Any utility/storage area may be located adjacent to its associated recreation vehicle in compliance with the setbacks provided in Section 3.4.0 of this document. The utility/storage area may be a continuous part of a screened-in porch where such a porch is attached to the vehicle as herein provided. Sleeping is prohibited in the enclosed utility/storage structure and the enclosed utility/storage, structure shall not be occupied unless an occupied recreational vehicle as described in Section 3.3.A.1 of the PUD is present on the lot; iv) the entrance to the enclosed utility/storage structure shall face the recreational vehicle as described in Section 3.3.A.1 of the PUD and the doorway to the enclosed utility/storage structure shall be no greater than a 45 degree angle when a corner mounted doorway is utilized; v) the height of any enclosed utility/storage structure is limited to one story not to exceed fifteen (15) feet in actual height; and vi) any expansion of an existing enclosed utility/storage structure shall include the footprint of the existing enclosed utility/storage structure, except where the existing structure may encroach into the side yard setback. b) An attached screened-in porch elevated or at ground level with a solid roof structure, architecturally compatible with its associated recreation vehicle, not to exceed an area equal to the area of the recreational vehicle to which it is attached. Said screened-in porch may provide for any site utility/storage space requirements as herein provided and shall not contain any other interior walls. All such screened enclosures must be permitted and constructed according to this Code and applicable building codes. No heating, air conditioning or heater systems or parts of systems including ducts or grills may be constructed or contained in such screened-in porch. Exterior walls may be enclosed with vinyl windows, except that the storage area may be enclosed with the same material as the principal unit. SECTION TWO: EFFECTIVE DATE, This Ordinance shall become effective upon filing with the Department of State. All such screened enclosures must be permitted and constructed according to this Code and applicable building codes. While I reside at 1590 Ludlow Road in Marco Island, I have had a lot at the Pelican Lake Motorcoach Resort since 2005. That address is 4881 Southern Breeze Drive. My wife and I have enjoyed Pelican Lake for many years and are dismayed at the proposed changes to the PUD. As the former President of the Pelican Lake POA Board for four years, I am very familiar with the challenges, lifestyle and the opportunities that this community presents to the owners and the County. I have followed the events of the last year closely,even meeting with Howard Potter of Pelican Lake and Ray Bellows of your office to explore and understand the process and discuss various alternatives. As currently presented to the County, I cannot support the requested change to the PUD for the following reasons: 1. Too many buildings/square footage on the lot. With very few exceptions, most lots are narrow and long. As proposed,the new 350 square feet(interior space- 16x24 exterior dimensions) accessory structure when combined with the existing 100 square foot storage structure and the proposed 350 attached screen room as delineated in the drawings (see attached) are too much for the lots to handle and maintain the outdoor feel and openness of the park. In answer to owner complaints at the October Pelican Lake Board meeting, it is my understanding that the applicant is working to correct this situation to only one building of the above dimensions. However, it has also been stated that the screen room portion (an additional 350 square feet under roof attached to the new proposed accessory structure, so effectively a lanai) can be administratively be added to the PUD at a later date if owners change our documents prohibiting screen rooms as the current PUD allows a screen room attached to the motorhome thereby creating a 700 square foot structure. Why is 350 square feet or ultimately 700 square feet too much? These structure(s)will increase the noise level between owners lots as the structure(s)will have screen rooms, cooking and dining facilities that will be used to entertain guests and become the de facto principal residence rather than the motorhome. Loud TVs, air-conditioning units, and parties only 13 feet away from your bedroom window on a motorhome next door will ruin the experience for the neighbor. Currently, noise between lots is not a common complaint. In the evening, people are in their 1 9A motorhomes which are quite soundproof. Large attached screen rooms/porches/lanai's or sliding glass doors to a large livable guesthouse area will create the potential for a significant increase in sound complaints and decrease the value of a quiet evening at the park and replace it with the noisy neighbor next door! The uniqueness of Pelican Lake is the large lots, unlike