Agenda 09/27/2016 Item #16F2 16.F.2 09/27/2016 EXECUTIVE SUMMARY Recommendation to approve a transfer of transportation impact fee credits in the amount of $116,044.30, held by Berkshire Equity, LLC, for the Berkshire Common Parcels 3A and 3B development to the Thomasson Place development. OBJECTIVE: To approve a transfer of transportation impact fee credits in the amount of$116,044.30. CONSIDERATIONS: Transportation impact fee credits in the amount of $116,004.30 are remaining from an overpayment of impact fees for Berkshire Commons Parcels 3A and 3B located in Road District 2. Section 74-205 (n) of the Collier County Code of Laws and Ordinances states the following: " Impact fee credits shall not be assigned or otherwise transferred from one development to another development except by written agreement executed by the county, and then, shall only be transferable from one development to another development within the same or adjacent impact fee district for the same type of public facility impact fee. This assignment or transfer may be to commercial and/or residential developments. .....". The Berkshire Commons Parcels 3A and 3B development is complete and Berkshire Equity, LLC, the owner of the credits, has requested approval to transfer the credits to the Thomasson Place development also located in Road District 2. FISCAL IMPACT: The transportation impact fee credits are being transferred to a development within the same road district (Fund 333). There is no fiscal impact associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County attorney, is approved as to form and legality, and requires majority vote for approval. No agreement is necessary as the impact fee credit is being utilized by the owner of the impact fee credit(as opposed to being transferred to a different developer, which would require an agreement). -JAK RECOMMENDATION: To approve a transfer of transportation impact fees in the amount of $116,004.30, from the Berkshire Commons Parcels 3A and 3B development to the Thomasson Place development, both located in Road Impact Fee District 2.
