The only item on the agenda today is the advertised public hearing,Petitioner Number VA-PL20120002648,Branislav Vukovic,for a variance in Naples Park. Yesterday morning I received a package that was delivered to Fred Reischl on Tuesday,containing a voluminous amount of emails, most of which were strongly not in favor of this particular variance. We had received a few other emails prior to that, some for, some against, but as a result of that quantity of emails I requested that this petition be moved to the standard procedure through the Planning Commission and the Board of County Commissioners. And that's the route it is going to retake. There are no members of the public here today,and I asked yesterday for Fred to please contact those numbers of emails that had sent in. Fred,could you tell us approximately how many emails you sent out and responses? MR.REISCHL: I sent approximately 60 emails to various interested parties,and I got two responses saying thank you,but--and also three emails were bumped back as not deliverable. HEARING EXAMINER STRAIN: Okay. So it looks like everybody that was concerned that had sent an email probably got an email in some form from you to the best of your ability. MR. GEOGRAPHIC LOCATION: The subject site is located at 164 Pago Pago Drive West, Isles of Capri Subdivision, Unit 2. (see location map on the following page) PURPOSE/DESCRIPTION OF PROJECT: The petitioner is proposing to construct a dock facility that includes two new boat lifts for two vessels, one that is 36 foot in length and one that is 21 foot in length. The proposed dock facility will protrude approximately 42-feet from a proposed seawall currently under construction. Staff notes that there is no principal use structure on this parcel; however the property owner has an active building permit to construct a single family residence, specifically with building permit PRBD2015051446001 currently under review. The proposed boat dock lifts will service 2 vessels that will result in a total protrusion according to the application of 42 feet into the water body and is located on a single family residential lot that has approximately 70 feet of water frontage. As noted above the proposed new boat lifts and vessels will have a total protrusion of 42 feet from the outside edge of the new seawall (which for clarification will also effectively be 42 feet from the MHWL). Section 5.03.06(E)(11) (Manatee Protection) of the Collier County Land Development Code (LDC) is applicable to all multi-slip docking facilities with ten (10) or BDE-PL20140002838, Page 3 of 8 Sears-164 Pago Pago,Boat Dock Extension. HEX Hearing June 11,2015 Report date:June 3,2015(revised:6-10-15) more slips. The proposed facility consists of two boat slips and is therefore not subject to the provisions of this section. STAFF COMMENTS: The Collier County Hearing Examiner (HEX) shall approve, approve with conditions, or deny, a dock facility extension request based on the following criteria. In order for the HEX to approve this request, it must be determined that at least four of the five primary criteria and four of the six secondary criteria have been met. Staff has reviewed this petition in accordance with Section 5.03.06 and finds the following: Primary Criteria 1. Whether the number of dock facilities and/or boat slips proposed is appropriate in relation to the waterfront length, location, upland land use and zoning of the subject property. Consideration should be made of property on unbridged barrier islands, where vessels are the primary means of transportation to and from the property. (The number should be appropriate; typical single-family use should be no more than two slips; typical multi-family use should be one slip per dwelling unit; in the case of unbridged barrier island docks,additional slips may be appropriate.) Criterion met. The proposed dock facility will consist of two boat lifts to accommodate two vessels. The proposed boat lifts and vessels will result in two slips which is consistent with the allowed 2-slip provisions. 2. Whether the water depth at the proposed site is so shallow that a vessel of the general length, type and draft as that described in the petitioner's application is unable to launch or moor at mean low tide (MLT). (The petitioner's application and survey should establish that the water depth is too shallow to allow launching and mooring of the vessel(s)described without an extension.) Criterion met. According to the petitioner's application the water depth in this area of Marlin Bay is shallow. However the current rip rap edge will be removed and a new seawall replacement constructed. The new seawall will upon completion have the result in providing more adequate water depths. In staff's opinion consideration of the rip rap edge and shallow water depth should remain or be taken into account as the new seawall construction while not part of this request is at least associated with the overall dock facility proposed. While an argument can be made that water depth will no longer be an issue for the parcel this will only be true because of the new seawall which as noted is being constructed at least partly due to the new dock facility. For this reason staff finds it more reasonable to find that this criterion is met. 3. Whether the proposed dock facility may have an adverse impact on navigation within an adjacent marked or charted navigable channel. HEX Hearing June 11,2015 Report date:June 3,2015(revised:6-10-15) not intrude into any marked or charted navigable channel thus impeding vessel traffic in the channel.) Criterion met. According to the information submitted by the petitioner, the proposed dock facility will not adversely impact navigation on Marlin Bay or other docks in the neighboring area which are for the most part comparable in length. 