EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners(Board) appoint a committee of ten (10) voting members to provide local input to the Florida Fish and Wildlife Commission (FWC) on proposed changes to the manatee protection zones in Collier County. OBJECTIVE: To create a Local Rule Review Committee (LRRC) to review the Florida Fish and Wildlife Conservation Commission (FWC) proposed changes to the manatee protection zones and provide comments, recommendations and modifications if warranted. CONSIDERATIONS: The Florida Fish and Wildlife Conservation Commission (FWC) approved a Manatee Management Plan (MMP) in December 2007 to provide a state framework for conserving and managing manatees in Florida. The Manatee Protection Rule of Collier County was adopted in 1997 and no comprehensive review has been performed since that time. New data is now available and FWC has officially noticed Collier County to solicit a LRRC to review and provide comments to proposed changes. On February 9, 2016 (Item 11A) the Board approved the establishment of a LRRC and directed staff to solicit applications for committee membership. The Board codified this direction with Resolution 2016-040 on February 23, 2016 (Item 16K1). The Board approved: • The appointment of a committee of ten (10) voting members and four (4) non-voting members who can represent the interests of the entire County. • That each District Commissioner recommend a "waterway user" and a "manatee advocate" as voting members for their District. • That each municipality, along with the County, appoint a non-voting member. • That the County invite other state and federal agencies to participate in this review process. As outlined in Resolution 2016-040, staff solicited applications for the ten (10)voting members for the LRRC and received the applications listed on page two (2) of this Executive Summary. Several municipalities have requested time extensions to allow their councils to meet, nominate and approve the non-voting member. Once all four(4)non-voting members have been identified, they will be presented to the Board for appointment. FISCAL IMPACT: There is no fiscal impact associated with this item. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK RECOMMENDATION: To appoint a committee of ten (10)voting members to provide local input to the Florida Fish and Wildlife Commission (FWC) on proposed changes to the manatee protection zones throughout Collier County. RESOLUTION NO. 2016 - 40 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA AMENDING RESOLUTION NO. 2016-31 WHICH ESTABLISHED A LOCAL RULE REVIEW COMMITTEE FOR MANATEE PROTECTION SPEED ZONES, IN ORDER TO INCLUDE NON-VOTING MUNICIPAL MEMBERS WHEREAS, the creation of speed zones to regulate vessels in Collier County for manatee protection is important in protecting the endangered Florida manatee; and WHEREAS, the Florida Fish and Wildlife Conservation Commission (FWC) is the primary agency responsible for creation of manatee protection speed zones in Collier County; and WHEREAS, the FWC notified Collier County of its intention to consider new or amended manatee protection rules in Collier County; and WHEREAS, pursuant to Florida Statute 379.2431(2)(f), proposed rules of the FWC Commission shall be submitted to the counties in which the proposed rules will take effect for review by local rule review committees; and WHEREAS, pursuant to Florida Statute 379.2431(2)(f)8, the local rule review committee shall have 60 days from receipt of the proposed rule to submit a written report to FWC Commission members and staff; and WHEREAS, it is in the public interest and benefit to create such a committee; and WHEREAS, on February 9, 2016, the Board of County Commissioners (Board) approved Resolution No. 2016-31, which established said committee; and WHEREAS, the Board desires to amend Resolution No. 2016-3I to include non-voting members on the committee to be appointed by the municipalities. For many years, i have been concerned not only for the safety of manatees, but for the safety of the many people who fish from small boats, and canoe or use I,l:ayaks and paddle boards. hi the past, I tried to get speed zone signage, destroyed during (hurricanes, replaced along the Cocohatchee River and for the signs to agree with the idle speed zone designation per Ordinance No. 97-10. To do this, I corresponded with Commissioner Hiller and Fish and Wildlife. Further, I have spoken with Collier County Marine Sheriffs about enforcement of the ordinance. I've been told that without proper signage, speed zones are very (difficult to enforce. I am very interested in being a member of this advisory committee,however I will be leaving Naples in May and not returning until November. We want to protect the Manatees that visit our bays. Slow boat speeds allow the slow moving Manatees to swim safely in our small bays. We provide for monthly water testing and quarterly trawling to develop trends for knowledge of marine life in our bays. We're pleased to note new sea grass growth in our shallower waters. Our many kayakers on the bay have reported seeing Manatees in our waters as well as many Dolphins.No Wake speeds benefit all. STB has seeded oysters and lams in our bay and we pay for a captained boat to trawl in our bay quarterly,with the Naples atural Resources Dept. assessing the types, size and health of the Marine specimens present in •ur waters. They now have accumulated 10 years worth of data to determine a trend for our aters. We report our findings and news of the bays in our periodic newsletters to the residents •f Moorings Bays.
