DEPARTMENT OP NATURAL RESOURCES, STATE OP FLORIDA TO ESTABLISH . $
. CERTAIN AREAS WITHIN THE NAVIGABLE WATERWAYS OP COLLIER COUNTY, -.,
FLORIDA, AS RESTRICTED ZONES FOR T1113 PURPOSE OF REGULATING BOAT ,
. SPEEDS AND WAKES IN SUCH AREAS.
WHEREAS, the Board of County Commissioners of Collier County, Florida,
has passed Ordinance 79-8, the Collier County Vessel Control Ordinance, for the
. purpose of promoting safety in the operation of vessels on waterways within
Collier County, and to prevent injuries or property damage caused by the negligent •
• . , operation of such vessels; and •
WHEREAS, said Ordinance provides that the Board of County Commissioners'
may, by Resolution, adopt at public hearing upon at least fifteen (15) days notice'
, of such hearing published in a newspaper of general circulation in Collier County,
. • Florida, designated areas as "No Wake-Idle Speed" zones; and
• WHEREAS, in an effort to reduce boat and property damage resulting from
. excessive boat wakes, it is deemed advisable that certain navigable waterways and 1
heavily traveled channels be designated as restricted areas for the purpose of
. placing such regulatory markers therein; and 1

WHEREAS, the required advertisement has been accomplished; and
. .`• WHEREAS, upon the establishment of the restricted areas by the Division
of Marine Resources of the Department of Nntf.ral Resources, the Board c' County
. Commissioners of Collier County will accept responsibility for placement and --
' maintenance of regulatory markers.
.
NOW, THEREFORE, be it resolved by the Board of County.Commissioners of
Collier County, Florida that:
1. The areas described as the following, and ns shown on maps
' (reproduction of sections of U.S. Department of Commerce,
• Nautical Chart 11430) attached hereto and marked Exhibits
1,2,3, G 4, are designated as restricted areas within Collier • (
County for the purpose of placing "No Wake-Idle Speed" }
markers thereon, such areas being namely;
• a. Area "G" (Henderson Creek) One (1) piling in the vicinity
• of SR-951 bridge to support two (2) signs. One (1) sign
' • advising those entering the "Idle Speed-No Wako" zone and ''
one (1) sign advising boaters leaving the zone to "Resume •
. Normal-Safe Operation". One piling with two (2) "Idle
Speed-No Wake" signs located Northwest of the Henderson
Drivo Culf-De-Sac.
. • . . b. Area "H" (Bimini Waterway) One (1) piling with two (2) signs
• just North of the Butterfield Court Cul-De-Sac. One (1) t
sign advising "Idle Speed-No Wake" and one (1) sign to "Resume
Normal-Safe Operation". One (1) piling located North of
f • Pepperwood Court with two (2) "Idle Speed-No Wake" signs.
One (1) piling located North of Polynesia Court with two (2)

• bo and hereby is requested to establish those described areas as

markers in such areas. •
3. The County Engineer, Clifford B. Barksdale, P.E. be hereby appointed
• and authorized to act for and on behalf of Colleir County to execute
tho necessary documents to the State Department of Natural Resources
•
and any other concerned Federal and State Agencies and to negotiate
modifications and revisions, and to accept or assent to any stipulations
thereto on behalf of Collier County.

ZONES WITHIN TILL WATERWAYS OP COLLIER COUNTY.

MIEREAS, Collier County has requested tho Department of Natural }
Resources to designate certain areas within waterways of tho County as restricted
•
boating zones for the purpose of placing"No Wake-Idle Speed" markers in such
areas; and,
WHEREAS, the Department of Natural Resources has requested that the •
• .
County agree to hold the Department of Natural Resources, Division of Law •
Enforcement, harmless with regard to the placement, maintenance and operation
of said regulatory markers; •
NOW THEREFORE, WITNESSETII:
That for and in consideration of the designation of certain areas within
tho waterways of the unincorporated area of Collier County as restricted boating
'zones., the Board of County Commissioners hereby agree to hold the Department of
Natural Resources, Division of Law Enforcement, harmless with respect to any
• claim or claims arising out.of any alleged negligence in the placement, maintenance
• •
or operation of approved regulatory markers.
IN WITNESS WHEREOF, the Board of County Commissioners has caused this