4. Whether the proposed dock facility protrudes no more than 25 percent of the width of the waterway, and whether a minimum of 50 percent of the waterway width between dock facilities on either side is maintained for navigability. (The facility should maintain the required percentages.) Criterion met. The information provided in the application indicates that the proposed dock will protrude 42 feet into a waterway that is approximately 270 feet in width. Therefore the dock facility will protrude approximately 15.5 percent of the waterway width which means that it meets this criterion. 5. Whether the proposed location and design of the dock facility is such that the facility would not interfere with the use of neighboring docks. (The facility should not interfere with the use of legally permitted neighboring docks.) Criterion met. As shown in the drawings submitted by the petitioner and noted in the application the facility has been designed to not interfere with neighboring dock facilities. Specifically the design was selected to avoid conflicts for the proposed 36-foot vessel and the existing dock to the northeast and/or a possible future dock facility to the southwest. Secondary Criteria 1. Whether there are special conditions not involving water depth, related to the subject property or waterway, which justify the proposed dimensions and location of the proposed dock facility. (There must be at least one special condition related to the property; these may include type of shoreline reinforcement, shoreline configuration,mangrove growth, or seagrass beds.) Criterion met. As noted in the application by the petitioner the boat length dictated the proposed dock facility length. It is however staff's opinion that the special condition related to the subject property that justify the proposed petition is the relative narrowness of the subject parcel. The narrowness of the parcel in combination with the proposed vessel length more directly impacts the proposed dock configuration. For this reason it is staffs opinion that this criterion is met. 2. Whether the proposed dock facility would allow reasonable, safe access to the vessel for loading/unloading and routine maintenance, without the use of excessive deck area not directly related to these functions. There is also an additional decking area provided in front of the shorter slip which in staff's opinion is reasonable, with the proposed dock facility providing access for safe loading/unloading/routine maintenance without overly excessive decking area(s). 3. For single-family dock facilities, whether the length of the vessel, or vessels in combination, described by the petitioner, exceeds 50 percent of the subject property's linear waterfront footage. (The applicable maximum percentage should be maintained.) Criterion not met. The subject property contains a linear waterfront that is approximately 70 feet in length according to the application. The total length of the proposed vessels is 57 feet which is more than 50 percent of the waterfront footage therefore this criterion is not met. 4. Whether the proposed facility would have a major impact on the waterfront view of neighboring property owners. (The facility should not have a major impact on the view of a neighboring property owner.) Criterion met. The proposed dock facility meets the required 15 foot setback from riparian lines and should not have major impact on the waterfront views of neighboring property owners. Additionally the proposed dock facility will generally be consistent with other neighboring dock facilities in the area. 5. Whether seagrass beds will be impacted by the proposed dock facility. (If seagrass beds are present, compliance with subsection 5.03.06(I) of the LDC must be demonstrated.) Criterion met. According to the information submitted by the petitioner no seagrass beds are known to be located within 200 feet of the proposed dock facility or within this portion of the waterway. Therefore,there will be no impact to seagrass beds. 6. Whether the proposed dock facility is subject to the manatee protection requirements of subsection 5.03.06(E)(11) of this Code. (If applicable, compliance with section 5.03.06(E)(I1)must be demonstrated.) Criterion not applicable. The proposed total dock facility consists of two boat lift/slip and is therefore not subject to the provisions of this section. Staff analysis indicates that the request meets five of the five primary criteria. With regard to the six secondary criteria one of the criterion is not met and one criterion is found to be not applicable,therefore the request meets four of the remaining five secondary criteria. Such appeal shall be filed with the Growth Management Division Administrator within 30 days of the action by the Hearing Examiner. In the event that the petition has been approved by the Hearing Examiner, the applicant shall be advised that he/she proceeds with construction at his/her own risk during this 30-day period. COUNTY ATTORNEY OFFICE REVIEW: The County Attorney Office has reviewed the staff report dated June 3, 2015 for BD- PL20140002838. After submission of the completed application packet, accompanied with the required fees,the applicant will receive a response notifying that the petition is being processed. Accompanying that response will be a receipt for the payment and the tracking number (i.e., BDE- PL20120000000) assigned to the petition. This petition tracking number should be noted on all future correspondence regarding the petition. Pursuant to the LDC and the Administrative Code, several public notice requirements shall be completed within the required time frames. In order for the Hearing Examiner to approve the request, it must be determined that at least 4 of the 5 primary criteria, and at least 4 of the 6 secondary criteria, must be met. On separate sheets, please provide a narrative response to the listed criteria and/or questions. 