HEX Final Decision 2014-29 HEX NO. 2014—29 HEARING EXAMINER DECISION PETITION NO. PDI-PL20140000966 — Cameron Partners, LLC requests an insubstantial change to Ordinance No. 03-40, as amended, the Heritage Bay Planned Unit Development, to add a one way emergency medical service access drive from the adjacent CR 951 Extension to Tract 1 of the Cameron Commons Subdivision plat. The PUD consists of 2,562± acres located on the northeast corner of Immokalee Road and Collier Boulevard (CR 951) in Sections 13, 14, 23 and 24, Township 48 South, Range 26 East, Collier County, Florida. DATE OF HEARING: September 25, 2014 STAFF RECOMMENDATION: Approval. FINDINGS: Based on the applicant's written petition, testimony at the hearing of the applicant, and the recommendation of staff, the Hearing Examiner finds that the criteria set forth in Sections 10.02.13 E.1 and 10.02.13 E.2 of the Land Development Code has been met and the petition should be approved. DECISION: The Hearing Examiner hereby approves Petition Number PDI-PL20140000966, filed by Frederick Hood, AICP, of Davidson Engineering, Inc. representing Cameron Partners, LLC, with respect to the property as described in Ordinance No. 03-40, as amended, the Heritage Bay Planned Unit Development, for an insubstantial change to add a one way emergency medical service access drive from the adjacent CR 951 Extension to Tract 1 of the Cameron Commons Subdivision plat. Said change is shown in the Heritage Bay PUD revised Master Plan attached as Exhibit"A", and is subject to the condition(s) set forth below. ATTACHMENTS: Exhibit A—revised Master Plan LEGAL DESCRIPTION: See Ordinance No. 03-40, as amended, the Heritage Bay PUD. CONDITIONS: 1. The proposed access shall be limited to right-in only. 2. Adequate signage informing motorist that this is an "Emergency Vehicles Only" access shall be provided at the time of filing the first SDP for subsequent installation prior to site occupation in accordance with regulations governing signage in the PUD and LDC. An emergency services accessible automated gate shall be provided at this limited access point at the time of filing the first SDP for subsequent installation prior to site occupation. 4. A minimum of a 30' throat length will be required on site at all times. It shall remain the financial responsibility of the parcel owner to maintain a 30' throat length. Failure to maintain this minimum safety requirement may result in temporary closure of this access point until such time that the minimum safe throat length is restored. APPEALS: This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013-25, as amended, a Hearing Examiner Decision may be appealed to the Board of County Commissioners, Collier County.