other RV parks in the County and for that matter in the United States. These relatively large lots,with their extensive vegetation providing visual screening, are a significant asset to the park and provide an unusual level of quiet and privacy for a motorhome park(please visit Neapolitan Cove nearby to the courthouse or the Naples Nbtorcoach RV Resort both on Tamiami Trail to see the difference). While a vote was taken of the owners, in no way were the additional items of maintaining the existing structure or an additional attached screen room/lanai presented to the owners. While the current PUD allows for a screen room attached to the motorhome, owners specifically voted against free-standing screen rooms in 2010 and that prohibition is in our documents. It was also unclear that the structure would be 350 square feet of interior space as opposed to a 350 square foot footprint. As part of a recently released proposal for new Architectural Guidelines(10-29-13) to clarify the one structure rule, the Pelican Lake Board has complicated the situation by proposing six different square footage buildings (12x16, 14x20, 14x22, 16x20, 16x22, 16x24). While some may say that this allows "flexibility" in terms of fitting the building to the lot size, I say,who and how are the various buildings sizes to be determined for each individual lot? What is the process? Board approval? Sign-off by neighbors? What's the due process? POA Boards are notorious for not acting impartially and this proposal sets up a situation rife with potential conflict. Note that I believe this is also in conflict with the oft-cited owner survey that recommended one size and one style As a corollary to the excessive square footage argument for each lot, each drawing you have received for the application is not to scale and ignores several relevant facts. Motorhomes today have slideouts that extend up to 30 inches on each side but more importantly, awnings that extend out up to eight feet. The architectural guidelines for Pelican Lake as revised for the new accessory structure allow a sixteen inch overhang from the building exterior dimension and allow for full wrap-around awnings. Today there are numerous examples in the park of four and five foot awnings extending out from the current coach houses. The guidelines also allow for an outdoor kitchen and again references the relevant County setbacks. What I don't see in the drawings or mention of in the PUD is exactly how all of this is going to fit on the lots, particularly the smaller lots. The devil is in the details. You may ask, why is this important? With awnings extending out from the motorhome and the accessory structure combined with an outdoor kitchen, I believe,the close proximity creates a significant fire hazard. While the outdoor kitchen is an obvious source, it should be noted that we have had two significant coach fires over the last few years (see pictures below). In each case, damage was done to the coach house on the lot and on the neighboring coach house as each of these fires were of remarkable intensity. While I believe fire management has reviewed the application, I am concerned that the extension 2 9A of awnings and close proximity of the structures and the motorhome have not fully been evaluated. A domino-effect fire spreading from coach to coach or coach house,while unlikely, needs to be considered in the specific language of the PUD and argues for smaller structures with significant room and setbacks to avoid such a catastrophic situation. 2. Inconsistent with TTRV. In my reading of the LDC and the TTRV zoning as a novice, I have been troubled by the use of the term accessory structure in the application as opposed to the utility/storage term used in the current PUD. It is clear to me and most owners that additional storage is needed on the lots and that resulted in the overwhelming supportive vote of the owners. What is not clear is how big the new structure should be nor its intended uses. To me and many owners I have spoken with, 225 to 250 square feet as a utility/storage building to be configured internally consistent with TTRV zoning would be sufficient. Throughout this process, the Board has portrayed the accessory use structure as a guesthouse. (See the attached pictures that have been presented to owners as examples of what they can build). The drawings and statements have clearly influenced owners to believe that the new structure will be a guesthouse complete with cooking, sleeping, bathroom facilities and fully air-conditioned. From the drawings you can see that the emphasis is on living quarters as opposed to utility/storage. That is where I am confused. My understanding is that accessory structures were those structures ancillary to the operation of the park, i.e., the mailroom building, the maintenance shed, the clubhouse, the guard house etc. Guesthouse seems to me to be a whole new definition. Why not a guesthouse? While it is laudable that it would be great