Backup Documents 06/10/2014 Item # 7 4• 10 k 1 ( 7CC-R 9-2vry).. 00nCtId t ors' Tz Preserve Our Paradise, Inc. 3307 Twilight Lane, #5003 Naples, Florida 34109 http://preserveourparadise.org Board of County Commissioners Collier County Naples, Florida 7 June 2014 Dear Commissioners, It has come to our attention that in the 10 June 2014 Board Meeting, Commissioner Henning will propose, on the advice of now-former FDEP Deputy Secretary Littlejohn, that the Board reconsider its instruction to the County Attorney concerning the Collier-Hogan 20- 3H" oil well (FDEP Permit 1349H) near the Orangetree neighborhood. Preserve Our Paradise ("Paradise") believes the residents of Collier County would be ill- served if the Board were to follow Mr. Littlejohn's advice, for all the reasons set forth by Jennifer Hecker of the Conservancy of Southwest Florida in her letter of 6 June 2014, and for the additional reasons and considerations below. Even to hold a special Board meeting risks losing critical opportunities to protect the public through timely actions in the Florida courts and the federal regulatory system. 1. Public water monitoring. The existing consent order between Hughes and the FDEP explicitly allows Hughes to keep the results of its water quality monitoring confidential, as a trade secret. We believe all water quality monitoring results should be public. 2. Public Records in re the Orangetree oil well. As Ms. Hecker noted, the FDEP has released very little information concerning the Orangetree oil well, and what information it has released has often been disingenuous. Specifically, a. On December 27 Paradise was informed that an oil drilling convoy was headed from Louisiana to Naples along I-10 and I-75. The convoy could only have been headed for the Orangetree oil well. b. Unable to obtain information from the FDEP about what was going on at the Orangetree oil well, Paradise filed a formal Public Records Request under Florida Sunshine law on April 2, 2014. 1 7 c. Only after Paradise filed, did the FDEP (a) finalize its consent order with Hughes on April 8 and (b) publicly acknowledge that an "unauthorized activity" had occurred at the Orangetree oil well. d. Paradise did not receive knowledge of (2c) through its Public Record Request, but only learned this information through the press. When no further information was forthcoming in response to our request, Paradise filed a circuit court action to compel the FDEP to comply with Paradise's PRR on April 22. e. It took over one month for the FDEP to release substantive public information to Paradise, in the form of photographs taken at the Orangetree oil well on December 30, 2013 through January 1, 2014, the days of the "unauthorized activity". Beyond these photographs, Paradise has still only received one one-line agenda item citing "Collier-Hogan". Otherwise the FDEP has not yet responded to Paradise's PRR with any records of agency phone calls or internal emails pertaining to the "unauthorized activity". f. The Orangetree oil well was hydraulically fractured. The photographs released by the FDEP (Exhibit 1) show that (a) the "unauthorized activity" can plainly be categorized as "hydraulic fracturing". Almost all of the multiple chemical labels photographed by the truckload at the Orangetree oil well site are listed in the Arkansas Master Fracturing Chemicals List and other public listings. g. The FDEP authorized fracking at the Orangetree oil well. The FDEP either took these photographs itself, or had these photographs in its possession as the "unauthorized activity" was being conducted. The FDEP therefore clearly knew what chemicals were being used and how they were being used before and while the operation was being conducted. If the FDEP had wanted to stop ("unauthorize") the operation, they could have sent in the State Police. h. Nevertheless, the FDEP continued to refuse to characterize the "unauthorized activity" as "fracking". The FDEP represented to the Big Cypress Swamp Advisory Committee in the Committee's March 11 meeting that fracking was illegal under Florida law, with the clear implication fracking had not and would not be performed in Southwest Florida or, specifically, at the Golden Gate well ("Collier 22-3H", FDEP Permit 1353H). i. The FDEP also failed to report Hughes' fine and violation to Judge D. R. Alexander as he heard Paradise's petition to revoke the Golden Gate exploratory well permit, even though such disclosure is required under Florida law. 3. Persist with DOAH Petition. In light of these considerations and the considerations already cited in Ms. Hecker's letter, Preserve Our Paradise recommends and requests that a. the Board reaffirm its decision to petition to modify or vacate the FDEP-Hughes consent order concerning the Orangetree oil well, and b. the Board petition to suspend further operations at the Orangetree oil well until the safety of the public's water is confirmed by independent testing, and 2 7 4 . c. that the Board join PoP's Public Records Request and circuit court action demanding full public disclosure of FDEP communications and actions concerning recent events at the Orangetree oil well. 4. Notify the EPA. PoP further recommends and requests a. that the Board write Fred McManus,Chief,Ground Water and UIC Section,Safe Drinking Water Branch,Water Protection Division, U.S. Environmental Protection Agency, Region 4, 61 Forsyth Street,S.W.,Atlanta, Georgia 30303-8960, informing Mr. McManus of Collier County's concern over the evident and surreptitious hydraulic fracturing incident at the Orangetree oil well, and of the presence of unplugged wells near the Orangetree injection well that the EPA and the FDEP permitted, and b. that the Board express concern to Mr. McManus over its pending permit for a Class II injection well at the Golden Gate well site, and c. that the Board, given the presence of many old and unplugged wells in Collier County, the karstic nature of Southwest Florida geology, and concern for the endangered species in our natural habitats, ask Mr. McManus to ask the EPA to prepare an Environmental Impact Statement evaluating these and associated concerns, and d. that the Board also communicate the concerns and requests in 4a-c to Collier County's elected federal representatives. 