Resolution 2014-124 RESOLUTION NO. 2014- 124 A RESOLUTION AUTHORIZING THE CONDEMNATION OF THOSE PERPETUAL EASEMENT INTERESTS NECESSARY FOR THE CONSTRUCTION OF ROADWAY, DRAINAGE AND UTILITY IMPROVEMENTS REQUIRED FOR THE EXPANSION OF GOLDEN GATE BOULEVARD FROM 8TH STREET EAST TO 12TH STREET EAST. (PROJECT NO. 60040.) WHEREAS, the expansion of Golden Gate Boulevard from 8th Street East to 12th Street East(hereinafter referred to as"the Project"), as part of the Golden Gate Boulevard Project (Project No. 60040), is included in Collier County's Five Year Transportation Work Program; and WHEREAS,plans and specifications have been prepared for construction of the Project; and WHEREAS, construction of the Project will require the acquisition of perpetual easement interests; and WHEREAS, County must secure an Environmental Resource Permit("ERP") from the South Florida Water Management District("SFWMD")prior to commencing construction on the Golden Gate Boulevard widening project; and WHEREAS, County has been advised by SFWMD that, as a condition for the issuance of the ERP, boat ramps at all bridge crossings must be provided to facilitate maintenance of the p g g p water courses and water control structures as contemplated by the Cooperative Agreement between South Florida Water Management District on Behalf of the Big Cypress Basin and Collier County, dated February 19, 1991, as amended; and WHEREAS,the Project's engineers have identified vacant properties located at the intersection of Golden Gate Boulevard and all major canal bridge crossings, and have designed boat ramp facilities on each of these properties to accommodate Big Cypress Basin's maintenance responsibilities under the Cooperative Agreement(above); and WHEREAS, securing all required permits qualifies as a County purpose; and WHEREAS, the location for the construction of the proposed improvements has been fixed by survey and is collectively represented by the legal descriptions comprising Exhibit "A", attached hereto and incorporated herein; and WHEREAS, after consideration of the availability of alternate routes and locations,the comparative costs of the Project alternatives, various impacts upon the environment, long range planning options, and public safety considerations,the Board desires to exercise its right to condemn property for public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been determined by the Board that it is necessary and in the public's best interest to acquire the perpetual easement interests described in Exhibit"A" ("the Property") for the purpose of constructing the improvements proposed as part of the Project in order to protect the health, safety and welfare of the citizens of Collier County. AND IT IS FURTHER RESOLVED that acquisition of the Property and construction of the Project upon the Property is an integral part of the County's long range planning effort, and is included in the Capital Improvement Element of the Collier County Growth Management Plan, as approved by the Florida Department of Economic Opportunity. AND IT IS FURTHER RESOLVED that the Board has reviewed the technical report and considered the presentation concerning alternative locations for the Project, various impacts to the environment, public health, safety and welfare considerations associated with the design -Page 2- and construction of the Project, and the costs associated with the design,property rights acquisition, and construction of the Project; and the Board finds that after consideration of these issues, the most feasible location for construction of the proposed improvements is collectively represented by the legal descriptions comprising Exhibit "A", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that the taking of the perpetual non-exclusive road right-of-way, drainage and utility easements, along with the right-of-way and boat ramp easement, will provide the County with the right to place and/or excavate materials for the purpose of constructing, operating, and maintaining roadway, bikepath and sidewalk improvements, drainage structures including but not limited to ditches, swales, earthen berms, rip-rap and retaining wall systems, underground pipes, various types of water control structures and any and all manner of public and private utility facilities within the easement areas. These easements also include the right to remove and use any and all excavated material. AND IT IS FURTHER RESOLVED that all property acquired pursuant to this Resolution shall be put to public purposes. AND IT IS FURTHER RESOLVED that the County Manager or his designee and the Office of the County Attorney are hereby authorized and directed to immediately acquire by gift, purchase or condemnation, in accordance with the provisions of Chapters 73, 74 and 127,Florida Statutes, the Property more particularly described in Exhibit "A", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that no mobile homes are located on the property sought to be acquired and therefore it will not be necessary to remove any mobile homes from the property to be acquired. -Page 3- CqU: This Resolution, adopted on this Nth day of lane, , 2014, after motion, second and majority vote.
