EXECUTIVE SUMMARY To bring to the Board's attention outstanding invoices related to the procurement of background checks and fingerprinting by the Florida Department of Law Enforcement and the Federal Bureau of Investigation due to new statutory requirements for a shared clearinghouse amongst agencies established by Florida Statute 943.053. OBJECTIVE: To bring to the Board's attention changes in rates related to the procurement of background checks and fingerprinting by the Florida Department of Law Enforcement and the Federal Bureau of Investigation due to new statutory requirements. CONSIDERATIONS: In response to Homeland Security, the State of Florida (Section 126.5801, Florida Statutes) authorizes the Board of County Commissioners to conduct background checks on County employees. On July 27, 2004, the Board of County Commissioners approved an Ordinance (#2004-52, as amended) that mandates state and federal criminal history records checks for applicants and current employees, contractors, vendors, repair persons, and delivery persons, deemed by the Board to be critical to security or to public safety regarding any facility owned or operated by Collier County. On April 12, 2011, the Board of County Commissioners approved Item 16.E.2 at the specific rate of $43.25 per person related to the procurement of background checks and fmgerprinting by the Florida Department of Law Enforcement and the Federal Bureau of Investigation. This rate is paid by contractors, and in the case of employees, by the Human Resources Department or the individual departments. At that time, the estimated annual amount was $100,000,which has been reimbursed by contractors and user departments. Florida Statute 943.053 updates now require a shared clearinghouse of background check data for Department of Children and Families, Department of Juvenile Justice, Department of Elder Affairs and Guardian Ad Litem employees or contractors, to be retained for five years. This five year retention fee is charged in advance. Staff requested that Mr. Ochs sign the Background Screening Provider User Registration Agreement on behalf of the County. If "statutory rates", rather than a flat rate that is subject to change, are approved by the Board, this agreement and related rate changes can be audited by the Clerk for payment Packet Page-333- 1/12/2016 13.B. FISCAL IMPACT: Specific amounts unknown. Current invoices presented to the Clerk's office range between$2,500 and$4,000 per month. GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: That the Board review and take action regarding new rates for background checks as charged by the Florida Department of Law Enforcement and the Federal Bureau of Investigation. The purpose of this database is to provide a single data source for background check results for those providing services to children,the elderly and disabled individuals. This requirement mostly applies to those in the Parks and Recreation and Community and Human Services Divisions. All other employees and contractors are not subject to this requirement. Attached is the Background Screening Provider User Registration Agreement for your review and signature. Per the County Attorney's Office pursuant to both the County Administrator Ordinance and F.S 125.74,the County Manager has the authority to sign documents that are administrative or ministerial in nature.
