RIGHT OF ENTRY
KNOW ALL MEN BY THESE PRESENTS that THE CLUB PELICAN BAY, INC., a Florida not-for-
profit corporation, whose post office address is 707 Gulf Park Drive, Naples, Florida 34108
hereinafter known as "Grantor", for and in consideration of Ten Dollars ($10.00) and other
valuable consideration to them in hand paid, does hereby grant unto COLLIER COUNTY, a
political subdivision of the State of Florida, and the BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS THE
EX-OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT, whose post
office address is 3335 Tamiami Trail East, Suite 101, Naples, Florida 34112, its successors. assigns,
agents,or contractors hereinafter known as"Grantee",the temporary license and right to enter
upon the lands of the Grantor. as identified in the red area shown on the attached Exhibit "A",
which is attached hereto and made a part hereof, to place or remove wastewater and/or
electrical utility infrastructure, or fiber, including fencing and other equipment appurtenant
thereto for the purpose of rehabbing MPS 109 of the wastewater system.
(Wherever used herein the terms "Grantor" and "Grantee"include all the parties to this
instrument and their respective heirs, legal representatives. successors or assigns. regardless of
the number and gender in which used,shall be deemed to include any other gender or number
as the context or the use thereof may require.)
ALL RIGHT AND PRIVILEGE herein granted shall remain in full force and effect for a period
of one (1) year from the completion of the work pertaining to rehab of MPS 109 of the
wastewater system, including fencing and other equipment appurtenant thereto, on the lands
of the Grantor described in Exhibit"A". This Right of Entry shall have full force and effect until the
expiration of the contractor warranty for the construction relating to this project is completed,
including,but not limited to final inspections,acceptance and payment of the contractor,
ADDITIONALLY, the rights and interest granted hereunder are conditioned upon the
reasonable exercise thereof by Grantee. Grantee agrees not to unreasonably interfere with
Grantor's use of the lands described in Exhibit"A",and agrees to provide Grantor with advance
notice and in accordance with an agreed upon construction schedule when exercising its rights
hereunder. Grantee further agrees that it shall, at the Grantee's cost, repair any surface
damage caused to Grantor's property as a result of Grantee's exercise of its rights hereunder.
