Ordinance 2002-22 ORDINANCE NO. 02- 2 2 AN ORDINANCE AMENDING ORDINANCE NUMBER 91-102, THE COLLIER COUNTY LAND DEVELOPMENT CODE, TO CORRECT SCRIVENER'S ERRORS DUE TO OMMISSION OF AN INTENDED REVISION TO SECTION 2.6.21.2.2.; AND AN EXHIBIT DEPLCTING TYPICAL SETBACK REQUIREMENTS FOR DOCK FACILITIES; AND BY PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Collier County Board of County Commissioners adopted Ordinance No. 02-03, amendments to the Land Development Code, on January 9, 2002, and; WHEREAS, following said action staff determined that the Ordinance transmitted to the Department of State did not contain this revision, and exhibit ("Exhibit A"), that were otherwise intended and made a part of the public hearing before the Board of County Commissioners, and therefore constitutes a scrivener's error. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of Collier County, Florida that: SECTION ONE: SCRIVENER'S ERROR AMENDMENTS Section 2.6.21.2.2 of Ordinance Number 02-03, is hereby amended to correct a scrivener's error by amending said Section to read as follows: A. 2.6.21.2.2. For lots on a canal or waterway that is less than 100 feet in width, dock facilities may occupy no more than 25 percent of the width of the waterway or protrude greater than 20 feet into the waterway, whichever is lesser, with the following exception: on manmade canals 60 feet or less in width, which are not reinforced by a vertical seawall or bulkhead, dock facilities may protrude up to 33 percent of the width of the waterway, provided that the procedures outlined in Section 2.6.21.1.1. are observed. A dock extension in accordance with B. Furthermore, "Exhibit A", attached, showing typical setbacks for dock facilities, s~':~be inserted immediately following Section 2.6.21.4.6. SECTION TWO: EFFECTIVE DATE CD This Ordinance shall become effective upon filing with the Department of State.
