Resolution 2016-029 RESOLUTION NO. 2016 - 29 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, FORMALLY REQUESTING THAT THE FLORIDA COMMUNITIES TRUST ALLOWS COLLIER COUNTY TO ENTER INTO A LONG TERM, RENEWABLE LEASE WITH THE GOODLAND ARTS ALLIANCE FOR COUNTY-OWNED PROPERTY AT 326 PETTIT DRIVE, GOODLAND, FLORIDA. WHEREAS, on November 30, 2004, the Board of County Commissioners (Board) approved an Agreement for Sale and Purchase with The Trust for Public Land for acquisition of the 2.61-acre Mar-Good Resort in Goodland, Florida; and WHEREAS, the Board also entered into a Grant Contract with the Florida Communities Trust ("FCT") which provided for the reimbursement of seventy-five percent (75%) of the purchase costs using a Florida Forever Program grant. As a condition of the grant, a Declaration of Restrictive Covenants, in favor of FCT, was recorded in the Official Records of Collier County, Florida; and WHEREAS, the Goodland Arts Alliance has requested a long term, renewable lease with Collier County for a portion of the property with the intent of restoring and using it as an artist village; and WHEREAS, although the Declaration of Restrictive Covenants describes the sale or lease of any interest in the Project Site to a non-governmental person or organization as a "disallowable activity," it does allow the FCT latitude to permit such an activity to a certain extent; and WHEREAS, the Board desires to preserve, promote, and advance the cultural presence in the Village of Goodland through art, history and education and considers the proposal made by the Goodland Arts Alliance as a positive step in achieving this goal. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that this Resolution shall serve as a formal request to the Florida Communities Trust to allow a long term, renewable lease between Collier County and the Goodland Arts Alliance for the use of this County-owned property. 1 PASSED AND DULY ADOPTED by the Board of County Commissioners of Collier County, Florida, this 9 day of 2016.