to accommodate guests such as your kids and the grandkids on a temporary basis, instead of having to stay at nearby hotels (essentially the motorhome is really a two- person only abode), having a guesthouse capable of acting as living quarters will violate the TTRV zoning. The accessory structure as proposed will be able to be rented, occupied on a permanent basis, used to establish permanent residency, and accommodate guests for long periods of time inconsistent with our documents and the LDC. I have trouble understanding how"camping cabins", as defined in TTRV, have many restrictions such as, "no cooking facilities, a space restriction of 220 square feet, and no long-term occupancy(14 days), and yet we are about to approve a structure that is substantially larger and will set a precedent as a guesthouse. As currently implemented in the PUD,the 100 Square foot utility/storage"shed"which we call a "coach house", has evolved from the bare wall structure that was originally installed to a plethora of elaborate interior variations complete with bathrooms with tubs or showers, kitchens, offices, laundry facilities,woman's wardrobe closets and on and on limited only by imagination and money. While elaborate,they are still incidental to the motorhome, are difficult at best to act as sleeping quarters, although grandchildren do sleep in them on futons, and all share a commonality of being used for storage or an add-on space/feature when the motorhome gets too small during long winter days. The proposed new structure of any size will also morph into just about anything money and imagination can buy, but with a much larger footprint and clearly 3 9A the ability to act as a living space with or without the motorhome. In studying the LDC, I see that the County does have a definition of a guesthouse in its residential zoning requirements ( 5.03.03). I am confused as to how this definition is different than what has been proposed and sold to the residents of Pelican Lake. I have included the drawings used at meetings and posted in the public areas so that you can see that while the verbiage may be opaque and legal,the perception and marketing efforts of the Board to the owners are as a livable space regardless of the final dimensions. LDC 5.03.03 certainly has many restrictions (no leasing, 10x larger lot size, 20 foot setback from the principal structure) most of which would apply to the proposed accessory structure at Pelican Lake. While you may say that restrictions can be put in the PUD or in County codes, Pelican Lake has a history of ignoring County rules and regulations, a long-standing history of ignoring building code requirements and permits (many of the current utility/storage structures did not receive building permits for the electrical/plumbing/finishing). Enforcement then becomes a matter of Architectural Guidelines as enacted by the Pelican Lake POA Board and enforcement by the management company. For two reasons this is unacceptable and dangerous. ARC guidelines can be changed simply by a vote of four Pelican Lake Board members, not the majority of owners. So restrictions today can be gone tomorrow or 14 days from a duly called meeting. And as a former Board President, I can tell you that it is very difficult to enforce the County rules. You are asking a management company and a Board to do your job with our neighbors while being hamstrung by the Chapter 720 State POA statutes as to enforcement or fines that we as an Association can use to enforce the rules. While I can appreciate that you are not Code Enforcement,the history is such that violations will occur and they will not be reported. It is therefore imperative that the PUD amendment be very narrow and targeted to exactly what is expected and not a broad-based amendment subject to revision and interpretation by a small group of POA Board members. It is interesting to note that both the County bed tax on rentals and the state sales tax on rentals will become even more difficult to enforce or collect if these guesthouses are constructed in the manner which is intended by the Board. While the current Board has made efforts to secure the park, it is difficult at best to keep and maintain the necessary records of exactly who is in the park on any given lot as required by the statutes. Why? Because individual owners rent out their lots without informing the office. Rentals handled through the real estate agents are generally compliant but not always and many owners rent lots for six months and a day to avoid the bed tax while in reality the renters are there for shorter periods of time. While technically it's not your problem, it is a situation that does occur and will only be aggravated by structures that are capable of being lived in with or without a motorhome on the lot. How will a 14 day restriction if imposed on occupancy be enforced and by whom? Finally, I would implore you to seek a reasonable solution that does provide additional storage. Many