EXECUTIVE SUMMARY
Recommendation to approve and authorize the Chairman to sign an Addendum to Agreement 13-
6016 with Brenda C. Garretson for special magistrate services to include facilitation for vendor
payment dispute resolution.
OBJECTIVE: For the Board of County Commissioners (BCC) to have a formal procedure to resolve
payment disputes in order to meet the requirements in F.S. Chapter 218, Part VII, “Florida Prompt
Payment Act.”
CONSIDERATIONS: At the regular BCC meeting held June 14, 2016, Agenda Item 17F included an
amendment to the Collier County Procurement Ordinance to establish a Prompt Payment Procedure
which includes a vendor dispute resolution process. Various county divisions will utilize the services
provided under agreement 13-6016 on an as-needed basis if/when vendor disputes arise.
Approval of the following documents by the County Manager is subject to formal ratification by the
Board of County Commissioners. If the decision by the County Manager is not ratified by that Board, the
document(s) shall be enforceable against Collier County only to the extent authorized by law in the
absence of such ratification by that Board.
FISCAL IMPACT: Services will be provided upon request from the County, as needed. Fees for
services will be in accordance with the rates in the contract and funded by the divisions to which disputes
are related.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: That the Board of County Commissioners approves and authorizes an
addendum to Agreement 13-6016 with the special magistrate to include services related to vendor
payment dispute resolution in accordance with Ordinance 2013-69, as amended.
