HEARING EXAMINER DECISION
PETITION NO. BD-PL20140000455 — James and Rhonda Kabcenell request approval to
construct a tiki hut on an existing single-family boat dock, for a total protrusion of 18.6 feet
into the waterway, not to exceed the 20-foot limitation for covered dock structures in LDC
Section 5.03.06, for the benefit of Lot 29, Block C, Conner's Vanderbilt Beach Estates, Unit
No. 1 subdivision, also described as 290 Channel Drive, in Section 29, Township 48 South,
Range 25 East, Collier County, Florida.
DATE OF HEARING: October 23, 2014.
STAFF RECOMMENDATION: Approval.
FINDINGS:
Based on the applicant's written petition, testimony at the hearing of the applicant , and the
recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section 5.03.06
of the Land Development Code has been met and the petition should be approved.
DECISION:
The Hearing Examiner hereby approves Petition No. BD-PL20140000455, filed by James and
Rhonda Kabcenell, to construct a tiki hut on an existing single-family boat dock on the property
described herein, in accordance with the Proposed Site Plan attached as Exhibit"A".
ATTACHMENTS: Exhibit A—Proposed Site Plan
LEGAL DESCRIPTION: Lot 29, Block C, Conner's Vanderbilt Beach Estates, Unit No. 1,
according to the Plat thereof recorded in Plat Book 3, Pages 8 and 9, Public Records of Collier
County, Florida.
APPEALS:
This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as
amended, a Hearing Examiner Decision may be appealed to the Board of County
Commissioners, Collier County. Appeals must be filed within 30 days of the date the Hearing
Examiner Decision is rendered.
