commercial zoning districts, business park districts, or a commercial component of a PUD zoning district, which require a minimum of eighty(80) parking a. spaces, providing paved off-street surface parking in excess of 120 percent of the requirements of co�� this LDC shall request a variance in accordance with Chapter 9. The developer shall be required to provide double the landscaping required in interior vehicular use areas, as required by section 4.06.00 for those projects requesting such a variance. E D. Should the garage be side-loaded there must be at least a 23-foot paved area on a perpendicular line to the garage door or plans must ensure that parked vehicles will not interfere with pedestrian traffic by providing equivalent space. a E. Required off-street parking according to the requirements of this Code shall not be reduced in area 4 or changed to any other use unless the permitted or permissible use that it serves is discontinued or C modified, or equivalent required off-street parking is provided meeting the requirements of this Code. v F. Irrespective of any other requirement of this LDC, each and every separate individual store, E office, or other business shall be provided with at least one (1) off-street parking space, unless specific provision is made to the contrary. z 2. The County Manager or designee may determine the minimum parking requirements for a use which is not specifically referenced below or for which an applicant has provided evidence that a specific use is of such a unique nature that the applicable minimum parking ratio listed in this LDC should not be applied. In making such a determination the County Manager or designee may require submission of parking generation studies; evidence of parking ratios applied by other counties and municipalities for the specific use; reserved parking pursuant to section Page 1 Packet Pg.254, 10:Qb u, 4.05.05; and other conditions and safeguards deemed to be appropriate to protect the public health, safety and welfare.
