EXECUTIVE SUMMARY
Recommendation to hear Land Development Code Amendments at two regularly scheduled
daytime hearings and waive the night hearing requirement.
OBJECTIVE: To present to the Board of County Commissioners (Board) Land Development
Code (LDC) Amendments that change the actual list of permitted, conditional, or prohibited uses
of land within several zoning categories during regularly scheduled daytime hearings on
Tuesday, June 14, 2016 and Tuesday, June 28, 2016. This option requires the Board to waive the
nighttime hearing by a supermajority vote.
CONSIDERATIONS: The current LDC amendment cycle includes proposed changes that
amend the zoning atlas or that change the actual list of permitted, conditional, or prohibited uses
of land within several zoning categories. These amendments require public notice pursuant to
LDC section 10.03.06 K. This LDC section states that two Board meetings are required, and at
least one hearing shall be held after 5:00 p.m. on a weekday, unless by supermajority vote the
Board elects to conduct the hearing at another time of day.
The LDC amendments propose the following:
1) Amending the floor area ratio for group housing and assisted living facilities,
2) Adding requirements for school compatibility review,
3) Amending the conditional and prohibited uses in the Immokalee Main Street Overlay
Subdistrict,
4) Amending the site plan process for mobile homes in the Immokalee Urban Overlay
District, and
5) Addressing scrivener's errors within the permitted use sections.
It should be noted the Collier County Planning Commission will hold two public hearings on
Thursday, May 19, 2016, at 9:00 a.m. and on Monday, May 23, 2016, at 5:05 p.m. The Planning
Commission will review and provide recommendations regarding these amendments to the
Board.
FISCAL IMPACT: There are no fiscal impacts associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item is approved as to form and legality. An affirmative
vote of four is needed for Board approval. (HFAC)
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this Executive Summary.
RECOMMENDATION: For the Board to hold two regularly scheduled daytime hearings to
consider LDC amendments. This option waives the night meeting requirement as provided for in
LDC section 10.03.06 K.
