HEARING EXAMINER DECISION
PETITION NO. BD- PL20130002355 — Charles Bateman requests a waiver for a 20 -foot
boat dock extension over the maximum 20 feet allowed by the Land Development Code for
a total protrusion of 40 feet to accommodate a docking facility for the benefit of Lot 76,
Port of the Islands (The Cays) Phase II Subdivision, also described as 186 Sunset Cay in
Section 9, Township 52 South, Range 28 East, Collier County, Florida.

FINnING C-
Based on the applicant's written petition, testimony at the hearing of the applicant and the public,
and the recommendation of staff, the Hearing Examiner finds that the criteria set forth in Section
5.03.06 of the Land Development Code has been met and the petition should be approved.
ANALYSIS:
The applicant met all primary criteria and 5 of the 6 secondary criteria for the boat dock
extension. Secondary criteria #6 was not applicable to this application. There was no public
opposition.
The Hearing Examiner hereby ap rp oves Petition No. BD- PL20130002355, filed by Kris W.
Thoemke of Coastal Engineering Consultants, Inc., representing Charles Bateman, for a 20 -foot
boat dock extension over the maximum 20 feet allowed by the Land Development Code for a
total protrusion of 40 feet to accommodate a docking facility on the property described herein, in
accordance with the Proposed Site Plan attached as Exhibit "A ".

LEGAL DESCRIPTION: Lot 76, Port of the Islands, Phase II, according to the Plat thereof as
recorded in Plat Book 21, Pages 1 through 4, Public Records of Collier County, Florida.

This decision becomes effective on the date it is rendered. Pursuant to Ordinance 2013 -25, as
amended, a Hearing Examiner Decision may be appealed to the Board of County
Commissioners, Collier County. Appeals must be filed within 30 days of the date the Hearing
Examiner Decision is rendered.