1. Whether or not the number of dock facilities and/or boat slips proposed is appropriate in relation to the waterfront length, location, upland land use, and zoning of the subject property; consideration should be made of property on unbridged barrier Islands, where vessels are the primary means of transportation to and from the property. (The number should be appropriate;typical,single-family use should be no more than two slips;typical multi-family use should be one slip per dwelling unit; in the case of unbridged barrier island docks,additional slips may be appropriate.) 2. Whether or not the water depth at the proposed site is so shallow that a vessel of the general length,type, and draft as that described In the petitioner's application is unable to launch or moor at mean low tide(MLT). (The petitioner's application and survey should show that the water depth • is too shallow to allow launch and mooring of the vessel(s)described without an extension.) 3. Whether or not the proposed dock facility may have an adverse impact on navigation within an adjacent marked or charted navigable channel. (The facility should not intrude into any marked or charted navigable channel thus impeding vessel traffic in the channel.) 4. Whether or not the proposed dock facility protrudes no more than 25 percent of the width of the waterway, and whether or not a minimum of 50 percent of the waterway width between dock facilities on either side of the waterway is maintained for navigability. (The facility should maintain the required percentages.) 5. Whether or not the proposed location and design of the dock facility is such that the facility would not interfere with the use of neighboring docks. (The facility should not interfere with the use of legally permitted neighboring docks.) • 6/3/2014 Page 4 of 7 PRIMARY CRITERIA 1. (The petitioner's application and survey should show that the water depth is too shallow to allow launch and mooring of the vessel (s) described without an extension) Due to the existing water depths and plans to remove the rip rap and install a seawall, water depth is not an issue for the boats that will use this docking facility (Attachment 2). 3. Whether or not the proposed dock facility may have an adverse impact on navigation within an adjacent marked or charted navigable channel. (The facility should not intrude into any marked or charted navigable channel thus impeding vessel traffic in the channel) • No marked or charted navigable channel exists in the project area or man-made basin. 4. Whether or not the proposed dock facility protrudes no more than 25 percent of the width of the waterway, and whether or not a minimum of 50 percent of the waterway width between dock facilities on either side of the waterway is maintained for navigability. (The facility should maintain the required percentages). Approximate waterway width is 270 feet, 25% of which is 67.5 feet. The proposed docking facility extends 42 feet into waterway (approximately 15.5%), On the other side of embaymemt there is a dock extending approximately 20 feet into the waterway. This leaves approximately 208 feet (77%) of waterway for navigability. 5. Whether or not the proposed location and design of the dock facility is such that the facility would not interfere with the use of neighboring docks. (The facility should not interfere with the use of legally permitted neighboring docks) The !imposed docking facility is designed so that it will not interfere with neighboring docks. Whether the proposed dock facility would allow reasonable, safe, access to the vessel for loading/unloading and routine maintenance, without the use of excessive deck area not directly related to these functions.(The facility should not use excessive deck area.) 3. For single-family dock facilities, whether or not the length of the vessel, or vessels in combination, described by the petitioner exceeds 50 percent of the subject property's linear waterfront footage. (The applicable maximum percentage should be maintained.) 4. Whether or not the proposed facility would have a major impact on the waterfront view of neighboring waterfront property owners. (The facility should not have a major impact on the view of either property owner.) • 5. Whether or not seagrass beds are located within 200 feet of the proposed dock facility. Whether or not there are special conditions, not involving water depth, related to the subject property or waterway, which justify the proposed dimensions and location of the proposed dock facility. (There must be at least one special condition related to the property; these may include type of shoreline reinforcement, shoreline configuration, mangrove growth, or seagrass beds) Dock length is dictated by the length of the boat using the dock. As configured, a 36 foot boat on a boat lift requires a dock that extends more than 20 feet into the waterway in order to provide dockage. 