Agenda 09/27/2016 Item #16E 7 16.E.7 09/27/2016 EXECUTIVE SUMMARY Recommendation to approve Change Order #001 for Life Safety Upgrades in the amount of $197,476.06 to DEC Contracting Group, Inc. for Contract 15-6488, Courthouse 1st Floor Renovations, an element of Courthouse Renovations Project#50116. OBJECTIVE: To correct pre-existing, non-compliant life safety conditions revealed during construction. CONSIDERATIONS: The Board approved the award of Contract 15-6488, for $1,747,815.00, to DEC Contracting Group (DEC), during the October 13, 2015 Board meeting (Agenda Item 11E) to renovate the 1st floor of the courthouse. Phase-I assembles offices in the unoccupied 3,891 square foot open area vacated by the Clerk of Courts after the Annex was constructed in 2009. Phase-II builds a new courtroom in the 2,448 square foot area currently occupied by the Probation Office. The Phase I offices will consolidate the Probation officers and staff currently scattered throughout the courthouse. Construction of Phase I was 90% complete when close examination of the exposed deck during inspections revealed that five(5) shafts carrying HVAC ductwork from the first floor up to the third were not protected as required by Fire Safety Code. This is a condition which has apparently existed since the building was first occupied in the early 1990's. Primary construction was suspended on April 18, 2016, while a Life Safety Code Specialist was consulted. After the consultant's confirmation of the non- compliant conditions, a corrective rehabilitation was designed and the active permit revised. The shafts open under the 2nd floor deck. Typically an acoustical ceiling is 9' above the floor; these openings at the deck are an additional 22' above the 1st floor ceiling. They are as large as 8'x4', and as small as 4'x2'. They are blocked by pipes, wires, and other horizontal ducts. By code, they must be sealed off, with appropriate maintenance access, to retard flames or smoke from traveling between floors through them in the event of a fire. The HVAC ductwork running in the shafts must be fitted with dampers that will close during a fire to prevent the transmission of smoke or flame throughout the ducts. To accomplish the rehab work, the AC system must be disabled periodically. Work will therefore be performed while the Courts are out of session, after hours,and/or on weekends. This Change Order will authorize the Life Safety rehab to proceed. Concurrently the work suspension will be lifted so primary construction can resume, and the County can discontinue monthly payments to store the furniture and equipment that was ready to be installed when the progress was stopped. However, similar shafts exist in the Phase II space. Once that space is vacated, those shafts will be exposed and their condition's evaluated. If they are also found to be out of compliance with code, an additional Change Order will be requested to make the appropriate corrections. FISCAL IMPACT: Project 50116, Fund 181, was approved during the FY 2015 budget, for a total cost of$2,277,000. In addition to the cost of the 1st floor renovations, the project includes an estimated cost of$350,000 for rewiring of the entire courthouse's communications infrastructure, and an estimated cost of $150,000 for the repair / replacement of the elevator lobby's terrazzo flooring. This Change Order will temporarily use the funds meant for the flooring, and/or wiring, until their replenishment can be approved. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. Introduction The existing courthouse facilities located at 3301 Tamiami Trail, East is currently undergoing renovation of interior building spaces. Several wall partition locations immediately adjacent to the work areas were observed during inspections for its construction and passive protection being provided. These wall partitions separate exit access type circulation spaces from room i enclosures. As such, these circulation spaces are considered corridors serving the existing -a building areas and the spaces being renovated. The purpose of this analysis is to evaluate the o existing conditions within the building with respect to these corridor spaces and determine the a, effect of the proposed building modifications for conformance with applicable building and fire o prevention code provisions related to existing buildings. o 2. Applicable Code d W The building and fire prevention codes applicable for this project are the following: a m a. Florida Building Code, Building, 2010 edition (Referred to as FBC) w J b. Florida Building Code, Existing Building, 2010 edition (Referred to as FBCE) Q c. Florida Fire Prevention Code, fifth edition (Referred to as FFPC) o 3. Occupancy Classification y The existing building use based on the architectural layout of the spaces currently indicated in as- ; built drawing documents is considered to be primarily a business type occupancy with spaces } that are administrative type offices serving the judicial function of the