EXECUTIVE SUMMARY Recommendation to approve a Transportation Post Project Maintenance Agreement between the Florida Department of Transportation (FDOT) and Collier County for the maintenance of brick pavers installed on a portion of Davis Boulevard between Santa Barbara Boulevard and County Barn Road,upon completion of Financial Project#433173-1-52-01; and a Resolution memorializing the Board's approval of the Agreement. OBJECTIVE: To obtain the Board of County Commissioners (Board) approval of the attached FDOT Transportation Post Project Maintenance Agreement for the maintenance of brick pavers installed on Davis Boulevard between Santa Barbara Boulevard and County Barn Road,upon completion of Financial Project#433173-1-52-01, and a Resolution memorializing the Board's approval of the Agreement. CONSIDERATIONS: As part of the FDOT's road improvements on Davis Boulevard between County Barn Road and Santa Barbara Boulevard, in Collier County, brick pavers will be installed within medians instead of asphalt to match the existing roadway design and to stabilize the narrow portions of the median. FDOT will furnish and install brick pavers at the following locations in accordance with Financial Project#433173-1-52-01: • Sta. 147+38 Separator • Sta. 129+57 Median Nose • Sta. 147+58 Median Nose • Sta. 155+09 Median Nose • Sta. 156+29 Median Nose Upon completion of the road construction project, the County will be responsible, at its cost, for the maintenance of the brick pavers, which would be limited to weed control, cleaning, and replacement, as needed. FDOT will continue to mow and edge the intersection improvements and maintain all other aspects of the State Road maintenance program. FDOT requires Collier County to execute a Maintenance Agreement reflecting the County's maintenance obligations with regard to the brick pavers. FDOT also requests that the County execute a Resolution authorizing the Chairman to sign the Maintenance Agreement. FISCAL IMPACT: Upon completion of Financial Project #433173-1-52-01 the maintenance responsibility will be assumed by the Landscape Section of the Growth Management Department at an estimated annual incremental cost of$500. Maintenance dollars are budgeted in the Unincorporated Area General Fund(111). GROWTH MANAGEMENT IMPACT: This project is consistent with the Transportation Element of the Growth Management Plan,and produces no negative impact. LEGAL CONSIDERATIONS: This item has been approved as to form and legality, and requires majority vote for the Board approval. SAS RECOMMENDATION: To approve and authorize the Chairman to execute the attached FDOT Transportation Post Project Maintenance Agreement whereby the County will assume the maintenance responsibility of the brick pavers installed on a portion of Davis Boulevard between Santa Barbara Boulevard to County Barn Road, upon completion of Financial Project #433173-1-52-01, and a Resolution memorializing the Board's approval of the Agreement. FPID #433173-1-52-01 POST-PROJECT MAINTENANCE AGREEMENT: Collier County Page 1 of 2 TRANSPORTATION OFF SYSTEM POST PROJECT MAINTENANCE AGREEMENT BETWEEN FLORIDA DEPARTMENT OF TRANSPORTATION AND COLLIER COUNTY This is an Agreement, by and between the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (hereinafter, the "DEPARTMENT") and Collier County, Florida, a political subdivision of the State of Florida (hereinafter, "LOCAL AGENCY") for the maintenance of off system post-project transportation enhancements described below. WITNESSETH 1. WHEREAS, the LOCAL AGENCY is authorized to undertake a project within the DEPARTMENT geographical limits; and 2. WHEREAS, said project is identified and known to the parties as Financial Project# 433173-1-52-01, which will benefit the LOCAL AGENCY; and 3. WHEREAS, in accordance with Title 23, U.S. Code, Section 116 and Federal Highway Administration regulations issued pursuant thereto, there must be an agreement from the LOCAL AGENCY to maintain the project; and 4. WHEREAS, the LOCAL AGENCY by Resolution No. , dated ,, a copy of which is attached hereto as Exhibit A and made a part hereof, has consented to and approved the Agreement and has authorized its Chairman or designee to execute said Agreement. NOW, THEREFORE, in consideration of the premises, the parties agree as follows: 1. The DEPARTMENT has undertaken the project and obtained approval for federal participation on construction to SR 84 (Rd ID 03001000) from milepost 2.974 to 3.983 for a total of 5,328 linear feet, to furnish and install brick pavers at the following locations further described in Exhibit B: • Sta. 147+38 Separator • Sta. 129+57 Median Nose • Sta. 147+58 Median Nose • Sta. 155+09 Median Nose • Sta. 156+29 Median Nose 1. It is understood and agreed by the parties that upon completion of the project, the LOCAL AGENCY shall be responsible, at its costs, for maintenance of said project in accordance with (a) the attached "Scope of Maintenance" also described as Exhibit C, (b) the following federally accepted state standards: Manual of Uniform Minimum Standards for Design, Construction and Maintenance for Streets and Highways (2012), as amended. 2. This document incorporates and includes all prior negotiations, correspondence, conversations, agreements or understandings applicable to the matters contained herein and the parties agree that there are no commitments, agreements or understanding concerning the subject matter of this Agreement that are not contained in this document. The interlocking pavers follow the design criteria of ASTM C-936-82 with compressive strength minimum 8,000 psi. Background: As part of the FDOT's road improvements on Davis Blvd. between Santa Barbara Blvd. and County Barn Rd. in Collier County, brick pavers were installed within medians instead of asphalt to match existing roadway design and to stabilize narrow portions of the median.