owners have golf carts and copious amounts of outdoor furniture. As the park is occupied for such a short period of time, storage of these items is a legitimate concern especially during 4 9A hurricane season. Many owners go home in April and completely forget about our storms until it is too late despite warnings from management and the Board, so storage is something that is desirable but I believe that living space capable of supporting medium to long-term occupancy is not what is necessary to solve the problem. My name is Doug Williford. My wife, Cathy, and I have owned a lot at Pelican Lake for seven years. Our lot is 11797 Southern Breeze Drive• We also have a home on Marco Island. We sold our motorhome about a year ago and still wanted to keep our lot• We love our lot and the life style of' Pelican Lake• We really spent most of our time living outside either on our lot or visiting Friends. Pelican Lake is simply beautiful, large lots with wonderful tropical landscaping. Most owners spend one to three months a year at Pelican Lake- We however, spent six to twelve months a year at Pelican Lake- Because so many people have added outdoor furniture, this has resulted in some having to rent off site storage- Thus, the need for more storage space. Note I refer to storage space. Our current storage (coach house) building is an exterior 70x70' structure- We are able to put a bamboo bar, a small fridge and a table and four chairs inside, not our golf cart. My wife and I do not have a problem with a slightly larger storage building, exterior measurement 70'x111' or 76', certainly no more than exterior of 200 s•f We like to be able to sleep in our motorhome with the windows open, not listening to A/C-Heat compressors going on and off 9A outside our bedroom window. We don't need to have people cooking and sleeping/living in the storage buildings (coach houses). Remember, many owners, including us rent out our lots when they are not here. No matter what you are told, people will be staying on lots in the coach house without a motorhome• This is a motorhome park with people that travel and live, the RV/motorhome lifestyle• We are against the proposed changes in the PUD• Many people in the park are against this change, but will not say anything because of the political atmosphere that goes on in the park. When we purchased 3 years ago, it was in large part due to the open and spacious lots and the relative quiet and peacefulness in the Park. The interest from some in our community to increase the size of our 10 X 10 structures currently allowed gives us a great deal of concern. First of all, the 100 sq ft utility/storage shed currently allowed is adequate for most of the residents. For those who have more patio furniture and need a larger storage facility, I feel expanding the existing shed to 200 sq ft would be suitable. Most of the motor homes at the park are 40-45 feet long. Most also have 4 slide outs that when opened up give an estimated 450 sq ft of interior living space. Add to that,the awnings that are approximately 180 sq ft or more and you can see there really is very little space for some of the 400+sq ft additional room being proposed. The utility sheds are not to be used as a residence, guest quarters and such and that was exactly what I expected when buying there. I personally do not want to hear a lot of noise from ACs and Heating units all around me when I am on vacation and plan on a quiet area with a beautiful view of the foliage and landscaping, Another issue is screen rooms. The residents voted against these rooms just before we moved to Pelican Lake. One of the main concerns was that of the 289 lots, only 3 or 4 are inhabited during the summer when hurricanes are an issue. It was feared the unattended screen rooms would be a real hazard during storms.Who can disagree with that? We have what is arguably the most beautiful RV Resort in the country and pray we can keep it that way. It is my sincere wish to keep things as they were presented when I purchased. If approval is given for a 50-100% increase in the size of the utility shed, I would agree to that. I wish you could come to see the beautiful area we love before making any decision to change it. This is one of the key aspects of the community that sets it apart from condominiums and other residential alternatives in Collier County. Almost every owner has the ability to purchase a free standing home if their needs change or they tire of the Pelican Lake lifestyle. We believe the indoor space on our lots should be of a size that makes it clear that Pelican Lake is a motorhome resort and not a motorhome community such as Mt. Olive Shores,where the mo- torhome is the accessory space. Hearthside Grove in Petosky,Michigan achieves a nice balance of blending a motorhome lot with a reasonable size coach house. The coach house size at Hearthside is approximately 12'by 16',with enough room for a small kitchen, sitting area and bathroom. It is not large