Ordinance 2002-18D ORD:[NANCE NO. 2002- 18 ORDZNANCE ESTABLZSHZNG THE LAKE TRAFFORD TORATZON TASK FORCE; PROV[D~[NG FOR CREATZON INTENT; PROVZDI~NG FUNCTTONS, POWERS AND T[ES; PROV~ZDI~NG FOR APPOINTMENT AND ~SZgz¥(.~?...~'~COMPOSi'T[ON, TERMS OF OFFZCE, ATTENDANCE AND F[LLI'NG OF VACANCI'ES; PROVI'D1'NG FOR REMOVAL FROM OFFZCE FOR FAZLURE TO ATTEND MEETt'NGS; PROV~ZDZNG FOR OFFZCERS, (~UORUM AND RULES OF PROCEDURE; PROVZDZNG FOR REVt'EW PROCESS; PROVZD[NG FOR CONFLZCT AND SEVERABI'L]~TY; PROVZDt'NG FOR I'NCLUSI'ON ZN CODE OF LAWS AND ORDI'NANCES; AND PROVI'DI'NG FOR AN EFFECTZVE DATE. WHEREAS, on May 7, 1996, the Board of County Commissio~_~ ~opted Resolution No. 96-225 establishing the Lake Trafford Restoration Task For~;an~ WHEREAS, the Task Force was created as an Ad Hoc Committe~i~th ~ t~ expiring one year from the date of its inception; and · WHEREAS, the purpose of the Task Force is to prepare written ~i~.in~ an-'-d' recommendations to the Board of County Commissioners on the best meth~to ~move and/or prevent an algae bloom and restore Lake Trafford to its unpolluted condition, as well as to locate available funding sources to fund the restoration project; and WHEREAS, throughout the years, the Board of County Commissioners has approved one year extensions of this Task Force to further assist the Board with the restoration project; and WHEREAS, the term of the Task Force will expire on May 7, 2002; and WHEREAS, before the Task Force can prepare its written findings of its evaluation of available methods to restore Lake Trafford and the availability of funding, additional time is necessary. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: Creation and Purpose, The Lake Trafford Restoration Task Force (hereinafter "Task Force") is hereby established to assist the Board of County Commissioners by locating the best methods to restore Lake Trafford to its unpolluted condition. SECT]:ON TWO: Functions, Powers and Duties of the Task Force. The functions, powers and duties of the Task Force shall be as follows: A. Development and implementation of a restoration program to include identification of the best methods to remove and/or prevent an algae bloom in order to restore Lake Trafford to its unpolluted condition; B. Identify available funding sources to fund with the restoration project; and ¢. Prepare written findings and recommendations to the Board of County Commissioners. SECTZON THREE: Appointment and Composition; Terms of Office; Attendance And Filling Vacancies. The Task Force shall be composed of Thirteen (13) members whose representation shall include, but not be limited to, individuals representing the Audubon Society, the South Florida Water Management District, the Florida Fish and Wildlife Conservation Commission, the Department of Environmental Protection, the Big Cypress Basin, the Immokalee Chamber of Commerce, the Conservancy, environmental specialists, marine consultants, and private individual citizens from Immokalee with an interest in the preservation of Lake Trafford. Candidates for the Task Force shall be sought in accordance with the provisions of Collier County Ordinance 2001-55. Terms of office of members of the Task Force shall be for four (4) years. Members of the Task Force shall be appointed by and serve at the pleasure of the Board of County Commissioners. Members shall meet the qualifications for membership and requirements as outlined in Section Five of Ordinance No. 2001-55. Appointment of members to the Task Force shall be by resolution of the Board of County Commissioners, which resolution shall set forth the date of appointment and the term of office. Appointments to fill any vacancies on the Task Force shall be for the remainder of the unexpired term of office. SECTION FOUR: Removal From Office; Failure to Attend F4eetings. Task Force membership attendance requirements, including failure to attend meetings and member removal from office are governed by Collier County Ordinance No. 2001-55, or by its successor ordinance. SECTION FIVE: Officers; Quorum; Rules of Procedure. At its earliest opportunity, the membership of the Task Force shall elect a chairperson and vice chairperson from among the members. Officers' terms shall be for a period of one (1) year, with eligibility for reelection. The presence of seven (7) or more members shall constitute a quorum of the Task Force necessary to take action and transact business. The Task Force shall, by majority vote of the entire membership, adopt rules of procedure for the transaction of business and shall keep a written record of meetings, resolutions, findings and determinations. Copies of all Task Force minutes, resolutions, reports, and exhibits shall be submitted to the Board of County Commissioners. SECTION SIX: Review Process. This Task Force shall be reviewed once every four (4) years in accordance with the procedures contained in Ordinance No. 2001-55. SECTION SEVEN: Conflict and Severability. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. 2 SECTZON EZGHT: Znclusion in the Code of Laws and Ordinances. The provisions of this Ordinance shall become and be made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinances may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section," "article," or any other appropriate word. SECTION NINE: Effective Date. This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
