EXECUTIVE SUMMARY Recommendation to hire Hole Montes, Inc. for expert analysis and testimony in an amount not to exceed $24,357, Wilcox Appraisal Services, Inc. for expert appraisal services and testimony in an amount not to exceed $50,000, and Agnoli, Barber & Brundage, Inc. for expert analysis and testimony in an amount not to exceed $35,000 for support in the eminent domain cases styled Collier County v. S.D. Corporation, Inc., Case No. 15-CA-1580, and Collier County v. April Chappell, et al., Case No. 10-3932-CA filed in the Lely Area Stormwater Improvement Project,No. 51101. (Fiscal Impact: $109,357) OBJECTIVE: To retain expert support for pending eminent domain litigation for the Lely Area Stormwater Improvement Project. CONSIDERATIONS: On October 27, 2010, Collier County condemned Parcel 145DAME, a 0.8 acre drainage, access and maintenance easement, in the case styled Collier County v. April Chappell, et al., Case No. 10-3932-CA. Parcel 145DAME was formerly owned by Gulfview Townhomes, LLC and was condemned in order to construct the Royalwood/Whitaker portion of the Lely Area Stormwater Improvement Project (hereinafter referred to as "LASIP"). Subsequently, on October 29, 2015, Collier County condemned Parcels 251DAME, 255DAME, 257DAME, and 258DAME, drainage, access and maintenance easements, and Parcels 258TCE1 and 258TCE2, temporary construction easements, totaling roughly 10.26 acres, in the case styled Collier County v. S.D. Corporation, Inc., et al., Case No. 15-CA-1580. Parcels 251DAME, 255DAME, 257DAME, 258DAME, 258TCE1, and 258TCE2 were taken from a 70 acre +/- tract owned by S.D. Corporation of Naples, Inc. and Cypress Landings II of Naples, LLC, which are owned and operated by the same principals, and were condemned in order to construct the Sandy Lane Interconnect/Wingsouth portion of LASIP. In both cases, claims have been made by the property owners for severance damages due to damaged developmental potential, resulting in the need for professional review and analysis by an expert engineer and land planner experienced with development projects in Collier County. If the cases proceed to trial, expert testimony based on that analysis will also be required. The County Attorney's office, outside counsel and staff recommend the hiring of Hole Montes, Inc., under the terms of Contract No. 13-6164 (the County's Fixed Rate Annual Contract for Engineering and Architectural Services). Hole Montes has submitted the attached proposals dated December 1, 2015 and January 11, 2016 quoting an estimated total of $24,357 for both professional services and expert testimony. In addition, if the case proceeds to trial, litigation support and expert testimony will be required of the appraiser of record as well as the design engineer for LASIP. Attached are proposals from Alan Wilcox of Wilcox Appraisal Services, Inc. (appraisal testimony) in the amount of$50,000 and Dan Brundage of Agnoli, Barber and Brundage, Inc. (design engineer for LASIP) in the amount of$35,000 for litigation support and expert testimony in their relevant field. GROWTH MANAGEMENT IMPACT: None. Additional costs would include out-of-pocket expenses, such as, exhibit materials and miscellaneous. It should be understood that it is impossible to estimate with great accuracy the total time and expenses that will be necessary to complete all of the related tasks associated with the above additional appraisal services and litigation support services. However, for purposes of providing a reasonable initial estimate, I would estimate a total fee of$50,000 would be appropriate. It is important that I advise you that I am not an expert in determining the absence or presence of jurisdictional systems including, but not necessarily limited to wetlands, wildlife habitats, or other biological communities.
