EXECUTIVE SUMMARY
Recommendation to approve a Right of Entry to The District School Board of Collier County,
Florida to provide a temporary construction staging area and access over County-owned property
to facilitate the installation and construction of a water cooler tank at Vineyards Elementary
School.
OBJECTIVE: To approve a staging area and access over Collier County's Vineyard Park property
(County).
CONSIDERATIONS: The attached Right of Entry provides for the District School Board's (School)
contractor to utilize the area shown on Exhibit"A"attached to the Right of Entry as a temporary staging
area and access over the Vineyard's Park property to facilitate the installation and construction of a water
cooler tank(Project)at the Vineyards Elementary School.
The Right of Entry shall terminate upon the completion of the Project or one (1) year from the date of
execution of the Right of Entry, whichever occurs first. The School will coordinate and schedule with
County staff the times and dates for completing the Project. The School shall restore and return any
impacted lands within the Project area with hydro seed grass. School further agrees that it shall,at its sole
cost and expense,restore and repair any and all damage caused to County's property or improvements as
a result of the School's use of County's property.
FISCAL IMPACT: There is no fiscal impact.

LEGAL CONSIDERATIONS: This item is approved for form and legality and requires majority vote
for approval.-JAB
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth Management
Plan.
RECOMMENDATION:That the Board of County Commissioners approves the attached Right of Entry
and authorizes the Chairman to execute the Right of Entry.

VINEYARDS ELEMENTARY SCHOOL
RIGHT OF ENTRY
KNOW ALL MEN BY THESE PRESENTS that COLLIER COUNTY, a political
subdivision of the State of Florida, hereinafter known as Grantor, for and in
consideration of Ten Dollars ($10.00) and other valuable consideration to it in hand
paid, does hereby grant unto THE DISTRICT SCHOOL BOARD OF COLLIER
COUNTY, FLORIDA, its successors, assigns, agents, or contractors, hereinafter known
as Grantee, the temporary license and right to enter upon the lands of the Grantor
described in Exhibit "A", for the sole purpose of temporary construction staging and
access to facilitate the installation and construction of a water cooler tank at Vineyards
Elementary School (the "Project").
ALL RIGHT AND PRIVILEGE herein granted shall terminate upon the earlier of
completion of the Project or one (1) year from the date of execution of this Right of
Entry.
ADDITIONALLY, the rights and interest conveyed hereunder are conditioned
upon the reasonable exercise thereof by Grantee. Grantee shall only access lands of
Grantor through Grantee's property. Grantee shall fence off lands of Grantor and locate
all water pipes on lands of Grantor prior to using this Right of Entry. Grantee agrees not
to damage or remove any trees from the lands of Grantor. Grantee shall coordinate and
schedule with Grantor (or its staff) the times and dates for completing the Project.
Grantee shall restore and return any impacted lands of Grantor with hydro seed grass.
Grantee further agrees that it shall, at the Grantee's sole cost and expense, restore and
repair any and all damage caused to Grantor's property or improvements as a result of
Grantee's use of this Right of Entry.
IN WITNESS WHEREOF, the Grantor has caused these presents to be
executed in its name this day of , 2016.
