DATE OF HEARING: September 10, 2015. STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant and the recommendation of staff, the Hearing Examiner finds that each of the criteria set forth in Section 9.04.03 of the Land Development Code has been met and the petition is approved. ANALYSIS: The applicant provided letters of support from the neighborhood Community Association and an adjacent neighbor. This request involves an encroachment upon an existing 10 foot public utility easement; the applicant provided letters of no objection from the applicable utilities. This request is two -fold: first, to establish that the existing original pool cage would be allowed to be rebuilt in its previously approved location within the rear setback; and second, to allow the proposed expansion of the pool cage to continue uniformly across the rear of the principle structure within the rear setback. The pool cage expansion will not encroach further into the easement than the existing pool cage. The entire length of the rear yard abuts an existing conservation easement. The existing conservation easement provides a mitigating element to this request and further supports the applicant's contention that there are no negative view impacts to adjoining properties. The planned unit development (PUD) document governing this property, Ordinance 88 -25, the Sleepy Hollow PUD, allows principle structures under certain criteria to attain a zero foot rear yard setback, yet accessory structures are required to have a ten foot rear yard setback regardless of the circumstances. This request allows a closer alignment between the required setback standards and that which is needed to accommodate the replacement pool cage.
