McAnly and Associates, P.A., is a request for provisional use "g" of the C-4 zoning district for a used car lot for property located on the north side of East Tamiami Trail -approximately 200 feet west of Shadowlawn Drive in Section 11, Township 50 South, Range 25 East, East Naples, consisting of approxi- mately 1/2 acre. He said this petition was before the Board on 6/12/90 and at that time, the Public Works Administrator noted that one of the traffic stipulations required revision. He advised that the Board chose to continue the petition until today to allow staff sufficient time to address that issue. He Indicated as a result of a meeting with the petitioner, staff recommends that Stipulation "c" of the agreement sheet, which has been approved by the CCPC, be revised as follows: The Petitioner shall dedicate 15 feet of U.S. 41 frontage for future roadway improvements within 30 days from written request from the County with the following three (3) con- ditions to apply to the applicable subsequent easement docu- ment: Road dedication by easement. Setback to be measured from the fee simple property line for existing structures. Existing principal structure and existing accessory structure are non-conforming land uses pursuant to Policy 5.9 of the Future Land Use Element of the Collier County Growth Management Plan. Mr. Scheff reported subsequent to the preparation of this report, has been noted an additional two stipulations need to be addressed. He stated the owner of the property is required to sub- mit a letter approving this use on his property. Commissioner Hasse asked how many cars will be stored on this ::i, site? Page 4 August 7, 1990 ~ ' Mr. Scheff replied there will be a maximum of 8 cars. He said st~ff ~s recommending there be 7 regular parking spaces and 1 handicap ; space, with the remaining 8 spaces allowed for storage of the cars on .display. In answer to Commissioner Hasse, Mr. Scheff stated it is the intent of the petitioner to display classic and exotic cars. He noted that this PU is for used car sales which allows the petitioner to sell ' any type of used cars. Dwight Nadeau with William G. McAnly and Associates, P.A., repre- ~/~senting the petitioner, stated those automobiles placed on the lot for ~%u~ service will be located to the rear of the building. He said exotic and classic automobiles will be displayed ~n the front of the building for greater exposure on U.S. 41. Page 5 August 7, 1990 TO CONTROL ACCESS ON JANES SCENIC DRIVE BETWEEN DAWN AND DUSK - Transportation Services Administrator Archibald stated this is a request by Staff to gain Board approval of a plan to control access on Janes Scenic Drive between dusk and dawn consistent with the require- ments of the Florida Department of Natural Resources (FDNR). He said this portion of Janes Scenic Drive involves a limerock road that extends northward from the Lee Cypress/Copeland area approximately 10 miles to Stewart Boulevard in Golden Gate Estates. He advised the roadway goes through the Fakahatchee Strand State Preserve in which FDNR is both controlling access into the area and has plans to develop it into a preserve to protect animals and habitat existing in that area. He said the County approved the installation of gates all along Janes Scenic Drive in 1988. He stated that is worked out through a key system, where residents can apply and obtain keys to gain access from Janes Scenic Drive to the adjacent properties. He informed this request is an action to further control access, based upon discussions between Staff and FDNR and involves the installation of gates at both ends of Janes Scenic Drive. He advised the con- ditions under which the gates can be installed and not be a deterrent toward normal every day traffic are as follows: 1) permit the gates ~i ~ to be installed under Ordinance 82-91, which keeps in the County the authority to regulate use; 2) gates will only be closed from dusk to .dawn; 3) a key system be implemented for property owners having a need to use Janes Scenic Drive between dusk and dawn. He said Staff recognizes there may be a larger number of people who use this road than thdse who live in that area, possibility necessitating use by approximately a dozen people at night. ,:':.,,; Commissioner Hasse asked why people who do not live in that area will need access to Janes Scenic Drive at night? Mr. Archibald replied residents who live in Golden Gate Estates ,,:south of Alligator Alley use this road as access to U.S. 41. He said Page August 7, 1990 there is a very small number of people who need access both from a legal standpoint and for access to major roadways. He stated there ,?may be other users and