Recommendation to approve Petition VAC-PL20150002259, to disclaim, renounce and vacate the County and the public interest in a portion of the 10-foot Utility Easement, recorded in Official Record Book 1137, Page 638 and the 50-foot Utility Easement recorded in Official Record Book 1401,Page 757 of the public records of Collier County,Florida, located in Section 9, Township 48 South,Range 25 East, Collier County, Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the 10-foot wide Utility Easement, recorded in Official Record Book 1137, Page 638 and the 50- foot Utility Easement recorded in Official Record Book 1401, Page 757 of the public records of Collier County, Florida, located in Section 9, Township 48 South, Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A. CONSIDERATIONS: Petition VAC-PL20150002259 has been received by the Development Review Division, Growth Management Department from Wilson Garcia, P.E. of Hole Montes, Inc., as agent for the property owner, to vacate a portion of the 10-foot wide Utility Easement, recorded in Official Record Book 1137, Page 638 and the 50-foot Utility Easement recorded in Official Record Book 1401, Page 757 of the public records of Collier County, Florida, located in Section 9, Township 48 South,Range 25 East, Collier County, Florida. A redevelopment project is under construction at the West and East Clubhouses of the Bentley Village Community. During the Site Development Plan (SDP) amendment process, staff requested certain County Utility Easements be vacated due to inconsistencies with proposed structures. Improvements associated with the West Clubhouse will be built over two separate portions of the existing 10-foot County Utility Easement (C.U.E.) that contain fire hydrants. The existing locations of the fire hydrants are no longer necessary for the new proposed site, so these sections of the C.U.E. can be vacated without causing any detriment to the public. New fire hydrants and associated easements will be provided for the new site as part of the Site Development Plan process (Petition No. SDP-PL20130000949) so no replacement easements are needed at this time. Improvements associated with the East Clubhouse will be built over portions of the existing 50-foot Utility Easement which contains sewer and potable water facilities. These facilities and associated easements will be relocated on-site and provided as part of the SDP process so no replacement easements are needed at this time. There is no public detriment because the facilities are being relocated. The Development Review Division and Public Utilities Department has reviewed this petition and found no reason for objection. FISCAL IMPACT: Growth Management Department, Development Review Division staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition.