enough to encourage overnight stays,yet gives extra space for use in cool or rainy weather. Our lush landscape has alway been one of the most valuable resources of this resort. Having traveled much of the country, few motorhome resorts offer such special surroundings as Pelican Lake. The larger the coach house,the larger the negative effect on the whole resort. Not only does a large coach house have an impact on an individual lot's landscaping,but also the whole look of the resort and the views from other's lot. The motorhomes in this park,without slides extended are approximately 270 square feet to 360 square feet. A coach house larger than one's motorhome is out of proportion to the lifestyle that has been chosen by living at Pelican Lake. 9Ar- s tom With a coach house approximately the size of the ones at Hearthside, 12'x 16',most lots could accommodate these with little change to the landscaping. All discussions and information disseminated to residents concerning the proposed accessory structure spoke to "footprint" or outside dimensions. In fact, the drawings presented to the residents clearly show not only outside dimensions, but an accessory structure considerably less than the 350 square feet proposed. (see drawings attached) 3) If approved by the County, the proposed amendment as written will allow two buildings on each lot: the current 10' x 10' utility/storage building and the new accessory structure. The information given to the membership never indicated that both buildings would be permitted. All discussions regarding this proposed amendment, whether at Board meetings, informational meetings, written correspondences, or casual conversations with Board members, clearly stated the plan was to replace the current 100 square foot storage/utility area with the proposed accessory structure. There was NEVER any public discussion to ADD subsection c) as a "stand-alone paragraph" as indicated in the proposed amendment. No one noticed that the ballot used to approve the submission of the proposed amendment to Collier County added a new sub-paragraph to section 3.3.B.6 as subsection c) without any modification to sub-paragraph a) effectively and legally leaving in place approval to have both the 100 square foot utility/storage building and the 350 square foot accessory structure on each lot at Pelican Lake. (On November 22, 9A 2013, the current Association President told us that the ballot presented to the membership for a vote was never reviewed by our attorney). To retain the language in the proposed amendment as sub-paragraph c) without modification to sub-paragraph a) is simply unacceptable. 4) At no time was there ever any discussion regarding the addition of a covered porch to be attached to the proposed accessory structure as shown in the drawings submitted to the County and there is no language in the proposed amendment for such a porch. While the current language in the Pelican Lake PUD allows a covered porch, that language only refers to the recreational vehicle and not to the accessory structure. In conclusion, we strongly object to this amendment as written. The proposed accessory structure is too large for most of the lots at Pelican Lake. I have been a lot owner going on 11 years.The structure we have now was put there as a storage unit to store out door furniture when the lot was not occupied. It also serves as a tool shed. If the ordinance is changed to allow a larger structure which is now being considered that will allow people to live in them. Pelican Lake is considered to be one of the top RV parks in the nation.We have allowed the owner to use their individual imagination in regards to landscaping and driveway surfaces. By allowing different size structures to be built they will detract from the beauty of the park.These structures will be misused and will go against our by-laws,which states only one residence is allowed on the lot.So if the owner parks an RV on the lot,then the RV is considered to be a residence,then the structure can not be used as such.. By allowing a 308sq foot structure, would not allow the RV to put out slides and awnings and maintain the proper set back between the RV and the structure.. There is little question our storage sheds (as they were originally used) need to be replaced. The question that needs answering is how large the replacements should be. Pelican Lake Motorcoach Resort is a unique and special resort like none other. It truly is a SW Florida treasure. While there are other Class A Motorcach Resorts in the US, none have the remarkable foliage so unique to this area. To remove some of the foliage to simply have very large buildings would be tragic. I also understand there is a movement to add screened enclosures later to whatever may be approved. The application is to triple the current size of 100 sq.ft. where only 60 is actually allowed. In my opinion, 250 sq.ft.max. is more than adequate. I have attached photos of coach houses from two other Class