5. Petition against the Golden Gate well. PoP further recommends and requests that, in light of the preceding, the Board join PoP in filing exceptions to Judge D. R. Alexander's recent decision to permit the Golden Gate exploratory well. CONSENT ORDER ON OIL EXPLORATION BY DAN A. HUGHES COMPANY (Naples,Fla.)—At Tuesday's Board of County Commission(BCC)meeting, Commissioners decided to move forward with challenging the Florida Department of Environmental Protection's(FDEP)Consent Order with a Texas-based company exploring oil drilling in Collier County. Chairman Tom Henning placed an agenda item on the June 10,2014 agenda to reconsider the BCC's earlier May 13 decision to challenge the Consent Order between FDEP and Texas-based Dan A.Hughes Company due to a lack of communication with the Board of County Commissioners. Dan A. Hughes is exploring for oil on Barron Collier lands at the Collier-Hogan Well. Chairman Henning said if the Commission had decided at Tuesday's meeting to reconsider challenging the FDEP Consent Order it would have established a means of communication,allowed for review of FDEP information and allowed the County to vet potential misinformation that has been circulating throughout the community. On May 28, Chairman Henning met with the then FDEP Deputy Secretary Jeff Littlejohn who agreed to have FDEP officials meet with the Board of County Commissioners. Subsequently, Littlejohn resigned from his position with FDEP on June 6, and FDEP appointed Cliff Wilson as Deputy Secretary. Wilson spoke with Chairman Henning on June 9 advising that FDEP did not wish to participate in a public BCC Oil Exploration Workshop which the Chairman had requested to allow for FDEP to answer Collier County Commissioners' concerns in a public forum. "After meeting with Mr. Littlejohn I felt FDEP was on the right track to meet with us and address our concerns,but the newly appointed Deputy Secretary has made it clear FDEP officials do not in fact wish to participate in an open forum and prefers private meetings in Tallahassee where Collier County residents would not be able to participate. This goes against everything all of us on the Board of County Commissioners stand for and that is an open public dialogue to learn what needs to be learned and take action where it needs to be taken,"said Chairman Tom Henning, District 3. Without the commitment from FDEP to participate in an oil workshop with the BCC on June 17 as proposed by the County,the filing deadline to challenge the Consent Order which is June 13,warrants the BCC to instead move forward with challenging the FDEP Consent Order. HUGHES OIL TALLAHASSEE - Today, the Collier County Commission made the unfortunate decision to move forward with challenging DEP's Consent Order with the Dan A. Hughes Company, L.P.,jeopardizing the department's enforcement action against the company. On May 28, the Florida Department of Environmental Protection traveled to Naples to meet individually with several Collier County commissioners to discuss the Commission's May 13, 2014, vote to challenge the Consent Order entered into between the Department of Environmental Protection (DEP) and Dan A. Hughes, L.P., and to answer any questions they may have. The Commission's decision to challenge the Consent Order is based on incorrect and incomplete information. Should the County choose to follow through with its challenge, this would cause the Consent Order to be suspended for the duration of the judicial review, effectively removing any obligations on Hughes contained in the Consent Order .° until the conclusion of litigation. Most importantly, it would remove the mechanism currently in place for DEP to require Hughes to perform the additional groundwater monitoring and investigations, depriving the public of the important information the study will yield, including discussion of any impacts that may have occurred to z, groundwater resources. Additionally, it must be recognized that it is the Consent Order, not the permit itself, that is legally challengeable at this time. Should the County decide to continue with its challenge and prevail, the Consent Order will be vacated, but the permit will remain in place. When DEP became aware the workover procedure by the company had commenced without approval, in December 2013 a Cease and Desist Order was immediately i 7 ''' first and foremost ensuring no environmental impacts to the groundwater resources in Collier County had occurred. DEP worked diligently for more than three months to finalize and secure a legally enforceable instrument that not only assessed the maximum civil penalties allowable under law, but also compelled the company to pay a third-party independent expert to perform the groundwater monitoring and investigations needed to ensure no harm to groundwater resources had resulted from the company's workover operations. The department continues to urge the Commission to reconsider its decision.
