Recommendation to approve Petition VAC-PL20160000343, to disclaim, renounce and vacate the County and the public interest in a portion of the 30-foot wide County Utility Easement (C.U.E.), and the private interest in a portion of the 5-foot wide Utility Easement(U.E.)located in Lot 1,Block C of Boca Palms of Naples as recorded in Plat Book 16, Page 67 of the public records of Collier County, Florida, located in Section 25,Township 48 South,Range 25 East,Collier County,Florida. OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the 30- foot wide C.U.E.,and the private interest in a portion of the 5-foot wide U.E. located in Lot 1,Block C of Boca Palms of Naples as recorded in Plat Book 16, Page 67, of the Public Records of Collier County, Florida,located in Section 25,Township 48 South,Range 25 East, Collier County,Florida. CONSIDERATIONS: Petition VAC-PL20160000343 has been received by the Development Review Division, Growth Management Department, from Richard D.Yovanovich,Esq.,of Coleman,Yovanovich &Koester,P.A., as agent for the property owner,to vacate the County and the public interest in a portion of the 30-foot wide C.U.E., and the private interest in a portion of the 5-foot wide U.E. located in Lot 1, Block C of Boca Palms of Naples as recorded in Plat Book 16, Page 67 of the Public Records of Collier County,Florida,located in Section 25,Township 48 South,Range 25 East,Collier County,Florida. The purpose of this vacation request is to allow existing and proposed structures over areas currently encumbered by these easements. There are already existing permitted structures encroaching within the easements, including a pool and screen enclosure that were constructed in 1993 and received a Certificate of Occupancy. The property owner is also proposing to construct a new garage addition that would also encroach into the easements, and therefore cannot proceed with the addition until the subject easements are vacated. The 5-foot U.E. was dedicated to "Florida Power and Light Company, United Telephone Company of Florida, and any cable television franchise company," according to the plat. The applicant has provided letters of no objection from FPL, CenturyLink (as successor company to United Telephone), and any other utility companies that may have an interest in the U.E.which indicates their consent to the proposed vacation. There is no County or public interest in this 5-foot Utility Easement, so only private interests in the easement are being vacated on the plat. The 30-foot C.U.E. was dedicated to the Collier County Water-Sewer District, according to the plat. Public Utilities' staff has determined that it will not need the portion of the C.U.E. that is proposed to be vacated, and staff has confirmed that the proposed vacation will not have an adverse impact on the subject property or surrounding properties. The Board of County Commissioners is the ex-officio governing body of the Water-Sewer District,so the Board has authority to vacate this easement. The public will benefit from the proposed vacation because the County and other utility providers will no longer have maintenance responsibility or liability for easement areas that they do not currently, or propose to, utilize. There will be no public detriment from the proposed vacation of the C.U.E. because the County no longer needs the subject portion of the C.U.E., and there will be no adverse impact on the surrounding properties.There will be no public detriment from the proposed vacation of the U.E.because it only affected private interests and does not impact any County or public interest. The vacation will not affect ownership or right of convenient access of persons owning other parts of the subdivision. Moreover, Packet Page -2296- 6/14/2016 17.C. allowing the property owner to build an addition to their home within these easement areas will allow a better use of the property and increasing the property value,resulting in increased property taxes. Staff has reviewed this petition and found no reason for objection. Letters of no objection have been received from abutting property owners who responded, Boca Palms of Naples Association,Inc., and all pertinent utility providers that may have an interest in the easement(s). FISCAL IMPACT: Staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this Executive Summary. LEGAL CONSIDERATIONS: There is no public interest in the 5-foot U.E. because the easement was only dedicated to private entities on the plat. Therefore,the vacation of the portion of the 5-foot U.E. will only act to remove the physical depiction of the U.E. on the Boca Palms of Naples plat, and any additional private rights created or affected by third parties over the 5-foot U.E. must be separately terminated.
