EXECUTIVE SUMMARY Recommendation to accept the "2016 Indexing Calculations" report, prepared by Tindale-Oliver and Associates, in accordance with the adopted indexing methodology, and to adopt an Ordinance amending Chapter 74 of the Collier County Code of Laws and Ordinances, which is the Collier County Consolidated Impact Fee Ordinance,amending the Road Impact Fee rate schedule,which is Schedule One of Appendix A, and the Correctional Facilities Impact Fee rate schedule, which is Schedule Four of Appendix A, and providing for an effective date of September 12, 2016, in accordance with the 90-day notice requirements set forth in Section 163.31801(3)(d), Florida Statutes and to allow for impact fee deferral requests to be filed after the building permit was received for those permits issued between June 23,2015 and June 23,2016. OBJECTIVE: That the Board of County Commissioners (Board) adopts an ordinance amending Chapter 74 of the Collier County Code of Laws and Ordinances (Code) to provide for the incorporation of the 2016 Indexing Calculation and associated impact fee rates for Transportation (Road) Impact Fee and the Correctional Impact Fee rates, and to allow for requests for impact fee deferrals to be filed after the building permit was received for permits issued between June 23, 2015, when the Board reinstated the Impact Fee Deferral Program, and June 23,2016. CONSIDERATIONS: Sections 74-302 (Road) and 74-308 (Correctional Facilities)of the Code of Laws and Ordinances (Code) require that in each of the two mid-cycle years between the formal three-year updates,the County shall implement adjustments to the impact fee rates based on the percentages set forth in the Impact Fee Indexing Study, as updated annually,and in accordance with the indexing methodology specified in the current and adopted impact fee study. On April 28,2009,the Board adopted Ordinance 2009-17,which amended the Code to reflect a change to the use of a two-year average model from the 10-year regression analysis model to calculate the various indices,as this method is intended to be more responsive to cost fluctuations. On February 10,2015,the Board adopted Ordinance 2015-17 which amended the Code to incorporate the Collier County Transportation Impact Fee Study Update and the Correctional Impact Fee Update Study and amended the Road and Correctional Impact Fee rate schedules. The adopted rate schedules were effective February 17,2015 (decreases)and May 11,2015 (increases). The attached Indexing Calculation Report (Attachment A) was prepared by Tindale-Oliver and Associates, Inc. for the 2016 annual indexing of Road and Correctional Facilities Impact Fees. Four measures are used, alone or in combination, to calculate the indexing percentages for the various impact fees.These measures include land costs,building costs,building equipment costs and transportation costs. Based on this information, the total indexing percentage is then calculated for each of the individual impact fees. The indexing percentage calculated in the attached report for Road Impact Fees is a 3.7% increase, and the percentage calculated for Correctional Facilities Impact Fee is a 3% increase. The proposed Road and Correctional Facilities Impact Fee Rate Schedules incorporating the increases are shown in Appendix A of the attached Ordinance Amendment (Attachment B). The overall percentage increase of the total impact fees on a single-family home with less than 4,000 square feet is approximately 1% as shown in Attachment C. Recent bid activity has shown that roadway construction costs are increasing significantly. Staff will continue to monitor these increases over the next several months and, in the event costs continue to escalate, will move forward with a Road Impact Fee Cost and Credit Update to ensure that the impact fee remains current with costs. Emergency Medical Services (EMS), Government Buildings, Law Enforcement and Library Impact Fee Update Studies are currently proceeding through their required full updates, are expected to be complete within the next few months,and therefore,are not being indexed at this time. On April 6, 2016, the Development Services Advisory Committee voted to accept the Indexing Calculation report;however,they voted unanimously,with one abstention,to recommend that the fees not be increased at this time. On May 10, 2016, (Item 16.A.21) the Board directed the County Attorney to advertise for future consideration an ordinance amending Chapter 74 of the Code in order to adopt the indexing study and associated changes to the impact fee rates. Additionally, the Impact Fee Deferral Program for owner-occupied units, which was suspended in December 2009, was reinstated by the Board on June 23, 2015. The Code currently requires that any person seeking a deferral shall file an application prior to receiving a building permit for the proposed development. Subsequently, on April 26, 2016, due to some developers being unaware that the program had been reinstated, the Board directed staff to amend the Code to allow applicants to file an application for deferral after receiving a building permit for permits that were issued after the program was reinstated. The proposed amendment is applicable to building permits issued between June 23, 2015 and June 23, 2016. FISCAL IMPACT: Based upon current activity and historical collections, the projected increase in revenue associated to the indexing in the first year after implementation, assuming that development activity remains constant, is approximately $400,000 for Road Impact Fees and approximately $44,000 for Correctional Impact Fees. In addition, the aggregate amount of owner-occupied impact fee deferrals per fiscal year will remain within the allowable limitation of 3% of the prior years' total impact fee collections. GROWTH MANAGEMENT IMPACT: The concepts of annual indexing and impact fee updates are consistent with Objective 2 of the Capital Improvement Element (CIE) of the Collier County Growth Management Plan (GMP) states: "Future development will bear a proportionate cost of facility improvements necessitated by growth." Additionally, this approach is consistent with Section 163.31801, Florida Statutes, which is the Florida Impact Fee Act 2006,requiring the most recent and localized data be used in impact fee calculations. Introduction Collier County retained Tindale Oliver to calculate the updated indices for the following program areas: • Correctional Facilities • Transportation Updated school and parks impact fees were adopted in 2015, and the County is currently updating the technical studies for government buildings, emergency medical services facilities, law enforcement facilities, and library facilities. As such, indices for these program areas are not included in this document. In addition, per recommendation of the County's Consultant, water and wastewater impact fees are not indexed. This technical report provides a summary of the updated indices and the calculations of combined indices for the program areas listed above. Calculation of Indices As part of the calculations, the following indices were updated: • Collier County Property Values; • Consumer Price Index (CPI); • Producer Price Index (PPI) (for equipment and highway construction separately); • Engineering Building News (ENR) Record Building Cost Index; • Turner Building Cost Index; and • RS Means Building Cost Index • Florida Department of Transportation (FDOT) Average Roadway Construction Cost, based on data from District 7 Table 1 presents the updated individual indices that will be used in the calculation of the overall indices for each program area. The table also provides a comparison to 2012 indices. It should be noted that the indices were calculated based on the most recent two years of data available, 2014 and 2015 (through the latest month/quarter available). Consistent with the adopted indexing methodology, for building cost index, ENR, RS Means, and Turner Building Cost indices were used. In the case of equipment/vehicle cost index, CPI and PPI for equipment were used. The land index is based on data from the Collier County Property Appraiser. The roadway construction index utilizes a combination of PPI Highways and FDOT District 7 data for 2014 and 2015. SECTION FOUR. INCLUSION IN THE CODE OF LAWS AND ORDINANCES. The provisions of this Ordinance shall be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or re- lettered and internal cross-references amended throughout to accomplish such, and the word "ordinance" may be changed to "section,""article,"or any other appropriate word.