courtroom and hearing room E assembly spaces. The proposed use of the first floor level building areas undergoing renovations 0 converts the work area at the north portion of the floor level currently functioning as an office space to a courtroom. The work area at south portion of the floor level is an office type space and o proposed to remain as such after reconfiguration of the area. The existing building in the as-built drawing documents is arranged as a Group B type occupancy consistent with the definition by section 304.1 of the FBC having office use for service type transactions and storage of records typical of civic administrative spaces. A Group A-3 type occupancy use consistent with the definition by section 303.1 of the FBC is also included as part of the building for the courtroom, hearing room and other large assembly areas. 0 4. Classification of Work A review of the FBCE was completed to determine the level of alteration applicable for the construction work being proposed. Classification of work was considered to be Level 2 as per section 404 the FBCE due to the reconfiguration of existing building systems such as lighting, a sprinkler, and mechanical HVAC systems to accommodate the erection of a new wall assemblies. The total work area is also less than 50% of the aggregate area of the building and expected to be completed within a 12-month time period. co n 5. Applicable Work Area Provisions The work areas for the renovation are defined by Chapter 2 of the FBCE as portions of the building consisting of all reconfigured elements, systems or spaces indicated on the construction o documents. Similarly, the FFPC also recognizes this type of work as part of section 101, Chapter u. 43, Building Rehabilitation. The scope of the renovation is defined by section 101-43.2.2.1.3 of 11) this chapter as a modification work category and part of the rehabilitation work area defined by y FFPC section 101-43.2.2.4. These work area descriptions are used to further determine the e applicability of provisions for each of the codes that require compliance. It should also be noted that a reconstruction type of work classification as defined by section 101-43.2.2.1.4 of the FFPC o is not considered for the reconfiguration of the spaces due to the corridors being outside the scope c.) of the renovation. There is no work planned that would reconfigure the existing corridors spaces immediately adjacent to the work areas. a. Fire Prevention Code a as General requirements for building modifications is specified in section 101-43.5 of the FFPC. This section mandates that the newly constructed elements and components portion of the work area co be in accordance with code provisions applicable to new construction. As such, applicable provisions for the corridor spaces are indicated in section 101-38.3.6 for existing business occupancies and section 101-13.3.6 for existing assembly occupancies. The applicability of assembly occupancies is based on the change of occupancy classification for the north work area from office space to a courtroom as per FFPC section 101-43.7.2.2. This change of occupancy is within the same hazard classification category (No. 3) specified in FFPC Table 101-43.7.3. cn The previously referenced FFPC sections for the corridor spaces indicate that fire barrier r construction for corridors is not required in assembly occupancies and in business occupancies if the building is protected throughout with an approved automatic sprinkler system. This building is provided accordingly with this type and coverage of sprinkler protection. b. Florida Building Code Provisions for Level 2 alterations are indicated in Chapter 7 of the FBCE. This chapter specifies requirements for corridors under section 705, Means of Egress. The scope of these provisions as per section 705.1 is limited to the corridors within the work areas only. The combined work area however for this floor level is approximately 34% of the first floor area of the building. As such, there are no applicable provisions by this code for the existing corridors outside the scope of the work areas being renovated. 6. Conclusions a) 72 The code requirements of wall partitions that separate the work areas being renovated from the o` existing corridor spaces serving as exit access for these work areas were evaluated. Provisions a� applicable to these existing building elements indicate that fire barrier construction of the corridors ea is not required if the building is protected throughout with automatic sprinklers. There is also no o work planned to reconfigure the existing corridor spaces which would mandate compliance with o corridor separation requirements for new construction. a cc Change in occupancy classification was also evaluated and recognized by applicable code 15 provisions to be within the same hazard classification. This allows for the provisions of existing N construction to be applied as per the code which stipulates no requirements for corridors to be a) provided.
