EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to execute the Sovereignty Submerged
Lands Easements for the Gulf of Mexico/Doctors Pass Easement No.41899 and 41794.
OBJECTIVE: To move forward with the execution of two(2) Sovereignty Submerged Lands Easements
for Doctors Pass erosion control structures and south jetty rebuild project.
CONSIDERATIONS: This item presents two nonexclusive easements granting Collier County use of
sovereignty lands. One easement allows the County to repair the south jetty at Doctors Pass. The other
easement allows the County to install the new erosion control structure at the beach just south of Doctors
Pass.
More specifically, Submerged Lands Easement No. 41899 will be used solely for construction of a
detached nearshore breakwater, construction of a rock groin, and rehabilitation of an existing groin to
function as beach erosion control structures required to maintain sand on the Naples beach immediately
south of Doctors Pass.
Sovereignty Submerged Lands Easement No. 41794 will be solely for rehabilitation of a jetty and
construction of a rock spur groin to repair the south jetty of Doctors Pass. Rehabilitation of the jetty is at
the following location: Doctors Pass, south jetty lying in section 28, township 49 south, range 25 east,
City of Naples, Collier County. The use of the premises is for a 50 year period from May 17, 2016, the
effective date of this easement. This easement is to modify an existing easement to increase the square
footage and extend the term.
Under Easement No. 41899, Collier County shall not engage in any activity related to this use except as
described in the State of Florida Department of Environmental Protection Consolidated Joint Coastal
Permit No. 0338231-001-JC, dated November May 27, 2016.
Under Easement No 41794, Collier County shall not engage in any activity related to this use except as
described in the State of Florida Department of Environmental Protection Consolidated Joint Coastal
Permit No. 0334007-001-JC, dated November 16, 2015, and State of Florida Department of
Environmental Protection(DEP),Consolidated Joint Permit No. 0338231-001-JC,dated May 27,2016.
FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. -JAB
RECOMMENDATION: To execute the Sovereignty Submerged Lands Easements for the Gulf of
Mexico/Doctors Pass Easements No.41899 and 41794.