2. Whether the proposed dock facility would allow reasonable, safe, access to the vessel for loading/unloading and routine maintenance, without the use of excessive deck area not directly related to these functions. (The facility should not use excessive deck area) The dock is designed and configured to provide safe access to the two vessels that will be using the structure. 3. For single-family dock facilities, whether or not the length of the vessel or vessels in combination, described by the petitioner exceeds 50 percent of the subject property's linear waterfront footage. (The applicable maximum percentage should be maintained) Combined, the two vessels are 57 feet. The lot is 70 feet wide and thus the combined length exceeds 50% of the subject property's linear waterfront footage. 4. Whether or not the proposed facility would have a major impact on the waterfront view of neighboring waterfront property owners. (The facility should not have a major impact on the view of either property owner.) The proposed dock has 15-foot setbacks from the adjacent properties and will not impact the view of neighboring waterfront property owners. 5. The proposed docking facility is located at 164 W. Pago Pago Dr. The dock will be constructed in a man-made basin(Attachment 1). OBJECTIVE Coastal Engineering Consultants,Inc. (CEC)conducted a topographic and natural resources survey on June 24,2014 to assess if there are seagrasses or other important resources present in the project area and vicinity. METHODS CEC reviewed the aerial photography of survey area and established an area to be surveyed that extends 100 feet on either side of the proposed dock. The area was visually surveyed by divers for the presence of seagrass and other resources. Bathymetric data were also collected. • RESULTS No seagrass or other submerged resources were observed. The submerged bottom consists of unconsolidated fine sand. The shoreline consists of rock rip rap(Attachment 2). Water depth increases as you move waterward from the rip rap and reaches depths(approx. five feet)in which seagrass is not, in our experience,typically found in areas such as this. CONCLUSION As no seagrass or other epibenthic resources were observed in the study area,we do not expect any negative impacts to result for construction of this docking facility. The GMP does not address individual Variance requests but focuses on the larger issue of the actual use. The Carillon PUD is consistent with the Future Land Use Map. Based upon the above analysis, staff concludes that the proposed use for the subject site is consistent with the Future Land Use Element, although the Sign Variance request is not specifically addressed. ANALYSIS: The decision to grant a sign variance is based on the criteria of LDC Section 5.06.08.B. Staff has analyzed this petition relative to the evaluative criteria and offers the following responses: a. That special conditions and circumstances exist which are peculiar to the land, structure or building involved and which are not applicable to other lands,structures or buildings in the same district. There are no special conditions. b. That literal interpretation of the provisions of the sign code would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district and would work unnecessary and undue hardship on the applicant. The literal interpretation of the provisions of the sign code would not deprive the applicant of the rights commonly enjoyed by other properties in the same zoning district and cause unnecessary and undue hardship on the applicant. However, if a literal interpretation of the LDC provision is applied, then the applicant will not be able to have additional building wall signage. A Variance by definition confers some dimensional relief from the zoning regulations specific to a site. The granting of the Sign Variance request would allow for an additional wall sign on the building façade. This sign variance confers a special privilege on the applicant. e. That the variance granted is the minimum relief that will make possible the reasonable use of the land, building or structure. Yes. The purpose of the requested Sign Variance is to allow for an additional wall sign that is otherwise not permissible by the Sign Code. The additional signage granted by the proposed sign variance would aid patrons in identifying the business. If the Condition of Approval recommended by Staff is followed, the reasonable use of land is possible. f. That the granting of the variance will be consistent with the general intent and purpose of the Collier County Sign Code and the Growth Management Plan, and will not be injurious to adjacent properties or otherwise detrimental to the public welfare. Section 5.06.O1.A. of the LDC states that the purpose and intent of the LDC relative to signage is to ensure that all signs: 1. Lessen hazards to pedestrians and vehicular traffic; 2. Preserve property values; 3. Prevent unsightly and detrimental signs that detract from the aesthetic appeal of the county and lead to economic decline and blight; 4. Prevent signs from reaching such excessive size and numbers that they obscure one another to the detriment of the county; 5. Assure good and attractive design that will strengthen the county's appearance and economic base; 6. Preserve the right of free speech and expression in the display of signs.
