1. Affiant is the Vice President of Related Capri
Housing, Inc., a Florida corporation (the "General Partner"), the
sole general partner of Eastridge Partners, Ltd., a Florida limited
partnership (the ,,Partnership"), and has actual knowledge of the
matters set forth in this Owner's Affidavit.
2. The Partnership is the owner of the following
described real property located in Collier County, Florida (the
"Property"):
See Exhibit "A" attached hereto and made a
part hereof.
3. The Partnership is a duly formed, validly existing
limited partnership in good standing under the laws of the State of
Florida.
4. The General Partner has the authority to execute and
deliver all documents required to be executed and delivered to the
Board of County Commissioners of Collier County, Florida, as the
governing body of Collier County and as Ex-Officio the Governing
Board of the Collier County Water-Sewer District, in connection
with the dedication or conveyance by the Partnership of water and
sewer utility facilities and a Utility Easement located within or
upon the Property
5. There are no parties other than the Partnership in
possession of, or claiming possession to, the Property, and the
Partnership is in undisputed possession thereof.
6. The Property is free and clear of all liens, taxes,
encumbrances and claims of every kind, nature and description
whatsoever, except for matters listed in th~ certain Attorney's
Affidavit from Brian J. McDonough dated /J/~ ~ , 1997 (the
"Attorney's Affidavit"). d
7. There have been no improvements, alterations or
repairs to the Property for which the costs thereof remain unpaid.
8. There are no mechanics', materialmen's or laborers,
liens against the Property.
9. The Partnership knows of no violations of (i) the
covenants, conditions and restrictions of record affecting the
Property, or (ii) municipal, county or state laws or ordinances
pertaining to the Property, or in the use and occupancy thereof.
10. There are no actions or proceedings now pending in
any state or federal court to which the Partnership or the General
Partner are a party, including, but not limited to, proceedings in
bankruptcy, receivership or insolvency and, co the best of
Partnership's knowledge, there are no judgments or liens of any
nature which constitute or could constitute a charge or lien upon
the Property, except as set forth in the Attorney's Affidavit.
11. This Owner's Affidavit is made for the purpose of
inducing Collier County to accept the dedication or conveyance by
the Partnership of water and sewer utility facilities and a Utility
Easement located within or upon the Property.

personally known, whose current business address and telephone
number are: 150 W. Flagler Street, Suite 2200, Miami, Florida
33130, (305)789-3350 (hereinafter the "Affiant"), who, being duly
sworn on his oath, does say:
1. This Affidavit is given as an inducement to the Board of
County Commissioners of Collier County, Florida, as the governing
body of Collier County and as Ex-Officio the Governing Board of the
Collier County Water-Sewer District to accept the dedication or
conveyance of water and sewer utility facilities and a Utility
Easement (the "Easement") located within or upon the real property
described in the attached Exhibit "A", which is incorporated herein
by reference (the "Property"), said land being located in Collier
County, Florida.
2. The Affiant has examined record title information to the
Property, including but not limited to, information requested from
the Florida Secretary of State relative to any Uniform Commercial
Code financing statements.
3. The record owner of the Property is Eastridge Partners,
Ltd., a Florida limited partnership (hereinafter "Owner"). The
Owner acquired record title to the Property by instrument recorded
in Official Records Book 1357, Page 1760, of the Public Records of
Collier County, Florida.
4. The Owner is a Florida limited partnership, in good
standing, active and current under the laws of the State of
Florida. A copy of the Certificate of Good Standing for the
limited partnership is attached hereto and incorporated herein as
Exhibit "B" The sole general partner of the Owner is Related
Capri Housing, Inc., a Florida corporation (hereinafter the
"General Partner"). The General Partner is in good standing,
active and current under the laws of the State of Florida. Angel
Hernandez is a Vice President of the General Partner and, as such,
is authorized to execute all documents in connection with the
conveyance of the water and sewer facilities and the Utility
Easement on behalf of the General Partner and as an act of the
Owner.
5. The Real Property is encumbered of record in the Public
Records of Collier County, Florida, by the exceptions listed and
particularly identified on Exhibit "C" attached hereto and made a
part hereof.
6. The Property is also encumbered by various UCC-1
Financing Statements described on Exhibit "D" attached hereto and
made a part hereof. Said UCC-1 Financing Statements cover all
property rights whether personal, mixed or otherwise including
accounts, general intangibles, equipment and inventory, which are
located at or which are used in connection with or arise out of the
conduct of the debtor's business related to the Property.