Staff is recommending that the controls be con- ': sidered on the use and operation of the gate, however, before imple- i:,. mentation, allow a 30 day notice period, putting up signs and advertising in the newspaper the conditions under which a permit will be issued. He indicated letters have already been received, most of which are in support of controlling access. Mr. Dorrill advised Staff is not recommending a further public hearing. He said the benefits of closing the road after dark outweigh the minor inconvenience for those who have legal property ingress. He stated before the final closing of the road, however, Staff is recom- mending running a public notice in the newspaper. The following people spoke in favor of the proposed plan, citing the existence of endangered and threatened plants and animals; illegal poaching of plants and animals in that area; and property owners will have 24-hour access using the key system: Franklin Adams Eileen Arsenault Dr. Fran Stallings Mercedes McCallen Ken Alvarez ~ The following people spoke In opposition to the proposed plan stating the need for a public hearing at night for proper response; the inconvenience of access using a key system; and the possibility of emergency situations occurring at night: Joyce Ogden Daryl Hughes Oommissioner Saunders asked if an emergency vehicle will be able to knock down the gate if necessary? Mr. Archibald answered the gate will be substantially structured iiii:i~making it difficult to drive through it. He said the gate at the south end will be located toward residences where response can be pro- vided by simply walking around the gate. Mr. Dorrtll commented Staff has endeavored to anticipate every Page 7 August 7, 1990 contingency. He said if this plan does not work, the County still ~'~: owns the road and modifications can be made if necessary. He ~' concluded Staff is asking to run the legal advertisement and make arrangements, pending that, to resolve this issue to the satisfaction of everyone involved. Commissioner Shanahan indicated his recommendation for approval is based upon property owners having received proper notice by legal advertisement. '~d~D ~T~ AUTHORIZED TO PLACE OUT FOR COMPETITIV~ BID THE FOOD . CON--ION AT TIGERTAIL BEACH Kevin O'Donnell, Public Services Administrator, explained this is a request to terminate the contract with Blue Mountain Lake Boat 'i Livery South, Inc., authorize staff to place out for competitive bid i. the food concession at Tigertail Beach and direct the County /Attorney's office to proceed with appropriate legal recourse against Blue Mountain Lake Boat Livery South, Inc. He said on March 23, 1990, Blue Mountain Lake Boat Livery South, Inc. wrote the County and asked for release from their contract with the County which would run through December, 1990. He indicated during the subsequent period Page 8 August ?, 1990 Staff was seeking direction from the County Attorney's Office, Mountain unilaterally ceased operation on May 1st. He advised staff was prepared to recommend that the contract be mutually ter- minated upon payment to the County by Blue Mountain of concession Its for February, March and April. He said over a period of .~'several months, a satisfactory resolution has not been obtained and, therefore, Staff is asking to terminate the contract in order to acquire a new concessionaire for the beginning of the tourist season. He added Staff is requesting the Board to direct the County Attorney's Office to take appropriate legal'action. Commissioner Hasse asked if the problem cited by Blue Mountain is the beach is not conducive to people using it? Mr. O'Donnell replied the original request from Blue Mountain indicated the food concession had become a physical and financial bur- den and they wished to be released from their contract. He said they were also concerned with the overgrowth of vegetation. He advised the County responded, that there is no contractual arrangement to remove ~'~the vegetation. He informed that Staff has applied to FDNR for a :~'.vegetatton. removal permit and added as of this morning, a preliminary response from FDNR ~ndicates they will require additional information /prior to issuance of that permit. Commi~sioner Volpe commented there are two requests from Blue Mountain: one is a change in hours of operation, dated May l§th, and another request asks for permission to close the concession stand during September. He said Mr. O'Donnell granted the change in hours of operation, but denied the request to close the facility from September 11 to October 1. He asked if termination of the contract with this vendor is based upon the need to keep this concession stand .open 12 months per year? Mr. O'Donnell replied it is Staff's opinion that the stand should be kept open 12 months, but the reason to terminate the contract is that ~t is currently in effect with Blue Mountain through December, lggO. He said Blue Mountain has indicated they no longer wish to Page 9 August 7, 1990 the stand, and this housekeeping step is needed in order to acquire a new concessionaire. Mr. Les Buie, President of Blue Mountain Lake Boat Livery South, ?Inc., commented he has done his best over the past two years to pro- vide a service at Tigertail Beach. He said originally he requested an amendment to his contract for a short period of time off. He !!