ONE CENT TAX UPON EVERY GALLON OF MOTOR FUEL AND SPECIAL FUEL SOLD IN COLLIER COUNTY FOR THE PURPOSE OF PAYING THE COST OF ACQUISITION,' CONSTRUCTION, RECONSTRUCTION, AND MAINTENANCE OF ROADS AND STREETS, SUBJECT TO APPROVAL AT A REFERENDUM; CALLING A SPECIAL ELEC- TION TO BE HELD ON THE 11th DAY OF MARCH, 1980 FOR THE PURPOSE OF SUBMITTING TO REFERENDUM THE QUESTION OF WHETHER OR NOT TO IMPOSE FOR A PERIOD OF THIRTY YEARS AN ADDITIONAL ONE CENT TAX UPON EVERY GALLON OF MOTOR FUEL AND SPECIAL FUELrSOLD IN COLLIER COUNTY FOR THE PURPOSE OF PAYING THE COST OF ACQUISITION, CONSTRUCTION, RECONSTRUCTION, AND MAINTENANCE OF ROADS AND STREETS; PRESCRIBING ELECTION PROCEDURES AND THE FORM OF THE BALLOT AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the increased use of the presently existing roads and streets by the increasing number of County residents, visitors, businesses and industries has caused in numerous instances an overcrowding and congestion on major roads; j and, WHEREAS, it is deemed to be in the best interest of all residents, visitors, businesses and industries to have an adequate road system in Collier County, which is not choked with traffic congestion, pollution, and accidents; and, WHEREAS, the road improvements required for the growth which is forecasted to continue in Collier County cannot be adequately financed through the existing revenue system; and WHEREAS, it in recognized that the adoption of this additional one cent (1 cent) tax will provide a portion of the funds necessary to maintain the current mobility and provide a safe and efficient roadway system in Collier County. 2 ~ NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, THAT: Section 1. Additional One Cent Fuel Tax. • A. There is hereby imposed, subject to approval at the referendum provided for herein, in addition to all other = taxes required by law, a one cent tax upon' every gallon of motor fuel and special fuel sold in the County and taxed under the provisions of Chapter 206, Florida Statutes, for 1 the purpose of paying the cost of acquisition, construction reconstruction, and maintenance of roads and streets. Said tax shall be collected pursuant to the provisions of Section 336.021, Florida Statutes. B. All or a portion of the tax provided for heroin may be pledged to secure bonds or other forms of indebted- ness issued for the purpose of payin the coat of acquisition, construction, reconstruction, and maintenance of roads and streets. A special election is hereby ordered an ca e to e le c through Collier County on the 11th day of March, 1980 for the purpose of submitting to the qualified electors residing within Collier County the question of whether or not to impose for a period of thirty (30) years in addition to all other taxes required by law, a one cent tax upon every gallon of motor fuel and . special fuel sold in Collier County and taxed under the provisions of Chapter 206, Florida Statutes, for the purpose of paying the cost of acquisition, construction, reconstruction, and maintenance of roads and streets, or bonds issued for such purposes. 1 Section 3. Pollin& Places. The special election shall be held at the polling places designated in each precinct in Collier County, Florida. Section 4, Election Officials. The election officials to conduct said election shall be appointed by the Supervisor of Elections pursuant to applicable general law. Section 5. Hours of Election. The polls will be open at the voting places on the date of said special election from 7:00 A.M. to 7:00 P.M. on the name day. All qualified electors residing within Collier County may vote in said _. .� -_. election. Absentee voting shall be permitted upon compliance with applicable provisions of State law. Scetion 6. Form of Ballot. A. If you do not favor approval of the tax, mark an "X" in the box after the word "AGAINST". Section 7. Notice of Election. The Clerk+of this Board shall publi - a Notice of said Special Election in the Naples Daily News, a newspaper of general circulation pub- lished in Collier County, Florida. Said publication shall be made once a week in the 5th week and in the 3rd week prior to the week in which said referendum election will be held with the first publication to be at least thirty (30) days before the date of the election. Said notice shall be in substantially the following form: • NOTICE OF SPECIAL ELECTION NOTICE IS HEREBY GIVEN that a Special Election will be held throughout Collier County, Florida, on 11th day of March, 1980 at the polling places designated within the precincts for the purpose of determining the following question: Shall a one cent tax upon every gallon of motor fuel and special fuel sold in Collier County , be imposed in addition to all other taxes re- quired by law and taxed under the provisions of Chapter 206, Florida Statutes, for the purpose of paying the cost of acquisition, construction, reconstruction, and maintenance of roads and streets or bonds issued for such purposes as provided by Section 336.021, Florida Statutes.
