IF ~ ~'~ ~1 THE NUMBER OF EX-OFFICIO MEMBERS FROM THREE O} ~¢~n. ~~~~~ TO ONE (1); PROVIDING FOR INCLUSION IN CODE OF na~ , AND ORDINANCES; PROVIDING FOR CONFLICT A~[D;, ~' SEVERABILITY; AND PROVIDING FOR AN EFFECTI~Ei: DATE. r'- WHEREAS, On April 23, 2002, the Board of County Commissioners appr~l~ ch~ges to the By-laws of the Emergency Medical Services Advisory Council and therefore the Collier County Code of Laws and Ordinances have to be amended to reflect this change. WHEREAS, the change involves increasing the number of regular members of the Emergency Medical Services Advisory Council from twelve (12) to fourteen (14); and WHEREAS, the second change in the Emergency Medical Services Advisory Council By-laws was in the reducing of the ex-officio members from three (3) to one (1) member. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: SECTION ONE: Section 50-28- MEMBERS: The EMSA council shall be composed of-l-3 14 regular members, 3 1 ex-officio members, and 2 staff advisors. The composition of the regular membership and the ex-officio members will be further delineated in the bylaws, as will the staff advisors. The EMSA council shall elect a chairman at its organizational meeting and annually thereafter. SECTION TWO: INCLUSION IN THE CODE OF LAWS AND ORDINANCE The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re-lettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION THREE: CONFLICT AND SEVERABILITY In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. - 1- SECTION FOUR: EFFECTIVE DATE This Ordinance shall become effective upon filing with the Department of State. BOARD OF COUNTY COMMISSIONERS COLLIER ~ This ordinance filed with the .~~of State's Office the of t~ , and acknowledgement of that filing received this of ~t.4,~. ~.a~ By ' Deputy C~erk RESOLUTION NO. 2002-1332 A RESOLUTION OF THE COLLIER COUNTY BOARD OF COUNTY COMMISSIONERS FOR APPROVAL OF THE AMENDMENTS TO SECTION 50-28 OF THE COLLIER COUNTY CODE OF LAWS AND ORDINANCES WHEREAS, On April 23, 2002 the Board of County Commissioners approved in concept, the proposed changes to the By-laws of the Emergency Medical Services Advisory Council and authorized the County Attorney to prepare this Resolution. WHEREAS, An amended Ordinance has been drafted and presented to the Board of County Commissioners increasing the Council members from twelve (12) to fourteen (14) and decreasing the ex-officio members from three (3) to one (1); and WHEREAS, the Emergency Medical Services Advisory Council requests the official approval of the revised By-laws, attached hereto as Exhibit "A" by the Collier County Board of County Commissioners. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: The Collier County Board of County Commissioners hereby approves the changes to the By-laws of the Emergency Medical Services Advisory Council by this Resolution and such By-law changes shall be effective as of the date of the approval of the amended Ordinance. -This Resolution adopted this JOE day of ~~.~ second and majority vote favoring same.