~iexplained over two years ago, he offered to build a chickee hut so there would be an area in the shade for people to eat. He informed he ~t[aleo recommended init~ation of parking fees because without them, it i~i.lhas been more convenient for people to drive their cars to McDonald's and return to the beach which also causes more litter. He said if the : picnic facilities were properly cared for and if he had been allowed build the chickee hut, both his business and the beach would have improved greatly. He stated he is satisfied to terminate his contract as of May 1st and pay $2,100 for the months of February, March and ~April, but asked the Board to look closely at activities taking place ~i at Tlgertail Beach. Commissioner Saunders asked Mr. Buie to state for the record what he would like to occur today. Mr. Bute responded he has asked, starting on March 23rd, to be released from his contract. He said he received a phone call on May 28th telling him that he was not released, and this was after the County had already started proceedings to replace him. Commissioner Volpe asked if the request will require the con- cessionaire to keep the operation open 12 months each year, to which ~7. Mr. O'Donnell replied in the affirmative. C~iulon~r Saunders moved, seconded by Contssioner Shanahan and 'c~rrie4 unanim~usly, to direct staff to prepare and issue an RFP for 'The conce~sion at Tigertatl Beach. ]~ESOLUTION 90-405 RE MODIFICATION TO MARCO ISLAND UTILITIES' WATER ~S~CTIONS VARIANCE - ADOPTED Water Director Michael Newman stated this is a request from Marco Island Utilities to modify their current water restriction variance based on the abundant rainfall this area has experienced, the increase in groundwater levels and the decrease in chlorides in their raw water ?/,..pit. He indicated he has reviewed the information submitted and discussed this request with the Marco Island Civic Association. He concluded based on this criteria, Staff is recommending approval of this request. Commissioner Shanahan noted this request is different from what }'!;.~the South Florida Water Management District (SFWMD) is doing in other i 'areas. He said the previous water restrictions on Marco Island were also different than the SFWMD. He added those have worked very well, and the Marco Island Civic Association is principally responsible for success. Commissioner Volpe asked if the modification will allow lawn irri- gation ? days per week between the hours of 6:00 P.M. and 6:00 A.M., to which Commissioner Shanahan replied in the affirmative, adding that is more restrictive than 5:00 P.M. to 9:00 A.M., which is being allowed by the SFWMD. Milton Leonard, President of the Marco Island Civic Association, Jtated this program has been very successful. He said the record ,should include a summary of what has happened during the past year. ?~ He informed that due to the number of complaints regarding the water Page 11 August 7, 1990 i~:restricttons of the SFWHD which were not well-suited to Marco Island, ~an ordinance was adopted on November 13, 1989, which implemented emergency waker restrictions on Marco Island. He said these restric- tions have worked out so well that water consumption decreased in the ~ftrst six months of this year by 900,000 gallons per day with almost ~'no complaints of low water pressure. He indicated the greatest bene- fit from this action is that the mechanism is in place for returning to this schedule if and when restrictions are needed again. He ~limented the Sheriff's Department, Marco Island Utilities and Marco Islanders for their cooperation in making this a very successful program. Page 12 August 7, 1990 GOLF ~STATES (MKCCQ) FORCE MAIN SEWER FACILITIES - CO~IDIT IONALLY APT~OVED Fred Bloetscher, Assistant Utilities Administrator, explained this is a routine acceptance with one minor difference. He said the contractor has filed a lien against the facilities. He advised the agreement between the County and MKCCQ states the County cannot make the