A Motorcoach resorts. Hearthside in Petosky, Mich. is arguably the finest motorcoach resort in the country. Larger lots than Pelican Lake and beautiful coach houses of only 192 sq.ft. Signature Motorcoach Resort around the corner from us on Route 41 with smaller lots is now offering attractive coach houses of only 120 sq.ft. END OF MEMORANDUM Page 1 of 1 i 9A January 22, 2014 Chairwoman Georgia AHiller, Esq. and Commissioners: Thank you for allowing me to express my thoughts on your upcoming discussion and decision as to the amendment to the Pelican Lake RV Resort PUD (Petition Number PUDA-PL 20130000476). My concerns today revolve around the proposal before you that was an outcome of the December 5, 2013 Planning Commission hearing which resulted in a negotiated resolution for a utility/storage shed of 308 square feet(sf)with six conditional stipulations. For me,the 308 sf represent an absolute maximum size that is not ideal given the variety of lot sizes in the resort. Ideally the maximum size should be closer to 200 sf or 300 sf inclusive of any screened-in (non-air-conditioned) area. As pointed out in the hearing by staff and Chairman Strain, Pelican Lake's current 100 sf shed is a variant from the 60 sf norm in the LDC and thus the 308 sf represents a 5X increase. The 308 sf is also substantially larger than the 220 sf for camping cabins which have similar characteristics and limitations as specified in the underlying TTRV zoning for this PUD. This is too large for many of the lots. The Pelican Lake Board will argue that self-imposed architectural controls will police the size. This will not happen as it pits neighbor against neighbor and cedes control away from professional staff and oversight by the County. The objective for the resort is additional storage space NOT a mini house or guest house for entertaining/sleeping/cooking or accommodation of temporary guests as has been consistently portrayed in presentations to owners. The principal residence IS the motorhome. The larger the structure, the more the temptation there is for owners to use the space as living quarters, guest rooms, or small businesses. While all this is prohibited in our Pelican Lake documents,this will be very difficult to police by either the County or the resort staff or Board and potentially removes revenue from the County through lower bed taxes when used to house guests. The use of the structure for entertaining, as proposed by the Pelican Lake Board, and reiterated at our most recent Board meeting, creates a structure that is prone to increased levels of noise to neighbors on very small lots. Chairman Strain carefully crafted six conditions and now the Pelican Lake Board of Directors wants to renegotiate those constraints. I am NOT in support of any changes which will result in the potential for increased levels of noise by allowing doors on the lake-side of the structure or allowing the air-conditioning to be moved to the buffer between lots thereby placing it only 8 feet for a neighbor's bedroom window. If 308 sf is allowed and "entertainment" space is part of the structure,this will undoubtedly increase the noise footprint and sliding glass doors on the lake side of the structure will send noise reverberating across the water. 9A As I stated, most of our lots are quite small with extensive vegetation. A structure of 308 sf plus a 45 foot motorhome with slideouts and a 40'x 9' awning extended from the coach,two cars, a motorcycle and/or golf cart in many cases, plus an outdoor kitchen and furniture will overwhelm a typical lot. Yes there are lots that can support that much stuff and you can see the need to have additional storage space, but is 308 sf the answer? Variable size buildings have been proposed but NOT mandated by lot size and the Pelican Lake Board and owners have rejected proposals for structure size based on a variable like a percentage. The Pelican Lake Board contends that the Architectural Review Committee (ARC)will enforce strict guidelines as developed by the community. My experience as the former President of this organization is that they will be difficult if not impossible to enforce, as it puts a non-professional group of people in charge of enforcement, hampered by a weak Florida Statute (720)for HOA's that does not give any teeth to the Board's enforcement actions. Furthermore, ARC guidelines can be changed under our documents by a simple majority Board vote not an owner vote so what exists today can be gone tomorrow as Boards change over time. Whatever your decision, I implore you to be very strict and clear in your definitions, and stipulations, as we as a community are ill-equipped to referee or enforce self-imposed guidelines as well-intentioned as they are. It just does not happen. We have 289 very assertive and successful owners who will test the boundaries of any agreement, so it would behoove you to carefully constrain the possibilities as it will serve the community better in the future.
