HEX Final Decision 2014-36 HEX NO. 2014—36 HEARING EXAMINER DECISION PETITION NO. SV-PL20140001151 —Two Lakes of Naples, LLC requests a variance from LDC 5.06.04.F.1, which limits multiple-occupancy parcels with 150 feet or more of public street frontage to one pole sign, or two pole signs if there is a minimum of a 1,000-foot separation between such signs, to instead allow two pole signs with a minimum of a 570.52- foot separation, for the Two Lakes commercial condominium, located within the Two Lakes Plaza PUD, Ordinance 00-63, on the east side of U.S. 41, in Section 9, Township 48 South, Range 25 East, Collier County, Florida. DATE OF HEARING: November 13, 2014. STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant and the public, and the recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section 5.06.08 B of the Land Development Code has been met and the petition should be approved. ANALYSIS: One member of the public from the adjacent residential area to the east requested additional information and clarification pertaining to the sign location, how the applicant's property is divided, and illumination of this second sign. The applicant explained their reasons for the separation between signs, and that any lighting of this sign will be limited to that allowed by the LDC. The applicant noted that both the increased preserves along the north of the property as well as the splitting of the south parcel to another entity created the necessity for a reduced distance as requested by this variance. DECISION: Petition SV- PL20140001151, filed by Chris Lascano of Phoenix Associates of South Florida, Inc., on behalf of Two Lakes of Naples, LLC, is hereby approved for a variance from Section 5.06.04.F.1, to allow two pole signs with a minimum of a 570.52-foot separation, for the Two Lakes commercial condominium located within the Two Lakes Plaza Planned Unit Development on the property hereinafter described, in accordance with the Proposed Site Plan attached as Exhibit "A".
