WHEREAS, by and in accordance with the provisions of the Florida '*";' ,
Statutes, Section 334.021 and 339.05 (3)(a), the Department of
Transportation is authorised, upon request of the County, to expend out
of funds available for the purposes, such monies as may be necessary for
the preparation of construction plans and right-of-way maps in connection
with the development of a revenue project within the County;
Specifically, the proposed widening of S.R. 931 from U.S. 41 to the Marco
•
•
Island Bridge= and
WHEREAS, the State of Florida Department of Transportation, having
requested the County of Collier, Florida to execute and deliver to the State
of Florida Department of Transportation, an agreement for the purpose of
undertaking the preliminary work described above providing for joint
responsibilities of the Department and the County, and said request having
been duly considered.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Collier County, Florida that the Chairman and the Clerk of the Board of County
Commissioners be and are hereby authorised to make, execute, and deliver to
the State of Florida Department of Transportation a Memorandum of Agreement
for the preparation of construction plans and right-of-way maps by the Florida
Department of Transportation in conjunction with the proposed widening of $.L
951 from U.S. 41 to the Marco /eland Bridge.

specifically, the proposed widening of State Road 9S1 from U.S. 41 to Marco
Island Bridge, hereinafter called the "Project", and;
WHEREAS, the County proposes to participate in the cost of the Project,
and has authorised participation in this Agreement by • resolution attached
hereto and incorporated herein.
•
NOW, THEREFORE, in consideration of the covenants and mutual benefits to
• be derived therefrom, the parties agree as follows:
1. The DEPARTMENT will prepare, or cause to be prepared, construction
plans and right-of-way maps for the Project and will be reimbursed for the cost
of such plans and maps from the first proceeds of any bonds sold by or for the
County.
2. The COUNTY will assume the obligation to acquire :ne entire right-of-
way for the Project. The COUNTY will be reimbursed for this expenditure from
• the bond proceeds after reimbursement of Department expenditures incurred under
Section 1,
3. The County will assume the obligations to fund any shortfall in
construction costs that exceed bond proceeds.
4. After construction is completed, the DEPARTMENT will fund the operating
and maintenance costs of the toll facility. The DEPARTMINT will be reimbursed
for this expenditure from excess toll revenues if available or if not
available, from toll revenues upon retirement of the bonded indebtedness. In the
event the Legislature should restrain the Department from entering into any
