EXECUTIVE SUMMARY
Recommendation to approve a Joint Motion and Stipulated Final Judgment in the total
amount of $41,749.00 for Parcels 118RDUE, 118DE, and 118TDRE, in the lawsuit
captioned Collier County v. John C. Peeples, et al, Case No. 2015-CA-1957, required for the
construction of a replacement bridge on White Boulevard over the Cypress Canal, Project
No. 66066. (Fiscal Impact: $7,049.00)
OBJECTIVE: To settle full compensation for the taking of Parcels 118RDUE, 118DE, and
118TDRE, for the construction of a replacement bridge on White Boulevard over the Cypress
Canal (Project 66066),hereinafter referred to as the"Project".
CONSIDERATIONS: On February 3, 2016, Collier County condemned Parcels 118RDUE,
118DE, and 118TDRE, and deposited $34,700.00 into the Court Registry as a good faith
estimate of value pursuant to an Order of Taking in the lawsuit styled Collier County v. John C.
Peeples, et al, Case No. 2015-CA-1957. All three parcels were needed in order to construct the
Project, and are located over property owned by Peggy J. Hoy. Parcel 118RDUE is a perpetual,
non-exclusive road right-of-way, drainage and utility easement. Parcel 1118DE is a perpetual,
non-exclusive drainage easement. Parcel 118TDRE is a temporary driveway restoration
easement, with a duration of three years. An aerial of Parcels 118RDUE, 118DE, and 118TDRE
is attached. Through negotiations, the parties agreed to total compensation in the amount of
$40,000.00 for full compensation for the property taken, as well as $1,749.00 for all attorney's
fees and expert fees. If approved, the County will be required to pay an additional $7,049.00.
The County Attorney's Office and Staff recommend approval of this Stipulated Final Judgment
since a better result is not anticipated at trial. Upon approval, the County Attorney's Office will
file the Joint Motion and Stipulated Final Judgment with the Circuit Court.
FISCAL IMPACT: Funds in the amount of$7,049.00 will be paid from gas taxes from White
Boulevard/Cypress Canal Project No. 66066.
GROWTH MANAGEMENT IMPACT: None.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and
requires a majority vote for Board approval. —ERP
RECOMMENDATION: That the Board of County Commissioners approves the attached Joint
Motion and Stipulated Final Judgment, and authorizes the payment of funds as stated herein.

Motion, the Court finding that the compensation to be paid by Petitioner is the full compensation
due the Respondent, PEGGY J. HOY, and the Court being otherwise fully advised in the

118RDUE, 118DE and 118TDRE, at which time title to said parcels as described in Exhibit"A"
vested in the name of the Petitioner; it is further
ORDERED that Petitioner, COLLIER COUNTY, FLORIDA, shall pay One Thousand
Seven Hundred Forty-Nine and No/100 Dollars ($1,749.00) to Respondents for all attorney's
fees, expert fees and costs, and no other attorney's fees or costs shall be awarded in this case; it
is further
ORDERED, that within thirty (30) days of entry of this Stipulated Final Judgment, the
Clerk shall disburse from the Court Registry the amount of Thirty Four Thousand Seven
Hundred and No/100 Dollars ($34,700.00) to Craig D. Blume Trust Account, 750 Eleventh
Street South,Naples,FL 34102; it is further
ORDERED that within thirty(30) days hereof,Petitioner shall pay the total sum of Seven
Thousand Forty Nine and No/100 Dollars ($7,049.00) to Craig D. Blume Trust Account, 750