final payment to them until the facilities are accepted by the Board of County Commissioners, and the Board cannot accept the facili- ,~/ ties because of the lien. He stated MKCCQ does not have the money to pay the contractor. He indicated Staff is suggesting the Board of .County Commissioners conditionally accept the facilities with the sti- pulation that a subsequent meeting be arranged between the County, the contractor and MKCCQ. At the meeting, he said, the contractor will ~/. bring a lien waiver and Staff will bring two checks made out to MKCCQ, one for the amount owed the contractor and the other for the remainder of the final payment. Gommissioner Volpe asked if this will be a proper payment under i: the mechanics lien law, to which County Attorney Cuyler replied in the affirmative. Commissioner Hasse remarked that an executive summary has not been . provided to the Board of County Commissioners for this item. Assistant to the County Manager Olliff explained this is asso- ~.' ciated with the Pocket of Poverty program, which is a grant project for low and moderate income housing in the Immokalee area. He said the first phase is Collier Village which is ready for construction with the exception of this mitigation requirement. He said there is 3 less than one acre of wetland area that needs to be mitigated, but since this is located off-site of the Collier Village phase, they are mitigating to the County an additional .8 acre of wetland area. In answer to Commissioner Saunders County Attorney Cuyler explained a time period for argument and rebuttal is set by the Board and he is recommending 10-10-5 or 15-15-5. Commissioner Volpe commented the list of pending contracts is becoming quite large. · Mr. Yonkosky replied he will provide the Board with an updated ~i;~list of everything over two months old by the end of the week. Page 15 August 7, 1990 DI$~$IOI[ P.E~A~fDING EVERGLADES BOULEVARD EXIT TO 1-75 TO REMAIN OPEN -- ~TA~T TO ~l~II~ BACK RECO~ENDATIONS AND CHAIRMAN TO WRITE LE"I'rER TO Commissioner Goodnight indicated she asked for this discussion. She said last year, she and Transportation Services Administrator Archibald brought a request to the Commission to extend one of the roads from C.R. 95! to Everglades Boulevard so residents in the area have access to C.R. 951 without having to drive from Everglades Boulevard, continue on Golden Gate Boulevard and then up C.R. 951 into Naples. She stated at that meeting there were two individuals in opposition and no one in support, and the motion failed. She reported she now has a petition with over 800 signatures from people who live in that area. ~.~ In answer to Commissioner Volpe, Commissioner Goodntght replied the road, 25th Avenue Southwest, is not on the map because it has not been completed. Transportation Services Administrator Archibald said the roadway line they were looking into last year was an extension from the south end of 23rd Avenue to Everglades Boulevard. He informed four corri- dors were identified to look into, but the funding was not available to proceed. Commissioner Hasse recalled that in the many meetings that have i'taken place on this subject, residents from both north and south of Alligator Alley were more interested in access to 1-75. He said federal and state representatives have met with Collier County on many occasions, and he feels if the County continues to pursues this issue, it can be accomplished. Mr. Archibald asserted this will be an excellent asset to the Goxxnt¥ with long-term benefits, however, will involve a series of Justification analyses and reports. He commented there may be some way to extend the efforts currently taking place for access at the !Antersection of 1-75 and Golden Gate Parkway, to cover both locations. 'At the very least, he said, it will provide some idea of a future Page 16 ~ ~ August ?, lggo .~:tmetable when an interchange may be plausible from an economic and permitting standpoint. Commissioner Shanahan asked if the alignment of 23rd Avenue with !iWhite Boulevard will continue to be pursued? Mr. Archibald replied affirmatively, adding he can bring a report back to the Board as a future agenda item. Commissioner Goodnight reported the object of bringing this sub- .Ject up today is to make the Board aware of the concern of residents in that area, and also to ask the Commission for direction in how to 'proceed with the problem. The following people spoke in favor of the request, stating that this extension will reduce more than 30 miles of travel to get to ?'>Naples, and Forest Rangers and the Sheriff's Office need quicker access to respond to fires and emergencies: Ben Spanioli Pugh Henderson M.
