I:Forms/County Forms/BCC Forms/Original Documents Routing Slip WWS Original 9.03.04,Revised 1.26.05,Revised 2.24.05;Revised 11/30/12 16K2 RESOLUTION NO. 2014 - 1 1 g A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, DESIGNATING THE JAVA PLUMS LOCATED AT 549 MYRTLE ROAD, NAPLES, FLORIDA, AS SPECIMEN TREES. WHEREAS, Mr. Peter Tierney was in the process of installing a pool at his residence located at 549 Myrtle Road,Naples Florida; and WHEREAS, during the ordinary course of inspections, staff noted that there were 10 Java plums on the premises. Java plums are listed in LDC Section 3.05.08 as a Prohibited Exotic Vegetation. In keeping with the requirements of this section, staff requested that these trees be removed; and WHEREAS, Mr. Tierney objected to their removal, noting that in his opinion these Java plums fell within the purview of Specimen Trees as defined in the Prohibited Exotic Vegetation Ordinance, and on May 27th took the issue to the Board of County Commissioners on Public Petition; and WHEREAS, on this date this matter has come back to the Board for Public Hearing, with further documentation set forth in the record in support of this Petition. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that based on the review of all testimony and evidence presented in this matter, the Board of County Commissioners hereby finds that the Java plums located at 549 Myrtle Road, Naples, Florida, meet the criteria of Specimen Trees as set forth in LDC Section 3.05.09.
