Resolution 1991-156 RESOLUTION NO. 91-_156 FEBRUARY 12, 1991 A RESOLUTION INITIATING A PROGRAM FOR THE PURPOSE OF PROVIDING ROADSIDE IMPROVEMENTS WITHIN THE EUCLID AND LAKELAND AVENUES ROADSIDE IMPROVEMENTS MUNICIPAL SERVICE BENEFIT UNIT; DESIGNATING THE NAME OF THE SPECIAL ASSESSMENT DISTRICT; DESCRIBING THE AREA TO BE IMPROVED AND PROVIDING THAT THE COST OF SUCH IMPROVEMENTS SHALL BE PAID FROM ASSESSMENTS AGAINST BENEFITED PROPERTIES; INSTRUCTING THE COUNTY TRANSPORTATION SERVICES DIVISION TO PREPARE THE PLANS AND SPECIFICATIONS, ESTIMATE OF THE COSTS OF THE PROJECT AND A TENTATIVE ASSESSMENT ROLL. WHEREAS, the Board of County Commissioners on February 12, 1991 held a public hearing to create the Euclid and Lakeland Avenues Roadside Improvements Municipal Service Benefit Unit (hereinafter referred to as "the Unit"; and WHEREAS, on February 12, 1991 the Board adopted Resolution No. 91- 155creating the Unit; and WHEREAS, the aforementioned resolution, did set forth that el the cost of the roadside improvements within the Unit shall be paid by the levy and collection of special assessments against the benefited properties within the Unit. • NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Section One. This Resolution is adopted pursuant to the provisions of Section 125.01, Florida Statutes, Collier County Ordinance No. 88-23 and other applicable provisions of law. • Section Two. It is hereby found and determined as follows: A. The special assessment district created shall be officially known as "Euclid and Lakeland Avenues Roadside Improvements Assessment District". B. The special assessment district shall comprise all those lands within the Euclid and Lakeland Avenues Roadside Improvements Municipal Service Benefit Unit as described in Resolution No. 91- 155and more particularly described as: All of Section 24, Township 48 South, Range 25 East, Collier County, Florida, less the following four described areas of • said Section 24: • 1. The East 1/4 of the East 1/2. 2. The Northwest 1/4 of the Northwest 1/4. 3. The West 1/2 of the Southwest 1/4 of the Northwest 1/4. 4. The North 1/2 of the Northwest 1/4 of the Northwest 1/4 of the Southwest 1/4. ® COO PAGE 21 1 FEBRUARY 12, 1991 C. It is necessary for the continued preservation of the health, welfare, convenience and safety of the citizens and inhabitants of the Willoughby Acres area to provide for the construction of replacing open roadside ditches on Euclid Avenue and Lakeland Avenue with stormwater pipes with associated catchbasins, bikepaths, road and utility repairs (the "Project") described in Exhibit "A" attached hereto and incorporated herein. D. The cost of construction shall be payable by the levy and collection of special assessments against the properties benefiting from the construction of the Project. Such cost, in addition to the specific items contained in such plans and specifications may be deemed to include legal services, engineering costs, acquisition costs, administrative expenses, etc. Section Three. Construction of such assessable improvements I, ; constituting the Project is hereby ordered pursuant to the provisions of Collier County Ordinance No. 88-23 and other applicable provisions of law. Section Four. The Board does hereby direct the County Transportation Service Division to prepare in triplicate the preliminary plans, specifications and cost estimates for the improvements constituting the Project. The Board also hereby directs the County Transportation Services Division to prepare in triplicate the Tent,t.ve Assessment Roll, which roll shall contain: A. The description of the lots and parcels of real property within the Unit which will benefit from such assessable improvements and the estimated amount of benefits to each such lot or parcel of property, provided such lots and parcels shall include the property of the County, and any school district, special district, or political subdivision. B. The name and address of the owner of record of each lot and parcel as shown on the current County Tax Rolls. C. The total estimated cost of the project to each 1111 JJQ0 PAGE 22 • benefited lot or parcel. FEBRUARY 12, 1991 D. The method of assessment utilized in determining the cost of the project to be assessed to property owners, including any formulas for dealing with irregular lots and any assumptions of depth of the lots. One set of the triplicates of each of the preliminary plans, specifications, cost estimate of the project and Tentative Assessment Roll shall be filed with the Clerk and be open to the inspection of the public. ,Section Five. After completion of the Project and within sixty (60) days after confirmation of the assessments, any assessment may be paid at the office of the Clerk, without interest. Thereafter all assessments shall be payable in equal • annual installments, with an interest rate and installment period to be established upon completion of the construction of the improvements, on the unpaid balances from the expiration of said sixty (60) days; provided, however, any assessment may be paid at • any time before due, together with interest accrued thereon to the date of payment. Such assessments shall be levied on a per • dwelling unit basis against all lots and lands within the Euclid and Lakeland Avenues Roadside Improvements Municipal Service Benefit Unit, or otherwise specially benefited thereby and designated on the assessment roll. The assessments shall be levied against such properties in direct proportion to the benefits received from the construction of the project. Section Six. After the sixty (60) day period referenced in Section 5, the assessments as finally determined and confirmed shall be payable at the office of the Tax Collector of Collier County at the same time as the ad valorem taxes of such County are collected, and all assessments shall constitute a lien upon the properties so assessed, of the same nature and to the same extent as the lien thereon for County ad valorem taxes falling due in the same year or years in which such assessments or installments thereof fall due. As an alternative to the foregoing, the County may contract with the Property Appraiser and Tax Collector to include the special assessments on the ad valorem tax bills.
