The Clerks Office & Dwight Brock are out of control with holding peoples money that they rightfully owe and have no leg to stand on for withholding payment. I am now up to approx. $190,000.00 that is owed to me and is accumulating interest each month under the FL Prompt Payment Act. It occurs to me that Dwight Brock is not aware/ or cannot fully understand/ read the contract that we have and was signed on August 11, 2014, by his office. No where in the contract does it state that Lump Sum is not acceptable, nor does it say that lump sum invoices need to be broken down into Time and Material. These are 2 different pricing methods. A price was given, accepted and processed, work performed and billed according to the accepted price. I may suggest the Clerks Office have someone P ' interpret/read this contract so they can understand it better. We have already had a sit down with Dwight, which he chose to have a retired judge sit in as a mediator. Dwight Brock was informed he had no leg to stand on and that Kyle Construction would win a judgement, but Dwight Brock still refuses to accept the facts. So this is the way we are going to proceed with this situation caused by the Clerks Office: 1. I will be getting on the next Board Of Collier Commissioners agenda to speak to them about the outstanding $190,000.00 that is owed to me, and the interest that is owed on the past due invoices. 2. NBC 2, FOX, and Naples Daily New will be contacted the day of the commissioners meeting, and I will be sure to get full coverage on how the Clerk of Courts is still refusing to pay its contractors. 3. I will be contacting Governor Rick Scott to let him know how things are being handled by the Clerk of Courts down in Collier County. I will be sure to send a letter, email, and follow up with a phone call. 4. I will also follow up with another interest bill for the outstanding funds tomorrow. These interest charges are valid and are to be paid per the FL Prompt Payment Act. 5.After the commissioners meeting, I will give the Clerk 10 business days to pay the outstanding funds, with interest. If this payment does not occur, I will take legal action and the court proceeding will be filed. Dwight Brock and the Clerks Office are copied on this email. I have no choice but to proceed this way. While we appreciate your frustration at not being paid,please consider the following facts: Our office held a dispute resolution meeting with you on June 7,2016. During that meeting we explained the documentation required by our office to pay your outstanding invoices. Without the supporting documentation to tie to your contract we are unable to determine that your request for payment is legal. During discussions you indicated that you determined lump sum pricing based upon"waking up and deciding what you needed to make that day",and that you did not use the contract items costs to calculate the invoice charges.At that meeting,we discussed several ways that documentation could be provided. You refused to provide any additional documentation,and threatened the same actions articulated in your recent e-mail. We indicated to you at the dispute resolution meeting that we were unable to pay your invoice based upon the inability to tie to your contracted rates, and lack of supporting documentation for the items charged. At the meeting was an independent reviewer,retired Judge William Blackwell,he indicated that invoices did not comport to the contract. He further indicated that you would probably win in court. The Clerk's Office agreed,however the Clerk does not have the authority to pay outside of the Board's approved contract. As such,upon our inability to obtain proper documentation from you at the dispute resolution meeting,our office met with County Manager Leo Ochs,Assistant County Manager Nick Casalanguida,and County Attorney Jeff Klatzkow on June 136, 2016 and advised them of our inability to pay based upon the lack of documentation to support the charges according to the contracted amounts.