(hereinafter referred to as "Surety"), are held and fixrely bound unto Collier County, Florida (hereinafter
called "County"), in the total aggregate penal stun of Two Thousand Six Hundred Thirty Six and Fifty
cents Dollars ($2,636.50) in lawful money of the Urnted State, for the payment of which sum well and
truly to be made, we bind ourselves, our heirs, executors, administrators, successors, and assigns, jointly
and severally, firmly by these presents. Owners and Surety are named for singular or plural, as the
context requires.
THE CONDITION OF THIS OBLIGATION is such that whereas, the Owner entered into a
certain Utilities Facilities Construction Contract, dated the /~/t{ day of May, 1997, a copy of which is
hereto attached and made a part hereof; and
WHEREAS, the County has a material interest in the performance of said Contract; and
WHEREAS the County has adopted Ordinances and Resolutions (hereinafter "Land
Development Regulations") concertting the Owner's obligations to the County regarding the construction,
conveyance and warranty of water4tltt:ama~ facilities at the Villas of Capri, Project No. SDP #94-123-A
consuucted within the Unincorporated area of Collier County;
NOW, THEREFORE, ff the Owner shall well, truly and faithfully perform its obligations and
duties to the County under said Land Development Regulations and all the undermJdngs, covenants,
terms, conditions, and agreements of said contract during the ori~nal term thereof, and any extensions
thereof which may be granted by the Owner, with or without notice to the Surety and during the guaranty
period established by the County, and thereafter, and if the Owner shall satisfy all claims and demands
incurred under such contract, and shall fully indemnify and save harmless the County from all costs and
damages which it may suffer by reason of failure to do so, and sh_nll reimburse and repay the County all
outlay and expenses which the County may recur in making good any default, then this obligation shall be
void, otherwise to remain in full force and effect.
PROVIDED, FURTHEK that the said Surety, for value received hereby, stipulates and agrees
that no ch_n_nge, extension of time, alteration or addition to the terms of the contract or to work to be
performed thereunder or the specifications accompanying same shall in any way affect obligation on this
Bond, and it does hereby waive notice of any such change, extension of t/me, alteration or addition to the
terms of the conUact or to the work or to the spec/fication.
PROVIDED, FURTHEK that it is expressly agreed that the Bond shall be deemed amended
automatically and immediately, without formal and separate amendments hereto, upon amendment to the
Contract not increasing the contract price more than 20 percent, so as to bind the Owner and the Surety to
the full and faithful performance of the contract as so amended. The term "Amendment", whenever used
in this Bond, and whether referring to this Bond, the Contract or other documents shall include any
alteration, addition or modification of any character whatsoever.

Code, Section 3. All water and/or sewer facilities approved, accepted and required to be
maintained by Collier County shall be conveyed to the County pursuant to the provisions
set forth in Collier County Ordinance No. 97-17, as amended.
You are reminded that it is your responsibility to petition the Development Services
Director for final approval of the improvements upon the expiration of the minimum one
(1) year maintenance period. After satisfactory completion of all final inspections., the
Board of County Commissioners shall grant final approval of the required improvements
establishing County responsibility for maintenance of the required improvements if it is
the Board's desire to accept and maintain the facilities.

The undersigned warrants all its work performed, and all the materials and equipment fumished,
in connection with the above referenced project to be free from all defects in material
workmanship for a period of one (1) year from the date of acceptance by the Board of
Commissioners. Additionally, the undersigned agrees to remedy all defects arising within that
period at its expense.
The term "defects" shall not be construed as embracing damage arising from misuse, negligence,
acts of God, normal wear and tear or failure to follow operating instructions.

This Fire District does not except ownership nor does it maintain

tests was paid for on June 6, 1997 in the amount of $105.00.
