A RESOLUTION DENYING PETITION PUDA-PL20150000178
TO AMEND ORDINANCE NUMBER 95-33, THE BRIARWOOD
PUD, AS AMENDED, TO ADD PRIVATE CLUBS AND PRIVATE
PARKING GARAGES, AND ASSOCIATED REQUIRED
FEATURES, AS A PRINCIPAL USE IN TRACTS B & C:
COMMUNITY COMMERCIAL, AND OTHER PROPOSED
AMENDMENTS FOR THE PUD PROPERTY CONSISTING OF
209.17± ACRES LOCATED ON THE EAST SIDE OF
LIVINGSTON ROAD, NORTH OF RADIO ROAD, IN SECTION
31, TOWNSHIP 49 SOUTH, RANGE 26 EAST, COLLIER
COUNTY, FLORIDA.
WHEREAS, on April 25, 1995, the Board of County Commissioners approved Ordinance
No. 95-33, the Briarwood Planned Unit Development, in accordance with the Planned Unit
Development document attached thereto; and
WHEREAS, Frederick E. Hood, AICP, of Davidson Engineering, Inc., representing
Premier Auto Suites of Naples, LLC, has petitioned the Board of County Commissioners to
amend Ordinance No. 95-33, the Briarwood Planned Unit Development, as amended, to add
private clubs and private parking garages, and associated required features, as a principal use in
Tracts B & C: Community Commercial, and other proposed amendments; and
WHEREAS, on August 20, 2015 and November 19, 2015, the Collier County Planning
Commission held properly noticed public hearings to consider Petition PUDA-PL20150000178
to amend Ordinance No. 95-33, the Briarwood PUD, as amended; and
WHEREAS, on January 12, 2016, the Board of County Commissioners held a properly
noticed public hearing to consider Petition PUDA-PL20150000178 to amend Ordinance No. 95-
33, the Briarwood PUD, as amended; and
WHEREAS, all interested parties have been given the opportunity to be heard by this
Board in public meeting assembled, and the Board having considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Petition Number PUDA-PL20150000178, filed by Frederick E. Hood, AICP, of
Davidson Engineering, Inc., representing Premier Auto Suites of Naples, LLC, is hereby
DENIED in accordance with the transcript of the proceedings of the public hearing held before
the Board of County Commissioners on January 12, 2016.
BE IT FURTHER RESOLVED that this Resolution be recorded in the minutes of this
Board and filed with the County Clerk's Office.
This Resolution adopted after motion, second and super-majority vote of the Board of
County Commissioners on this 12th day of January, 2016.
