EXECUTIVE SUMMARY
Recommendation to authorize a time certain of 5:00 PM for the RaceTrac Gas Station item when it
is scheduled for an upcoming BCC meeting in order to facilitate participation by the working
residents of the community concerned about the RaceTrac development proposal on US 41 between
Palm and Frederick Streets. (Commissioner Taylor)
OBJECTIVE: To provide an increased opportunity for working residents in the community to participate
in the political process by scheduling the RaceTrac development proposal hearing to a time certain of
5pm.
CONSIDERATIONS: Many residents have shown concern regarding the proposed RaceTrac
development site and have been engaged in following the process including a standing room only public
meeting on December 1, 2014. The neighbors and other community members have expressed their
concerns not only verbally,but through many emails over the course the last sixteen months.
There is a tentative BCC meeting date scheduled on May 24, 2016 pending a decision, by the BCC on
April 26, 2016 whether to request an initial hearing by either the Hearing Examiner or the Collier County
Planning Commission for a finding of fact and recommendation to the BCC regarding the distance
waiver. The request for the time certain pertains only to the one meeting when the RaceTrac proposal is
heard by the BCC (May 24th pending).
FISCAL IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no
legal issues, and requires majority vote for approval. -JAK
