Agenda 09/13/2016 R Item #16A52 1 6.A.52 09/13/2016 EXECUTIVE SUMMARY Recommendation to direct staff to pursue a Land Development Code Amendment to examine a setback requirement for dumpsters and recycling receptacles for commercial,industrial and multi- family projects from residential uses to address compatibility concerns. OBJECTIVE: To examine the locational requirements for dumpsters and recycling receptacles in Land Development Code (LDC) section 5.03.04 and propose changes to ensure compatibility with adjacent residential uses. CONSIDERATIONS: LDC section 5.03.04 Dumpsters and Recycling provides locational requirements for commercial, industrial, and multi-family projects that do not receive curbside pickup. The section permits dumpsters or recycling receptacles to be located within a required setback, as long as they do not encroach upon a landscape buffer. Therefore, the section allows for a dumpster or recycling receptacle to be located in close proximity to adjacent uses,including residential uses. It has been brought to Staff's attention that pursuing an LDC Amendment to introduce a setback requirement for dumpsters and recycling receptacles would address compatibility concerns with adjacent residential uses. It is proposed that this concern is addressed through a future LDC Amendment cycle. FISCAL IMPACT: There are no fiscal impacts associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item is approved as to form and legality. A majority vote is needed for Board approval. -HFAC RECOMMENDATION: To direct staff to examine a setback requirement for dumpsters and recycling receptacles for commercial, industrial and multi-family projects not receiving curbside pick-up from adjacent residential uses in order to address compatibility concerns through a future Land Development Code Amendment cycle.
