HEX Final Decision 2015-26 HEX NO. 2015—26 HEARING EXAMINER DECISION PETITION NO. BD-PL20140002838 — Randy Sears requests a 22-foot boat dock extension over the maximum 20 feet limit in Section 5.03.06 of the Collier County Land Development Code for a total protrusion of 42 feet to accommodate a new dock facility with two boats, for the benefit of Isles of Capri Unit 2 Lot 189, also described as 164 Pago Pago Drive W., in Section 32, Township 51 South, Range 26 East, Collier County, Florida. DATE OF HEARING: June 25, 2015 STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant and the recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section 5.03.06 of the Land Development Code has been met and the petition should be approved. ANALYSIS: No members of the public were in attendance. One letter of objection was received expressing concern that approval would set a precedent, would negatively impact property values and that usage of two boats would negatively impact dolphins and manatees. No documentation was supplied supporting these concerns. The applicant supplied information indicating that other docks in the area are of similar configuration and staff confirmed that the Land Development Code allows no more than 2 vessels per single family home. DECISION: The Hearing Examiner hereby approves Petition No. BD-20140002838, filed by Kris W. Thoemke of Coastal Engineering Consultants, Inc., representing Randy Sears, for a 22-foot boat dock extension over the maximum 20 feet allowed by the Land Development Code for a total protrusion of 42 feet to accommodate a docking facility for two boats on the property described herein, in accordance with the Proposed Dock Plan attached as Exhibit"A", and as subject to the condition(s) set forth below. ATTACHMENTS: Exhibit A—Proposed Dock Plan LEGAL DESCRIPTION: Lot 189, Isles of Capri No. 2, a subdivision according to the Plat thereof recorded at Plat Book 3, Page 46, in the Public Records of Collier County, Florida. [15-CPS-01407/1190340/1]22 1 of 2 CONDITIONS: Construction of the boat dock improvements shall not commence until approval of single family residence building permit number PRBD2015051446001. The boat dock shall not receive final approval until a Certificate of Occupancy (CO) is issued for the single family residence. APPEALS: This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as amended, a Hearing Examiner Decision may be appealed to the Board of County Commissioners or the Board of Zoning Appeals, as appropriate.
