EXECUTIVE SUMMARY Recommendation to consider certain affiliations of Public Safety Authority members to other groups and determine that these affiliations do not present a conflict as set forth in the Public Safety Authority Ordinance. OBJECTIVE: To notify the Board of County Commissioners of affiliations of members of the Public Safety Authority (PSA) with other groups for a determination of whether such affiliations case a conflict. CONSIDERATIONS: The Collier County Public Safety Authority was created as an Advisory Board with the following purposes, powers and duties: (1) To assist the Board of County Commissioners, municipalities, fire departments, and law enforcement agencies, including the Collier County Sheriff's Office and hospitals, with issues affecting pre-hospital emergency medical services within all of Collier County. (2) To hear issues associated with pre-hospital emergency medical services when requested by a participating agency and make written recommendations to the Board of County Commissioners and involved agencies. (3) To work to improve and enhance pre-hospital emergency medical care within Collier County with thorough study, education, and system-wide participation by the response agencies and the local medical community as noted above. (4) To make its special knowledge and expertise available to any and all agencies upon request of the governmental board or agency when so charged during regular board meetings. (5) To serve as a catalyst to effect cooperative arrangements for improving and best utilizing emergency medical resources in Collier County, utilizing the resources of all municipal, dependent and independent fire organizations, 911 call centers, law enforcement agencies and the public. (6) To make recommendations, as warranted, regarding first responder programs,training programs, communication systems, and other appropriate facilities and services that positively impact on the delivery of emergency medical services. (7) To assist in the development of Interlocal Agreements and appropriate standards of care provided by all agencies so as to adjust levels of service commensurate with the needs of citizens of Collier County. Such efforts shall be in a cooperative fashion so as to implement those changes consistently countywide by all appropriate agencies. (8) The Authority may convene technical working groups from the community periodically to address the following: a. Community education and awareness. b. Emergency medical dispatch. c. Trauma triage and care. d. Pre-hospital emergency medical training. e. Clinical coordination and quality outcomes. Packet Page -1315- 6/14/2016 16.E.3. f. Field coordination and operational concerns. (9) The Authority will develop general guidelines and scope(s) of study for the technical working groups identified above. Membership of the technical working groups noted above may not exceed 50% participation by a member(s) of the Authority and membership on a technical working committee shall be formally recognized by the Authority before receiving a request for work or input. Specific guidance and charge will be given to technical working groups at regularly scheduled Public Safety Authority meetings. Such guidance shall not be in conflict with the Health Insurance Portability and Accountability Act or other laws of the State of Florida, local or state regulations, and local ordinances. Designation of persons filling temporary or standing committees shall be approved by the Authority and their charge clearly stated. Written reports of findings and oral presentations to the Authority will be duly recorded and submitted on behalf of the body. (10) To perform or assist with any other function or duty as requested by the Board. (Ord. 2012-23, as amended) Questions have been raised by certain members as to whether their affiliations with other groups may constitute a conflict. Sec. 2 of Ord. 2012-23 provides as follows: "The Public Service Authority will be a five member citizens committee with members having no affiliation with any hospital, fire district, EMS, municipality or Collier County Sheriff's Office." Certain PSA members have affiliations with the following groups: Contractors Licensing Board; Police Foundation; Marco Island Fire & Rescue Foundation; Avesta Systems;Neighborhood Health Clinic Board Member. The Contractor Licensing Board is made up of 9 members comprised of local contractors and consumers appointed by the Board of County Commissioners, Naples City Council and Marco Island City Council. The CLB is authorized to review and resolve complaints against contractors by taking disciplinary action including sanctions, fines, suspensions or revocations of a contractor's license, for those found guilty in all three jurisdictions. Avesta Corporation is an Ohio based human resources firm that provides services mostly for the private ambulance sector. The PSA member is a co-signer on the banking loans but is mostly a silent partner in Avesta. The PSA member has conducted limited consulting for clients- none of which are in Collier County. The Marco Island Police Foundation is a 501C3 nonprofit organization dedicated to helping their injured and seriously ill employees or their family members of the Marco Police Department. This foundation also conducts community service events. The Marco Island Fire Rescue Foundation is a 501C3 nonprofit organization dedicated to helping their injured and seriously ill employees or their family members of the Marco Island Fire Rescue Department. The Neighborhood Health Clinic is a non-profit organization that provides quality medical care to low-income, working but uninsured Collier County adults, using a profession volunteer staff and is funded by private philanthropy. The Clinic accepts no government funding. It is solely funded through individual donations, foundations,businesses, religious and civic groups. The County Attorney attended a meeting of the PSA where this issue was fully addressed and opined that none of these affiliations represent a conflict under the Ordinance. However, in the interest of both transparency and caution, it was the County Attorney's recommendation that if the PSA was still concerned about this issue that these affiliations are disclosed to the Board so that any question of a conflict can be resolved. FISCAL IMPACT: None GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting from this action. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. It is the County Attorney's recommendation that should any Commissioner is concerned of any particular named affiliation, that this matter be brought back at a subsequent meeting on Regular Agenda for discussion, at which time the particular PSA member can be present to answer any questions. - JAK RECOMMENDATION: That the Board consider certain affiliations of Public Safety Authority members to other groups and determine that these affiliations do not present a conflict as set forth in the Public Safety Authority Ordinance.
